Consumer Complaint: I have a HAMP Loan XXXX through OCWEN Mortgage. Several years ago you handled another problem I had with them quite satisfactorily. The original loan was through XXXX XXXX XXXX. After some months OCWEN took transfer rights. At the time of transfer OCWEN applied {$430.00} in fees on my monthly statement. I inquired as to why I was getting this added fees. They told me it was transfer fees. This is a HAMP Loan there are no other fees to be applied during the duration of the loan. I refused to pay these fees and to this day they remain on every statement each month. The fees applied to the last statement was {$360.00}, why they dropped I do n't know. I do not owe these fees, I have never been late on this loan and am in good standing on the loan. I 'm getting extremely agitated seeing them on my statement every month listed now as past due fees/other charges. Any help you might give me would be greatly appreciated. As I said you took care of the other problem I had with them right away. This problem did not start appearing until I had the loan with them for several months. Consumer Complaint: Many things but the most recent is after being denied a modification for many reasons and 4 years of being abused and tortured I finally received one in XXXX 2014. I was given a XXXX/XXXX arm. I had numerous questions about the documents but was told if I do n't sign them like it 's written they would take my home. After over 1 1/2 years of making modification payments I receive a statement in XX/XX/XXXX that that said I owed back escrow and my payment will go up almost {$300.00} which is now more than I was paying before the modification. I have not paid the extra money because I think what they 've done once again is illegal. But they are now charging interest on the amount I 'm not paying.

Consumer Complaint: WHAT DOES RACIALLY DISCRIMINATION MEAN TO A BANK / SERVICER / LENDER AND EVEN THE ATTORNEYS THAT REPRESENTS THESE AGENCIES? I got my mortgage loan from XXXX XXXX through a mortgage broker on XX/XX/XXXX. The loan that I agreed initially was not the terms that I signed during the closing. But before I signed the document, I called to the mortgage broker to get him to correct the errors. But the broker assured me that due to time restrain, we should proceed to closing and get he would get the pre-payment penalty restriction to be removed and Interest-Only changed. After closing I called several times but to no availed. Meanwhile I was still making my pay and hoping that the error would be corrected ; but to my surprise from the Servicer at that time ( XXXX XXXX XXXX ), I could not refinanced the loan without paying for the prepaid penalty. On XX/XX/XXXX, since XXXX XXXX XXXX was handling the file, I decided to request for the Beneficiary of my house Note. These requests continued until XX/XX/XXXX, when XXXX produced a fake name of a Beneficiary ( XXXX ) and address of which a certified mail was returned undelivered. On XX/XX/XXXX, the Servicing of my loan was transferred to Ocwen Loan Servicing. I continued to request the same Note Holder 's information and the title information, but always receiving partial documentation ; hoping that I would stop my requests. On XX/XX/XXXX, Ocwen handed my file to XXXX XXXX XXXX XXXX XXXX for trustee sale. I tried to contact the trustee by both telephone and a fax within 20 days of Notice of XXXX to talk to them, but they refused to answer my correspondence. On XXXX XXXX while the trustee was preparing to auction the house, I found a House Bill Report XXXX XXXX which proof that I was within my legal right to request all the documentations and also meeting to resolve the issue before even the Notice of Default could be issued. Even though, the Trustee stop the foreclosure for the " meet and confer '', it was for a short time. It was my understanding that Notice of Default could not be issued until " meet and confer '' had been satisfied. But, Ocwen Loan Servicing and XXXX XXXX XXXX XXXX had teamed up and turned a deaf ears on my requests since I 'm XXXX and having a house in a most sought for in a XXXX XXXX XXXX, had blindly ignore the law and continue to harass me with their premature foreclosure notices.

Consumer Complaint: We are disputing a late payment that was sent on time for XX/XX/XXXX and is on my credit report as a late payment. A payment was sent for {$1500.00} come to find out they never notified us that they went up on the payment and we never received nothing in writing or phone call letting us know that we were short on our payment. Ocwen Loan Servicing received the payment and held the payment in a suspended account and did n't contact us regarding the payment was short. They did n't post the payment until 30 day later when they received XX/XX/XXXX payment. In XX/XX/XXXX we where notified that the payment was short and we sent and addition amount to bring the account up to the right amount, why this was not done in XX/XX/XXXX to avoid a late payment no answer from Ocwen Loan Servicing. We contacted the office and spoke to someone regarding this matter first, we where told that it was not on our part and they would correct this error, now they are saying that the late payment will remain. We are in the process of trying to close on another home that we have purchase and this is showing up on my Credit report as being 30 days late which is not true because I sent the payment and they held the money in a suspended account without notifying me it was short or the amount was increase. My VA loan was denied because of this. I submitting a letter to Ocwen Loan Servicing regarding this matter and they refused to remove the late payment.

Consumer Complaint: My husband and I were relocated for his work. I had tried to sell our home several times but the town it is located in has become very rundown and values have plunged. We decided to rent it out, which worked for a few years but we were still having to pay in to make the mortgage payments. Finally we decided we could no longer try to keep this house, and we live across the country so I submitted the paperwork for a DIL. After 3 months, we were denied, at first Ocwen said it was because we had not missed any payments - which we had, then the story changed when I contacted Ocwen 's XXXX. I was told they reviewed the file and that it was concluded we made enough to pay the mortgage. They based this on a XXXX monthly gross income and a XXXX monthly debt..I requested they send me the guidelines that stated this was a sufficient DTI to live on. After reviewing the numbers we sent in, I noticed my husband actually forgot to include some of our debt.. so now I have to resubmit again, which I have no problem with, but I do not feel that was a legitimate reason for denial, as a family of XXXX can not make it on the numbers we were denied on. Ocwen did this before when I applied for modification of the loan back in 2010, every 3 months they were telling us we needed to resubmit information- that went on for a year before I was able to get the ombudsman to intervene. This time around though, I do not feel the ombudsman is working to help me, the consumer, at all. This is a cat and mouse game to see if they can wear you down. I would rather have a DIL than a foreclosure.

Consumer Complaint: Ocwen is engaging is Mortgage Service Abuse, Dealing in Bad Faith with deceptive and misleading practices causing the Homeowner and spouse great deal of XXXX needlessly. Ocwen entered in to Loan Modification ( attached Exhibit C ) after the Homeowner has successfully completed all required payments. Ocwen has twice since XXXX of XXXX arbitrarily without notice and contrary to the completed Loan Modification Agreement. Changed the modified of 3.76 % to 8.25 %. In XXXX XXXX Ocwen completed Modification Agreement and the Homeowner then made seven ( 7 ) monthly payments of the requisite amount of {$4400.00} then on XXXX without notice Ocwen in violation of the Modification Agreement increased the monthly payment to {$7100.00}. When the Homeowner contacted Ocwen to inquire as to why the change they were told it was an annual increase. The Homeowner were force to enlist help from counsel and XXXX/XXXX/XXXX ( Exhibit B ) Ocwen issued a correction letter citing on XXXX XXXX they identified the error and made the necessary adjustments. When the XXXX ( Exhibit A ) Mortgage Account Statement arrived Ocwen once again without notice or reason has once again increase the interest rate form the contractual {$4500.00} ( 3.76 % ) to {$7200.00} ( 8.25 % ) that an 119. % increase of the interest rate!

Consumer Complaint: Due to financial constraints, and holding on to my property post the height of the economy ; I opted to try to sell my home to get out from under it. I purchased my home in 2006, the value of the home is barely what I purchased it for. I purchased it for {$270000.00}, appraisal is for {$280000.00} with all the upgrades in the last 10 years. I had a buyer with an offer of {$270000.00}. The offer was accepted by the first mortgage and denied by the second mortgage, therefore forcing me into forclosure and ultimately bankruptcy. The load was a fannie mae dictating how much money would go to the second mortgage. The system is broken. I thought things were better to support this type of situation. How can a bank deny the sale. How can a bank deny the sale based on " principle '' as they said to me. They would rather have nothing than the amount offered to them.

Consumer Complaint: Account Number:XXXX Property Address : XXXX XXXX XXXX XXXX XXXX FL XXXX Servicer : Ocwen Loan Servicing On XXXX XXXX, XXXX GMAC initiated a foreclosure action against XXXX in the Circuit Court of XXXX County , Florida . On XXXX XXXX, XXXX GMAC recorded in XXXX County Official Official Record a bogus mortgage assignment purportedly executed by XXXX XXXX an alleged Assistant Secretary of XXXX XXXX XXXX XXXX , XXXX ( XXXX ). The assignment shows an execution date of XXXX XXXX, XXXX. There is no evidence that XXXX has any authority to assign the mortgage. The law office of XXXX XXXX XXXX prepared and recorded the bogus mortgage assignment on behalf of GMAC. On XXXX XXXX, XXXX, the court dismissed without prejudice GMAC complaint for lack of standing. On XXXX XXXX, XXXX, GMAC filed its first Amended Complaint, wherein GMAC stated the mortgage loan went into default on XXXX XXXX, XXXX. GMAC alleges that the new principal on the Note is {$180000.00}. The alleged original Note shows an initial principal balance of {$170000.00}. Due to the negative amortization of the loan, the Note principal balance has increased by {$10000.00} ( {$180000.00} - {$170000.00} ). GMAC has not paid the required documentary stamp tax on the increased value of the Note, making the note unenforceable. Though the alleged original promissory note did not carry an endorsement from XXXX XXXX XXXX XXXX, GMAC claimed ownership of the mortgage loan by way of an Assignment of Mortgage from XXXX. GMAC obtained an unconscionable advantage by concealing and/or misrepresenting the true owner of the beneficial interest in the subject loan and/or the amount owed. Despite such actual knowledge as to XXXX ' limitations and preclusions, GMAC intentionally and willfully uttered, in writing throughout foreclosure proceedings, the false and fraudulent misrepresentations as to XXXX for the sole and specific purpose of manufacturing bogus " Assignments '' of mortgages in order to institute and further fraudulent foreclosure proceedings with the intent of committing theft of real property. On XXXX XXXX, XXXX, XXXX XXXX was substituted as plaintiff with Ocwen as the servicer due to GMAC bankruptcy filing. Ocwen is now trying to foreclose on the property knowing that it has no standing to do so and that the note is unenforceable. A trial is scheduled for XXXX XXXX XXXX.

Consumer Complaint: After providing necessary documents and verbally having an agreement with signed documents, The servicer Ocwen decides to change the terms. I make XXXX a year now after starting a new job in XX/XX/XXXX and deserve a better term as first told. Having a Balloon and being told at XXXX, XXXX would be due in one lump sum is not acceptable. After showing concern the principle was allegedly reduced more but still Considered Ballooned. Not again what was stated earlier with the streamlined Hamp as described. Being able to pay down the debt with 3.12 interest as described with 40 year term was told as it would be. XXXX has been given XXXX a month since XX/XX/XXXX and the servicer tried on a holiday week to have timing is of the essence, sign, date, notarize by XXXX XXXX. Securitization audit and Quiet Title were requested with a QWR with all not being provided. Home Owner Bill of Rights and the issues with Investors servicers past and present should make this more unique workout solution. XXXX XXXX another lawyer is in jail now for realestate fraud and XXXX ipo issues that did Foreclosure rescue scam XXXX on me and I 'm tired of censured attorney chapter XXXX that would not let me fire him as his firm acquired info from Litton Loan and then said they were not doing a loan mod after they had us fill out docs stating different. Very unique people. Please advise, ... ... on my rights with the changing of terms that is not welcomed when I make enough income and they see that. Being scammed and represented illy is horrible.
