Consumer Complaint: This is a complaint against Resurgent Capital Services. The original creditor being XXXX XXXX. I paid off this balance and received the letter stating that the account was settled in full on XX/XX/2019 and it was actually settled on XX/XX/2019. Resurgent Capital has continued to debit my account for {$90.00} which should not be happening since I was finished paying this off on XX/XX/2019 and it is illegal! I want Resurgent Capital Services to stop reporting to all three of my credit bureau reports ( XXXX, XXXX and XXXX ) immediately. They have engaged in illegal behavior and I am actually contemplating suing them in civil court. I have called several times, each time I got a letter in the mail saying that they were going to debit my account AGAIN. They always said that the account has been closed in their office. Then why are they still taking money from me??!!!

I have never entered into any contract or signed any documents or made any agreement with this collections agency. They have no right to furnish any information on my credit report. I never gave them any permission. Also, I sent a debt validation letter to them and they have not sent a valid response. They should be shut down! They are taking advantage of XXXX VETERANS like myself. They are adding stress to my life and making it impossible for me to obtain credit. As you know, an account in collection is A DELINQUENT OR PAST-DUE ACCOUNT transferred from routine account to the collection department ( or a collection agency ). Under the federal Fair Debt Collection Practices Act, a debt collector generally is a person or a company that regularly COLLECTS DEBTS OWED TO OTHERS, usually when those DEBTS ARE PAST-DUE. Based on the information provided above, this debt is no longer in collection. Reporting information that you know to be inaccurate, or failing to report information correctly, violates the Fair Credit Reporting Act.

Consumer Complaint: I have received 5 emails from LVNV.. Funding LLC stating I owe {$540.00} to XXXX XXXX XXXX. I email lvnv funding telling them that is not the correct amount that I owe it is less the what they have stated. I have done some research on this company and this company like to add fees on top of whats owed. Lvnv expect me to pay the fees that has been added to the original amount that is owed. And I have contacted them by email and i told them it was illegal. I also told them I'm not working so Im unable to make a payment to them and If I was working the account wouldn't have landed to their office. Unfortunately, I still receive receive emails from them and they would like me to talk to them but I prefer that they contact me through email instead.

Consumer Complaint: I am lodging a formal complaint against lvnv funding. this debt buyer has intentionally continued to report derogatory information on my credit reports that isnt mine.i have requested thru mail since XX/XX/2017, debt validation for this account on my reports. and they have ignored my request but continue to report every month. lvnv also never sent me a dunning notice in the mail before they reported which is a violation of the fcra/fdcpa act. i have called and spoke to them about this and they continue to tell me we dont have to send you anything in the mail before we report on your reports which is a lie. this debt is for a XXXX XXXX XXXX credit card which i never had before. ive never had XXXX XXXX XXXX on any of my credit reports which i spoke to them and told them. the representatives told me they dont care and i need to just pay. i am in the process of purchasing my very first home and this errounous account is holding me back. i am requesting immediate deletion of this account from my credit reports and no further action will be taken. if not i will be reporting to my state and lvnv state attorney general offices, and contacting legal options. thanks for your time.

Consumer Complaint: I XXXX XXXX am a XXXX year old retired woman. I along with my husband are on a fixed social security income. In addition, my husband has been hospitalized most of 2019 and is in a XXXX. I keep receiving invoices from a law firm located in Pennsylvania, claiming that they are trying to collect a debt from a debt buyer known as LVNV Funding LLC. The letter also claims that the original creditor was XXXX XXXX XXXX XXXX. I believe that this debt is so old that it can no longer be collected in the state of Tennessee. However, I can not pay this collection, and between my husband 's health and my own personal issues, I request a full history of this debt, including its sale to the debt buyer entity. I request forgiveness of this debt in exchange for a 1099C income against me and my personal income taxes. I simply have no money to pay on this invoice, and I along with my husband are in poor health. Thank you!

Consumer Complaint: This HORRIBLE company has repeatedly tried to contact me on a debt that is not mine for {$1300.00} I've sent them a letter via CERTIFIED MAIL/RETURN RECEIPT they received on XX/XX/19 asking them to stop calling me and to prove the debt is mine. They have failed to provide me with a signed contract with my signature that shows I entered into any contractual agreement. They have sent me a very graphic and threatening text message to try to scare me, to my phone, with continued phone calls, false reporting on my credit reports, contacting my relatives, and other third parties. including getting robocalls. You are now in violation of the FCPDA, and are now subject to fines of {$1000.00}, plus actual damages and attorneys fees, which I may collect from you by filing a claim in small claims court. You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. In addition, the Fair Credit Reporting Act ( FCRA ) does not allow the inaccurate reporting of information on my credit report and under this act. Therefore, if you do not immediately remove this account from my credit report, you are subject to another {$1000.00} fine, plus punitive damages. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies. I intend to follow through with the suit if I do not hear back from you within 15 days.
