Consumer Complaint: One of XXXX XXXX XXXX credit card debt collectors keeps calling me after i told them like 2 or 3 times to stop calling me. I even told them that its harrassment to continue calling me. I disputed back around XX/XX/XXXX because i didn't authorize it and someone took it out in my name without me knowing about it. It was approximately taken out in my name around XX/XX/XXXX i think guessing and its over 10 years old the debt. I told them i ain't paying it either and they can't go after me since its over 7 years old. I would like them to stop calling me repeatedly harrassing me for the {$900.00} something debt owed since its been disputed and its over 10 years old. Im not going to pay them because i didn't authorize it. I want to be left alone and not contacted again by them.

Consumer Complaint: XXXX XXXX is reporting a false, unvalidated account on my credit report. I sent them certified letter on XX/XX/2018. To which they responded with their own account summery with does not meet Fair Debt Collection Practices Act requirements for validation of debt. The did not provide any proof of any signed agreement I had the the alleged original creditor. Not only did they fail to validate this debt with in 30 days as required by law, they also took collection activity by adding erroneous accounts to my credit report. I also sent them a SECOND certified letter on XX/XX/2018 to which they have ignored.

Consumer Complaint: I received a letter from a debt collection company by the name of XXXX XXXX XXXX XXXX dated XX/XX/XXXX - which states that the current creditor is XXXX XXXX who is in affiliation with Resurgent Captial. The letter they sent me clearly violates the FDCPA 807 ( 10 ) " False or misleading representations '' in which the preclude to the letter states " Assigned as a Pre-Legal Account ''. The letter continues on with multiple misleading and confusing statements cited as : If we can not resolve this account, our client will place the account with a law firm and in the same paragraph goes on to state We do not make any decision whether to place any account with a law firm as that decision rests solely with our client. No decision will be made regarding whether to place any account with a law firm until after the end of time frame described below. This is clearly misleading as in one sentence they tell me it WILL be placed with a law firm and a few sentences later it is inferred that it may or may not be sent to a law firm by the beginning sentence of No decision will be made regarding whether to place. This is an illegal practice under FDCPA in which the debt collector is threatening legal action that has no proven intent and is also violation committed by XXXX XXXX XXXX under FDCPA 807 ( G ) ( 5 ). Any letter from a debt collector or creditor has to be clear and concise and be able to be understood by the least sophisticated consumer. The materiality element of the Least Sophisticated Debtor Standard does not hinge on what an ordinary individual might reasonably interpret from a debtors communication, but rather, a material statement is one that has a natural tendency to influence or has the capability of influencing the decision of the decisionmaking body to which it was addressed. Id. Here, the relevant decisionmaking body is the least sophisticated debtor. Id. ( citing XXXX v. XXXX XXXX, XXXX XXXX XXXX, XXXX ( XXXX Cir. XXXX ). Furthermore, XXXX XXXX XXXX states that the " current creditor '' is XXXX XXXX. Under the FDCPA the term " creditor '' is defined as anyone who extends or offers credit. XXXX XXXX XXXX nor XXXX XXXX ( Resurgent Capital ) has ever extended or offered any credit to me.

They keep sending me the same credit card statement which does not show proof of validation. I have sent them 2 different letters ( dated XX/XX/XXXX and XX/XX/XXXX ) attempting to settle this because I want it off my credit reports and they have not sent me anything trying to accept payment or settle the account. It has been well over 30 days and I would like to have this account off my credit report ASAP. Thanks in advance!
