Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b } that your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate to bring legal action against you for the following : Violation of the Fair Credit Reporting Act Violation of the Fair Debt Collection Practices Act Defamation of Character If your offices can provide proper documentation as requested in the following Declaration, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing any information with a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate, when in fact there is no provided proof that it is accurate. If your company fails to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit report and a copy of such deletion { to any/all of the 3 major credit reporting bureaus : XXXX, XXXX and XXXX } request shall be sent to me immediately. Consumer Complaint: The past few months have been incredibly difficult for me. I saw these accounts on my credit, and I do not know what an LVNV funding is or why it's on my credit. I read the FCRA and learned that I have the right to dispute the account and request verification. I have many times now, requested said verification, which I still have not received. I have however received threatening phone calls from agents of the company. I have asked them several times to cease telephone communication and to send me information by writing, which they have refused many time!

Consumer Complaint: LVNV is a collection account owned by Resurgent Capital Services. There is a collection on a credit card for the amount of XXXX dollars. I contacted Resurgent and they sent me a letter that I dont have any collection accounts with them. So far XXXX is the only credit bureau that has deleted this inaccurate account from my report. XXXX and XXXX has not corrected my credit report even after uploading the documents proving my claims and uploading the letter from Resurgent. XXXX and XXXX are really the problem with this collection account that does not belong to me.

Consumer Complaint: Original creditor : XXXX XXXX XXXX and Company account was sold to LVNV Funding LLC is in Violation of Federal law. ( Please see attachment for further details ) After challenging LVNV Funding LLC to accurately validate Account of which they have purchased from XXXX XXXX XXXX account # XXXX. This account is currently being reported illegally. And must be deleted from my consumer reports immediately. Please note : the original creditor claims that they received last payment on this account in XX/XX/XXXX. But never closed the account. Account was not closed and I was not notified that account has been closed. As stated in writing the company claims that last payment was made in XXXX of XXXX but was not closed or charged-off until 233 days later in my of XXXX this is illegal. And be proven in court! Since account was not closed the account occurred interest and fees that was then added to the balance, of which can not be accurately verified. In addition I've made multiple attempts to have LVNV Funding LLC and the credit bureaus validate this account of which they have not done.

Consumer Complaint: LVNV Funding will not provide full debt validation in writing when I have repeatedly asked for it. They claim that I owe them XXXX after purchasing this old debt from XXXX XXXX XXXX XXXX XXXX. I have gotten nothing but hung up on when calling this collector. XXXX will not fully investigate this matter. Perhaps my choice of verbiage when filing my dispute was considered inferior, because I filed a 2nd dispute online today and as soon as I hit send, I received an immediate message from them informing me that I could not dispute this item again, as a recent dispute was just closed. This is indeed maddening. I am not being given full proof or validation to substantiate the decision backing the validity of this debt. LVNV reports that the last 4 numbers of the account end in XXXX, and that the status of the account is closed. The most recent negative report date by them being today, XX/XX/2020. Also XXXX XXXX / XXXX XXXX XXXX, and Resurgent Capital are reporting on this same account as well. I did not think an account could be double or triple reported whether the account was accurate or not. XXXX XXXX XXXX XXXX XXXX has sold this account to LVNV some time ago. I have no account number from when it was owned by XXXX XXXX / XXXX XXXX XXXX. Also an interesting thing to note about this account, is that it has no data available. No payment history whatsoever. Yet XXXX XXXX XXXX XXXX, Resurgent Capital, or LVNV insist it is my account, and it is being reported that it is a collection account at all three credit reporting bureaus by one combination or another of the aforementioned companies.

Consumer Complaint: LVNV Funding LLC purchased my account from XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX. The balance was {$780.00}. They reported this collection to the credit bureaus in XXXX of XXXX. It dropped the score from one agency 78 points, and 28 points for another. I contacted LVNV on XX/XX/XXXX, we settled for a lesser amount. I had been working hard to pay my credit collection debts in XXXX and XXXX of XXXX, with positive results. This raised my credit scores to XXXX for XXXX, and XXXX with XXXX. Since LVNV purchased my account in XXXX of XXXX, should've they contacted me before turning this debt over to the reporting agencies? I contacted them today XX/XX/XXXX. They told me they did not have to contact me after purchasing this account since it was a charge off. However they did confirm a verification of payment is being sent in the mail as of XX/XX/XXXX. Were they supposed to contact me before hand? If so, since the debt is settled, can this be deleted from my history, and can my previous credit score be reinstated? Please advise.
