Consumer Complaint: The company LVNV funding LLC calls repeatedly. I disputed errors on my credit and this account was removed and later reinserted. I file a dispute again and again then its removed and then it on my credit again. The company calls over and over sometimes after XXXX XXXX call this morning claiming I refuse to pay could be sued. I feel helpless as a consumer. Even once an account is 7 years old the collection companies still call and pretend to be lawyers. LVNV Funding is the only company that does this. It causes extreme stress and I dont understand why a collection agency could treat people like this. I spoke with company explained I was unemployed and couldnt make and arrangements. The lady on the phone became very rude. This company calls sometimes 9 times a day. This cant be the way to take care of one credit card with finger hit. There were over 500.00 in fees. I dont know what else to do. I answer the call so they wont call all day but they do either way.

I immediately contacted them by phone only to be on hold for an extensive period of time. I also sent them a certified letter to the address on my credit which is LVNV Funding LLC XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NV XXXX and the letter was returned. However the account remains on my credit and I was not notified before they placed the account on my credit .... put simply the unknown debt was not verified and I can not reach them

Consumer Complaint: I'm filing a complaint against the collection agency Resurgent Capital Services. They are one of the collection agencies that the credit card company XXXX XXXX uses to collect on delinquent accounts. The account became delinquent by me in the Fall of XXXX, which was a very bad year for me financially. About 2 years ago I was able to start working on paying this debt off with Resurgent Capital Services. The payment was {$25.00} a month due on the XXXX of the month, with funds being drawn directly from my bank account. Everything was going well I thought until I was notified by XXXX Credit Bureau in XXXX of this year that an account was in collection against me for {$880.00}, from a company by the name of Cach LLC, and that the account had been opened with this company in XX/XX/XXXX. No additional information was given about this company. I contacted XXXX and informed them I was disputing this collection item. They filed my dispute and did an investigation. They sent me a letter of the results of their investigation in XXXX of this year. The letter stated the account was mine and they gave me the name of the company Resurgent Capital Services, as the collection agency. The delinquent account had been placed with the agency in XX/XX/XXXX and that the last payment received was {$25.00} on XX/XX/XXXX. I also was given their address of XXXX XXXX XXXX, XXXX, SC XXXX and their phone number of XXXX. I never received any mail or a phone call from this collection agency informing me of any issues with payments. I did call the collection agency and they informed me their third party company, ( I was not given a name ), had sent the account back to them but had never gave them a reason why the third party company had stopped collecting payments. Resurgent Capital Services further informed me that when I originally set up payments it was with their third party company and not them. I then asked why I never received any mail or a phone call informing of a problem. Resurgent stated they or their third party companies don't usually call or send letters when there is a problem. I then asked how do I get back to paying on the delinquent account. Resurgent then stated they had already assigned my account to another third party company. I stated I didn't want to work with another third party company again. Finally I was able to set up a monthly payment of {$25.00}, directly with Resurgent Capital Services and have paid my XXXX payment already. My complaint with Resurgent Capital Services, is the way they handle my account and now I have a negative mark on my credit reports that they have made and will not remove.

Consumer Complaint: LVNV Funding, LLC has reported an erroneous collection to the credit bureaus. They claim that I owe XXXX XXXX. I have NEVER had a XXXX XXXX credit card. I've asked LVNV via USPS certified mail to show an agreement that authorizes them to collect this alleged debt, an agreement that bears the signature of the alleged debtor wherein he promises to pay the alleged debtor, and complete payment history on this account as to prove that the debt amount you wish to collect is correct. They have provided NEITHER. This company 's irresponsible behavior has tarnished my credit worthiness.

Consumer Complaint: I have attempted to send a debt validation letter to this company, at the address they provided to the CRA 's. This address is not a valid address and my certified letter was returned. This intentionally deceptive act has prevented me from requesting a validation letter. Furthermore it violates the Deceptive Trade Act as noted below. When you try to reach LVNV the phone dials Resurgent Capitol Services. The original debt owner took me to court, I won the case ( dismissed with prejudiced in my favor ). This behavior is is also in violation of the FDCPA/FCRA/TDCPA Sec. 17.462. LISTING OF BUSINESS LOCATION OF CERTAIN BUSINESSES. b ) A person is considered to misrepresent the geographical location of a business for purposes of Subsection ( a ) if the name of the business indicates that the business is located in a geographical area and : ( 1 ) the business is not located within the geographical area indicated ; ( 2 ) the listing fails to identify the municipality and state of the business 's geographical location ; and ( 3 ) a telephone call to the local telephone number : ( A ) listed in the directory or database routinely is forwarded or transferred to a location that is outside the calling area covered by the directory or database in which the number is listed ; or ( B ) provided on the Internet website or in a print advertisement routinely is forwarded or transferred to a location that is outside the calling area of the geographical area as indicated by the name of the business. I am unaware of this account and have no verification this debt is mine. I only know of this account based on it being reported in my credit report ( s ). Consumer Complaint: LVNV FUNDING LLC has won a court order against me by default but I never received any mail about it. They did not have my current address on file at the time. I was paying {$50.00} per month for an alleged credit card debt owed in the amount of {$1300.00}. Per many inquiries made with the credit bureaus, the company still has not provided proof of validation with my original signature. The information is on my 3 bureau credit reports and is affecting my ability to apply for a loan. I ask that the company removes the negative information of my credit reports and refund the money they took from my account for payments, in form of a check. The current balance owed is listed as {$1100.00}.
