Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Dear Portfolio Recovery Associates , LLC I'm in possession of the papers you sent out and I received them on Monday XX/XX/2022. Account number, ( XXXX ). This information is unresponsive to my demand. I demanded proof that I owe you this debt. This is not proof that I owe you this debt. In fact, these papers have no original signature from you, no original signature from the original creditor, or my original signature. The name spelling is incorrect as well on every single piece of paperwork you sent me, therefore being a false representation according to 15 U.S.C 1692e. Please provide me actual verified proof that I owe you this debt before continuing collection activities, otherwise remove this account from my credit report. Also, in your response letter you stated you may contact me directly or through an affiliate or third party. That also is in violation of 15 U.S.C 1692-1692p Sec 806.

Subissue: Frequent or repeated calls
Consumer Complaint: I have been bombarded with constant calls by Portfolio Recovery. They have been calling me every single day for years now trying to collect a credit card debt in the amount of approximately {$1200.00}. My debt is XXXX years old, dating back to XXXX. I finally got tired of the constant calls and answered on XX/XX/XXXX to tell them to stop the harassment on a debt that is void at this point. The call lasted for 4 minutes and the representative had no regard for my request and continued to tell me that they could call me and continue to try to collect. The debt is off my credit report and it is past the statute of limitations to take action upon this debt. They continue to call me and have started to call me multiple times every single day, including weekends.

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: Over the past 2 years I have sent several certified letters trying to get XXXX to correct the errors from a company called " XXXX XXXX '' they are showing as a collection. As well as a company called Portfolio Recovery showing the same. one shows I have a high limit of XXXX and XXXX shows XXXX credit limit. As well as NO records of my one time payments! They have NO dates reporting for either of these companies. ALL my bills show I am an exceptional payment and these 2 companies are significantly damaging my credit by not fixing these errors!!! And after at least 10 certified letters over the past 2 years of giving them information to correct and they still don't update!!! I want these both removed asap or I will now take this to lawsuit. It is too much now all these years.

Subissue: Reporting company used your report improperly
Consumer Complaint: In accordance with complaint # XXXX. I noticed that even after Portfolio Recovery was put on notice via cease and desist they are still communicating with me about an alleged debt via my consumer report. The FDCPA defines the term communication broadly to mean the conveying of information regarding a debt directly or indirectly to any person through any medium '' that includes consumer reports. As I have stated previously I have never contracted with Portfolio Recovery nor have they been able to provide me with a contract in which " I '' the consumer ever had any business transactions or agreement with Portfolio Recovery because there is none. Portfolio Recovery committed identity theft by purchasing my personal identifying information without my consent and then Portfolio Recovery committed aggravated identity theft by using that information to furnish alleged debt to my consumer report without my consent. Parking alleged debt on a consumer report to coerce payment, extort, or intimidate is illegal and is within the legal scope of racketeering and that carries up to 20 years in prison. I've given Portfolio Recovery a chance to cure this matter but they are being willfully non-compliant as well as willfully negligent to my rights as a federally protected consumer. This is the last notice in regards to this matter, a rebuttal is unnecessary and ignorance of the law is no excuse. DELETE the accounts in question from ALL consumer reports upon receipt of this notice.
