Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: Portfolio claimed I owed them debt back in 2019. They sued me- I went and represented myself and explained that I had no knowledge of this debt - they had NO proof and admitted that they did not have a signed contract etc. the case was found in my favor. Then they threatened to take it to an appeals court which would require me to hire a lawyer to navigate. I made payments on this as I did not have the money to fight them but did not quite qualify for any pro bono lawyer ( I live in a rural area ) and could not take the time off from work. I did not know at that time they had to provide what information they used to say the loan is mine or that they can not threaten legal action. Despite the fact that they were told that I had been the victim of identity theft in court and the fact that credit reporting laws prohibit reporting or trying to collect in this case they never deleted it from my report. I never stated I owed them money - I was just scared of getting court costs and garnishments

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: I receive repeated calls from Portfolio Recovery Associates. They call from a different phone number every couple days. I almost always answer the phone and I am greeted by someone telling me their name and asking me to verify sensitive information like address, date of birth and social security number. I then ask who they are and what company they are calling from to make sure I am not giving my information to scammers. The majority of them refuse to tell me what company they are calling from. I then ask why they are calling but they say it is about a personal matter and refuse to give more details until I give them my sensitive information. Several others tell me the name of the company, to which I verify the information and we continue to have a conversation about the debt. I then explain to these folks that I was laid off from work and have had difficulty finding another job due to my specialized industry. I even cried to one of the operators about the trouble I have had over the last 2 years. The other operators have also said they understand the circumstances why I can't pay or make payment arrangements but some have gone as far to ask me if I have family members that can help me out. They also say they will make notes on my account so I do not receive repeated calls but I receive more phone calls just a few days later and have to go back through this same process again with someone else refusing to tell me who they are or why they are asking for my personal info. This has been going on for at least 6 months now and the phone calls average twice a week and always from a different phone number. I have repeatedly asked them to stop the calls and I will be in contact as soon as I can make some kind of arrangements. The only relief I have had was from the operator I cried to. After talking to him, the phone calls stopped for a couple weeks. The phone calls resumed about 3 weeks ago and its now back to the same issues at least twice a week with someone asking for my info while refusing to identify why they are calling or the company they are calling from.

Consumer Complaint: The Company is Portfolio Recovery and they are trying to collect an old XXXX on Credit Card debt. Today they called from a number that was id as XXXX XXXX on my phone caller id. When I called back the recording said Portfolio Recovery, they are calling almost every day, I spoke to them 2 months ago to come up with an agreement and informed them that I still could not pay how much they were asking for, the rep insisted that I had to give a credit card number and she would put a future date on it. I explained to her that any date she puts is not a guarantee that I can pay as I was still not working and even though I was interviewing I had no prospects so not sure how I was going to pay. They stopped calling for a while and started calling back every single day, and today at XXXX pm I got a missed call that said XXXX XXXX XXXX. Since I did not file taxes as I have no income to report, I called back and the recording stated Portfolio Recovery, not XXXX XXXX.

Under the law, the creditor has 30 days to validate or it has to be removed. I have heard nothing in 60 days of proof. Consumer Complaint: Earlier today, I filed a complaint about Portfolio Recovery Associates. The same day they received my complaint, they retaliated by putting XXXX more collections on my XXXX credit report. The accounts in question had already long since aged off all my credit reports ; Portfolio is fabricating dates of delinquency to put these accounts back on my credit report. They have listed the accounts as " closed '' but claim recent payment activity to fraudulently list the accounts. They are selecting XXXX specifically due to XXXX 's long lead time for disputes. Their actions have resulted in an almost XXXX point drop in my credit score on XXXX ( which gets data from XXXX ) and more than XXXX points on XXXX itself. Portfolio 's actions are a clear violation of my rights under the FCRA. They once again fabricated dates and will use stall tactics to harass and inconvenience me.

Consumer Complaint: I sent a letter to Portfolio Recovery Associates on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, asking for the original contract between myself and the original creditor, where I agreed to the assignment of the debt ; with my ink signature. Portfolio Recovery has failed to provide me with the requested documents. However, it has been brought to my attention by my neighbor that Portfolio Recovery have tried to serve me papers with a processor to take me to court for alleged debt. Portfolio Recovery are using horrible/illegal tactics by disclosing to my neighbor of this alleged debt and I have video of this same processor opening my mailbox and going through my mail on XX/XX/XXXX.
