Consumer Complaint: XX/XX/XXXX, we were scammed by a company offering to get us a modification of our ARM mortgage. Our mortgage servicer at that time was AHMSI. We received approval for our mod., made our first three trial payments on time, then were informed by AHMSI that we were denied ( after being approved, sending in our XXXX signed, notarized copies, and receiving back the signed copy from AHMSI ) because they had not received " required documents '' ( income tax returns ) that had been sent in numerous times, including the copies given to their field representative in person, who sent them via ups red, with a tracking number. After that they tried to foreclose on us. At that point, I contacted HUD, who contacted AHMSI, and they agreed to do an " inhouse '' modification, and though the terms were not as advantageous, we agreed to, out of fear of losing our home. We made the three payments, but after that, when trying to make a payment by phone, our payment was rejected, the operator informing us that we were in pre-foreclosure ... ..it took two more years before the sheriff arrived at our door with foreclosure papers ... .during that time, apparently our loan was sold to OCWEN, and we had no idea ... ..we were never notified of this event. XX/XX/XXXX, we went to court, and the council for the bank urged us to sign a consent judgement to buy us 120 days to get a loan modification. We agreed, as we thought we did n't have a choice, but since the attorney did n't have the proper paperwork, we did n't sign anything. We had already submitted the loan mod. paperwork to Ocwen, although they claimed not to have received it, so we handed a copy to their attorney. Ocwen approved us for their SAM modification, so we immediately signed, notarized and sent in, via certified mail, the appropriate documents, and also sent in the initial payment 6 weeks early. Meanwhile, their attorney continued to insist that we HAD to sign the consent judgement agreement, which, I believe is considered dual tracking ... Ocwen mis-applied our payment, and we have been receiving phone calls from them, as well as emails from their attorney asking if we intend to make the XX/XX/XXXX payment, which we made XX/XX/XXXX. I responded to their attorney with the corrected info, and she responded to me that I was correct, and that Ocwen was asking about our XX/XX/XXXX payment, which is n't due for weeks! How can they harass us for a payment that is n't even due yet, when we made a payment six weeks early?

Consumer Complaint: 1- My monthly mortgage payment for XX/XX/XXXX was {$1200.00}. I sent in a check in the amount of {$1800.00}. As you can clearly see on the check and on my monthly payment coupon I had stated that I wanted an extra {$600.00} to be applied towards the principal payment. Ocwen failed to apply all of the {$600.00} dollars towards the principal and only applied XXXX towards the principal. XXXX not sure where the other {$19.00} XXXX was applied to? 2- My monthly mortgage payment for XX/XX/XXXX was {$1200.00}. I sent in a check in the amount of XXXX. Ocwen failed to apply all of the {$650.00} dollars towards the principal and only applied {$620.00} towards the principal. XXXX not sure where the other {$22.00} XXXX was applied to? I have tried to resolve this and many other issues with my so called relationship manager XXXX XXXX, I have talked to her a couple times on the phone but every time we have talked she says that she is unable to pull up my account on her end. She had requested that I fax her some of my payment coupons and that she would be able to get everything taken care of. After I did she has never returned any of my calls or e-mails.

Consumer Complaint: In XX/XX/XXXX I purchased a home in XXXX XXXX, Florida the note was in my name and mother placed on the title to show ownership via her present XXXX. My lender was IndytMac to IndyMac XXXX, to XXXX to XXXX additional names. I was notify in XX/XX/XXXX that I was illegally placed in foreclosure. I attempted on XXXX occasions to modify my loan with XXXX acceptance stating document would be XXXX to me then a cancellation stating I did n't qualify for a modification program but completed a six month payment plan. I have payment history of making all my mortgage payments. communicated with my several lenders. All said and done hired a lawyer I filed bankruptcy, it was discharged via mother interest on the title and courts records shows shes not on the mortgage and to this day has XXXX Credit. This stop to auction sale briefly. Now just two weeks ago .another foreclosure went before the court but this time the lender request and era on their part and requested from the court to stop sale and the judge denied request and property was auction off. An appeal was filed to stop transfer of title. Please help I do n't know what else to do other than file a complaint.

My mortage co. was holding XXXX $ in a suspense account I sent them about XXXX $ XX/XX/XXXX cashiers check because they kept returning my payments I would send them a check as the arrangement that was made between the account mgr and myself. He accepted the arrangements. then the arrangements were not good enough. I was to send XXXX $ every 2 weeks. They would take almost 2weeks to cash my checks then charge me more fees. My XXXX is no where to be found and I have been sending my payments via certified mail to ensure they get them My accont is way behind with all their fees they keep changing where my missing $ is and they keep threatingto forclose on my house. they wont fix my account or tell me where my missing $ is I got a payment report from them it says the money was returned to me I never got it and they cant tell me the check # or when it was cashed and it has not been applied to my account.Ever since this company got my loan they have done nothing but mess up my account from the 2nd month they had it

Consumer Complaint: ocwen is my mortgage company that is not my primary. they are the worst!!! this complaint is that when i moved they did not forward my change of address, so by the time i realized my ins had double, it was 3 months in. i found new company for ins and returned the balance insted of putting it to escrows they applied to other payments. i had made a call telling them i wanted it to go to escrows because then the payments would go back to normal. they did not i have been fighting with them since XX/XX/XXXX and now this is hurting my credit. i have a man named XXXX XXXX fromocwen who is suppose to be my consular, he agrees with me that that would have been the correct way of handling the return of ins. he was suppose to make them do that and get back to me. i have called and left a number of messages and he has not called me back.

XXXX and Ocwen Loan Servicing LLC does not have any signed supporting documents such as notes registered at the registry of deeds, because of this XXXX and Ocwen Loan Servicing are breaking the law by denying me my Human and Constitutional Rights and also committing bank fraud.

Consumer Complaint: I will commission into the XXXX XXXX XXXX XXXX in XXXX of 2016. I currently owe more than my home is worth and contacted my servicer about the possibility of a short sale or deed-in-lieu so that I can move to XXXX XXXX XXXX when I go on XXXX. I was told that I had to submit the paperwork for a modification even though a modification will not help my situation. Supposedly I was approved for a modification that will reduce my payment by {$22.00} a month. This does not address my issue, since I am current on my mortgage and have excellent credit. The issue is not the payment, but the fact that I have to move in order to serve my country and can not sell my house due to the decline in the real estate market. Because of my credit and that this is an FHA loan my servicer is telling me that the only way I can get out of it is default on the loan and let it start the foreclosure process in order to be approved for a short sale or deed-in-lieu. The only reason that I am trying to get rid of my house is because I am moving as a result of service in the military. I would like to keep my credit score as high as possible, because I need approval to rent in XXXX. I can not afford to pay rent in XXXX and mortgage in XXXX for a house I no longer live in.
