Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: I have sent XXXX letters to Portfolio Recovery to inform them the debt was due to Identity Theft but they have ignored it. The last letter was sent on XX/XX/2022 through certified mail and they did receive the letter. Since informing them of the identity theft they have begin to send XXXX to XXXX letters to my address a week trying to collect money for a debt that is not mine. And they have yet to remove the debt from my credit reports after proof of identity theft. This company has repeatedly harassed me over the years through phone and now through mail. I no longer want to be harassed for a debt that is not mine.

Consumer Complaint: I have previously complained about Portfolio recovery and the complaint was closed and nothing was resolved. Complaint # XXXX. Portfolio recovery has been negatively reporting to the credit reporting agencies causing my credit score to drop significantly. I have requested validation of the alleged debt and they have not issued proper validation of this alleged debt, contrary I have come to find out they had a claim against me in court. Furthermore, they never sent me any first communication, yet in their response to my dispute with the credit reporting agencies, they have sent me a " copy '' of a sold letter that allegedly was sent from XXXXXXXX XXXX I have requested of them in several occasions including today via email a copy of the alleged contract between XXXX and Portfolio. Copy of the forward flow agreement. The invoice for how much they bought this alleged debt. All statements and documents provided to them by XXXX that made them believe this alleged debt was valid. Along with the statements as what they sent me was incomplete. I need someone's assistance with this company. They do not care about consumers ' rights and they are just getting away with making consumers ' lives more complicated and stressed and causing the extension of credit difficult.

Consumer Complaint: Portfolio Recovery has been continually calling me daily, everyday, from multiple phone numbers. They report that they are looking to speak to an individual who is not me. I have continually informed them that I am not that person and that they have the incorrect number. I have asked them to stop contacting me, yet the calls continue. They use new phone numbers if i attempt to block their calls. I do not owe these people a debt, they keep calling asking for an individual who is not me. And despite being informed that they have the wrong number, they keep calling.

Consumer Complaint: During the month of XXXX, I sent a notification to Portfolio Recovery Associates about removing 2 old time-barred debts from my credit report, and gave them the standard 30 day to comply, with a mailing address out of state. ( that would be forwarded to me ) They immediately attempted to sue me for one account in hopes of collecting at the mailing address, out of state and beyond the statute of limitations allowable under Nevada State law # XXXX and under the FDCPA 7.2.12.3.1, and have failed to respond within the allowable 30 days on the other. They knowingly knew this is beyond the XXXX, and have fraudulently opened 2 accounts in my name for purposes of collection, after both accounts were already closed. The time-barred debts according to XXXX # XXXX is 4 years max for credit cards, which both accounts they hold are beyond the 4 year maximum.
