Issue: Written notification about debt

Subissue: Notification didn't disclose it was an attempt to collect a debt

Consumer Complaint: I am XXXX XXXX and Im submitting the complaint myself and there is no third party involved. I sent my correspondence to Portfolio Recovery Associates, LLC on XX/XX/2021 in regards to the collection account they are reporting to XXXX and XXXX. Pursuant 15 USC 1692e ( 11 ), a debt collector can not omit that they are attempting to collect a debt. In one of the exhibits provided, it clearly states that Portfolio Recovery Associates, LLC is not attempting to collect a debt, which is against Federal Law. The consumer must be informed of the reason for the initial communication and if this was not an attempt to collect a debt, Portfolio Recovery Associates, LLC would not be reporting this as a collection account to the consumer reporting agencies. Portfolio Recovery Associates, LLC has received all documents and supporting evidence of this dispute through U.S. mail on XX/XX/2021.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: Upon a first notice from Portfolio Recovery I immediately sent a letter disputing the validity of the debt asking for proof within 30 days of the notice which is my right under the FDCPA. The company did not sent any further information to me and continued to ask me to pay for this proposed debt. I followed up with 3 other letters and 2 emails to them and this started back in XX/XX/2021. XX/XX/2021 they reported that this was bad debt on my credit bureau stating DISPUTED RESOLVED- CUSTOMER DISAGREES. This statement is false and disparaging and is highly suggestive that I was in receipt of the proof this was my account. I called the company again today and I was not able to get anyone to resolve this and I need help as they are in violation and I have proof of all my correspondence to them asking for proof and they in turn did not send anything but dunning notices. See attached all my letters sent back to them and not including emails to them since XX/XX/2021.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: A validation of debt letter under Fair Debt Collections Practice Act was sent to Portfolio Recovery Associates but they did not follow the requests of the letter within 30 days. Up to present day they have not provided an original contract that bears my signature. They also failed to provide an affidavit of claim & a certification of authority. Due to their blatant negligence the alleged debt from Portfolio Recovery is considered fraudulent and invalid.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: Someone stole my identity and bought a car under my name and credit score for {$22000.00} in XX/XX/2020. The only reason I found out is that I wanted to get a loan from my credit union and the lady told me I had not made my car payments for over a year. She showed me the information and it shows a collection agency named Portfolio Recovery Associates and also says that I am responsible for the auto loan as well as two other people named : XXXX XXXX and XXXX XXXX. I do not know these people. I did not buy a car or co-sign a car for anyone except my daughter XXXX XXXX. I have never received any phone calls or letters from this collection agency. I believe the thieves did not use my address or phone number because I would have caught this sooner.

Consumer Complaint: In XXXX of 2021 I started to sell one of my properties and was told that a lien was placed on my property by an attorney 's office representing Portfolio Recovery Associates, LLC. During the process I discovered an account was opened that was due to fraud. Portfolio did not handle the matter in a timely fashion thus causing the real estate deal to fall apart. It took them several months to right their wrong when I had proof to show it was not my account.
