Consumer Complaint: I recently file a complaint with the consumer financial protection bureau on XX/XX/2021 against Portfolio Recovery Associates. At this time i request a cease of all written and oral communications and gave a list of violations under Fair Debt Collections Practices Act. At which stated each violation is 1000.00 15 usc 1692k ( a ) ( 2 ) ( a ) and to verify this alleged debt 15 usc 1692g. Portfolio Recovery Associates did not remove collections while in dispute from my consumer file with the credit reporting agencies under Fair Credit Reporting Act 15 usc 1681i ( a ) ( 1 ) ( a ). I was sent a summons though the mail in feburary that I was being sued in civil court in XXXX and another statement for payment which their main offices are located in virginia which is a violation per federal law to sue someone in another state. Which is violation of previous agreement from response to cfpb and a letter was sent to me though mail to cease all communications 15 usc 1962c ( c ) and 15 usc 1692c ( c ) ( 1 ).

Consumer Complaint: I Have made a complaint already on XX/XX/XXXX, Complaint # XXXX. Against Portfolio Recovery Associates LLC. They had bought XXXX charge off 's, One from XXXX XXXX Bank, XXXX. # XXXX, One from XXXX XXXX Bank, Acc. # XXXX. XXXX, XXXX continue to harass me. I sent them Postal Money Order reciet 's, but they didn't believe me so they kept on harassing me. I paid of the both Credit Card 's off in the year of XXXX. But I lost a reciet from XXXX XXXX, a {$50.00}, and XXXX from XXXX XXXX, a {$150.00}. But I did pay them off in XXXX. As I Received my Pension from the Military 100 % XXXX, I wrote them to tell them that, they won't be receiving any money as I paid off the both cards. I was going to small claims court for these both credit card cases in XXXX XXXX, but the co-vid hit in XXXX, California.They canceled all cases. What I Think is, they know they got taken to the bank in other words. They've lost so their very angry. So they get their pleasure from destroying my credit rating for the last 5 years. Consumer Complaint: XXXX XXXX XXXX XXXX sold my debt for pennies on the dollar to a 3rd party Portfolio Recovery Associates LLC without my permission a violation of the privacy act sold my name date of birth social security number first one XXXX XXXX XXXX ending XXXX XXXX XXXX for {$2300.00} second one XXXX XXXX nbr ending XXXX XXXX XXXX for {$6000.00} in addition to my privacy act Portfolio Recovery was in violation of the FCRA and within 5 days did not provide verification of debt. They have reported to all three credit bureaus that they own the debt as a collection and report that the accounts are seriously past due. a collection by default is past due. Ive attempted 3 times to get this removed from my credit report. most recent through the bureaus dated XX/XX/2022 with a verification of debt letter that was updated in the credit bureaus but no change and no verification sent to me. the credit bureaus repeatedly send to Portfolio rather than deleting the record with clear violations of the FCRA I have never done business intentional with Portfolio Recovery Associates LLC

Your company have violated FCRA 615 ( f ) ( 15 U.S.C. 1681m ( f ) ) ( f ) Prohibition on sale or transfer of debt caused by identity theft You have not responded to my request to provide me with an investigation report. I need this resolve, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence ( 1 ) In general No person ( company ) shall sell, transfer for consideration, or place for collection a debt that such person has been notified under section 1681c-2 of this title has resulted from identity theft. ( 2 ) Applicability The prohibitions of this subsection shall apply to all persons collecting a debt described in paragraph ( 1 ) after the date of a notification under paragraph ( 1 ). ( 3 ) Rule of construction Nothing in this subsection shall be construed to prohibit -- ( A ) The repurchase of a debt in any case in which the assignee of the debt requires such repurchase because the debt has resulted from identity theft ; ( B ) the securitization of a debt or the pledging of a portfolio of debt as collateral in connection with a borrowing ; or ( C ) the transfer of debt as a result of a merger, acquisition, purchase and assumption transaction, or transfer of substantially all of the assets of an entity. A person that furnishes information to any consumer reporting agency shall have in place reasonable procedures to respond to any notification that it receives from a consumer reporting agency under section 1681c-2 of this title relating to information resulting from identity theft, to prevent that person from refurnishing such blocked information. I have reported your company to consumerfinance.gov As a form of record and I am prepare to sue your company in federal court if need be. I am also aware that your company will be liable for actual damages and court fees. Stop collection proceedings against me and remove my information from your database. Consumer Complaint: I reached out to XXXX, XXXX, XXXX and XXXX XXXX and Portfolio Recovery on XX/XX/XXXX. To this date i have not received a response back regarding the fraud listed on my credit file. The collection listed on my file is fraud and should be removed as it is causing hardship with my life plans. I the consumer should not be suffering because of identity theft. According to the consumer law 15 U.S. Code 1681c2 states that a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such an agency. 1.
