Consumer Complaint: My husband and I knew this was a simple loan with a high interest rate when we signed the contract. What we didn't know, is that we would be paying such unexplained, extensive fees that don't allow us to get ahead and payoff this loan. According, to our math, we estimate a balance of roughly {$5000.00} not {$13000.00}. We have had some health hardships and we have stayed in contact with Santander through this. The worst has been this last year when I was diagnosed with pericarditis, which resulted in a pericardial effussion ( my cardiologist believes from Covid, due to the timing and symptoms ). Unfortunately, I had to be out of work and again I was in contact with Santander, but apparently they continued to charge outrageous extra fees. XX/XX/XXXX - I spoke with XXXX in regard to a payoff amount. My husband and I figured we would be close since we had just paid off our truck for {$18000.00} that we had bought XX/XX/XXXX. XXXX informed me that we still have a payoff of {$13000.00}. He informed me of the extra fees, but was unable to specify exactly for what. I had asked for a detailed payment statement and have yet to receive it. XXXX was very kind and informed me of the Santander settlement and that is what is bringing me here. XX/XX/XXXX - My husband and I spoke with a Santander employee who was not so kind and very difficult to work with and once again, he also was unable to specify the exact reason and amounts of the fees.

Consumer Complaint: I am XXXX and have had Health issues that are out of my control. And have had a really tough time paying my bills due to the economy and the prices to live going up. Ive called and told them. Begged for them to work with me, this vehicle is the only vehicle I have. I have drs visits and stuff I have to be able to get to. They repoed the vehicle last night. Didnt knock on the door or attempt to contact me. After calling they want the full payoff. Not whats past due. They refuse to work with me and are very hateful. Ive had severe anxiety over the whole situation for days and I cant take nothing else.

Consumer Complaint: Santander has a charge off on my credit file on an account that is in litigation due to predatory lending between XX/XX/XXXX, XXXX XXXX. Louisiana Attorney General XXXX XXXX has picked this up due to the predatory lending. They reported inaccurate payment dates. They repossessed the vehicle and sold it for over the amount that was supposedly left owed. Keep in mind I paid over XXXX and put XXXX down on a XXXX $ car. They are XXXX $ is owed and it is not. This debt is no longer owed and they have sold it to multiple collection companies. XXXX XXXX XXXX sent me a dunning letter trying to collect XXXX $ that I received in the mail on XX/XX/2021. This debt is not owed.

Consumer Complaint: Santander Consumer USA settled a multistate lawsuit with 33 states. The settlement resolves allegations that Santander violated consumer protection laws by exposing subprime consumers to unnecessarily high levels of risk by placing them into auto loans that Santander had determined had a high probability of default. My loan met the same criteria. I purchased my vehicle in XX/XX/XXXX and defaulted before XX/XX/XXXX. I've attached my loan documents for your review. I received notice from the MD Attorney General 's office outlining the relief I'd receive as a result of the settlement. I would receive a restitution payment and loan deficiency balance waiver. Neither of these have happened. Santander has only made payments to 2 entities so far. It has filed a motion with the NJ Bankruptcy court to have my chapter XXXX vacated so that it can repossess my vehicle.

Consumer Complaint: Had a loan with Santander consumer in XXXX and in XX/XX/XXXX my vehicle was stolen wrecked and damaged. The insurance company I had then XXXX contacted them got the settlement amount from what they had as blue book value and sent them a check. The same thing as my gap insurance done. They are mailing and calling now stating I still owe a balance which it was taken care of then. They have no proof to show that they didn't settle with my insurance company. I know they did because I had to give XXXX the okay when they came up with the total amount they emailed me the statement amount minus deductible, etc .... Then gap insurance was to cover the remaining balance after XXXX paid. Santander told me when I contacted them about it that, the gap insurance didn't pay the balance in full. Which I know they did! So now that I have called to complain they close the account on my credit file which hasn't been 7 years but it still shows closed with the balance they claim I owe. Then they stated they been collecting interest on it.

The actual 1st date of delinquency makes this account over seven years old and therefore outdated.

Consumer Complaint: In XXXX of 2018 the vehicle in question was totaled. The other drivers insurance took the blame because the vehicle was rear ended. The loan was given with GAP, and the other drivers insurance paid XXXX towards the loan with GAP supposed to pay the rest. GAP didn't pay the rest because the loan company ( SANTANDER consumer USA ) reported the wrong amount that was due for some reason. They subtracted two months of payments instead of going on the amount from the date of the accident. So GAP didn't pay the whole amount, and they put it towards us to pay ( which we shouldnt have had to because we paid for the GAP insurance ). They kept the account open for 2 years allowing the payments to accrue interest before charging it off instead of trying to make more money by making us pay instead of letting GAP take care of the payments.

Consumer Complaint: When I bought my XXXX XXXX from XXXX XXXX in Missouri, I was conned into trading in my car, getting less then half the trade was worth. They added a service contract that I never asked for which cost XXXX $ I had problems left and right with the vehicle, and the warranty the service contract came with. Hasnt covered any of the cars issues that they claim are not covered, but when I call the warranty company they are. When I signed the paperwork I asked before signing why is there 2 amounts on the document, they assured me I was paying the XXXX. The listing price for the car was that much, I got approved and then at the last minute when I was finished signing the paper work the lender they said that approved me changed there mind. They then magically found Santander USA and charged me 25 % casual interest. Now Im paying XXXX for a car thats worth XXXX if that anymore. I didnt want the car at that point and they told me that I couldnt get out of the contract due to signing it. When they mailed me the title to the car, the bill of sale, title and legal documents were for a car that I didnt purchase. It took them months to finally get me the needed proper documentation to legally show Im owner of the property. I just need help refinancing. I dont feel it was within my constitutionally protected rights. I never agreed to be financed thru Santander. But the I was scared into believing when they said even if I broke the contract and ended it, I would still owe for the loan on the car.
