They did modify my loan but only to send an increase before the official payment was made. They claim this is do to Escrow. I understand Escrow goes up however they had all the correct information prior and while doing the modification. I feel Ocwen did this to hurry up and get of your records in a timely fashion. Please look into this process I feel I am not the only XXXX. I would like Ocwen to do a fair modification. I almost did n't write this but felt that if this is common practice it is fraudulent in the less. thank you

Consumer Complaint: On XXXX XXXX, XXXX, I incurred a financial obligation when I purchased my home located at XXXX XXXX XXXX XXXX, XXXX, GA XXXX for the amount of {$270000.00}. The loan was evidenced by a Security Deed, naming XXXX as the " Lender, '' and XXXX XXXX XXXX XXXX , XXXX ( " XXXX '' ) as the " grantee, '' or beneficiary, of record acting solely as nominee for same. On or about XXXX XXXX, XXXX, after it was alleged that I had defaulted on my loan Account, was assigned to Deutsch Bank Trust Company Americas. In an attempt to save my home, I 've made various efforts to get an affordable loan modification from Deutsch Bank. All attempts, however, were unsuccessful. It appears that they refuse to give me a reasonable workout option and is bent on taking my home. Because I questioned Deutsch Bank 's servicing of my loan and how credits had been applied and whether or not my loan account is actually in default, on XXXX XXXX, XXXX I forwarded to Deutsch Bank a Qualified Written Requests ( QWRs ) requesting that Deutsch Bank provide, inter alia, me with ( 1 ) A complete audit history from alleged loan origination, showing the dates payments were applied, and to what internal accounts ( i.e. principal, interest, suspense, escrow, etc. ) payments were applied ; ( 2 ) A complete and itemized statement of all advances or charges against this account ; and ( 3 ) A complete and itemized statement of the escrow for this account, if any, from the date of the note origination to the date of your response to this letter. Also, my QWR stated that it was my belief that my loan account has been improperly serviced in that credits for payments made by me had not been applied to my mortgage loan account. Deutsch Bank, however, did not respond to my QWR, took no responsive action and undertook no investigation into the issues raised by my QWR. The only way to ensure the integrity of my loan and whether my account has been properly credited is for Deutsch Bank to produce a verified accounting in compliance with RESPA 2605 ( e ).

Consumer Complaint: In a nut shell, Ocwen has failed to apply payments and maintain accurate account balances ( which is what the Feds sued them for ... .its still continues to happen ). They charged an exorbitant amount of unauthorized fees for appraisals. They also refuse to give us a copy of our appraisal. Per ECOA by Dodd Frank Wall Street Reform and Consumer Protection Act of 2010 the lender is REQUIRED to send us a copy of our full appraisal. After more than a half dozen requests and having our attorney write a letter they still refuse to send us a copy of our appraisal. They also applied our first XXXX mortgage payments to our account and then reversed one of them out thus NOT GIVING US CREDIT. Our mortgage payment has gone up {$700.00} a month over the last XXXX years. They claim due to escrow impounds, although we were assured that all of our past taxes would be incorporated into our loan. We were very cleat why we needed the modification and now we find our monthly payment is {$1000.00} more a month than when we needed the modification to begin with. We are n't sure how much longer we can hold on. I 'm sure that was XXXX plan all along. I asked that my attorney be added as Power of Attorney and it took XXXX year for them to add him yet they still will not speak with him. How is any of this legal? Esp. after they were sued by the Feds and lost for these same business practices? We were absorbed from Litton loan when Ocwen took over their loans. We also had no idea that they were being sued as we made our first loan payment to them. Upon the research I 've done recently it appears that XXXX years after they lost they still continue to conduct business in a way that landed them in court to begin with. Now we risk losing our home again since the payment is nearly {$4500.00} a month. We need help from someone that will read this and see that they are still breaking the law and do something about it.

XXXX instructed the homeowners to stop paying their monthly mortgage payments and to apply for a loan modification, which XXXX failed to properly process. XXXX then declined the loan modification, but failed to explain why. XXXX then offered the homeowners to sell their home for a compromised payoff amount ( short sale ). Eventhough the homeowners had a cash buyer, XXXX failed to finalize the documents and thereby blocked the sale of the homeowner 's home. XXXX actions directly led to the related home being foreclosed on.

Consumer Complaint: In XXXX 2016 OCWEN posted Keep Your Home California funds to my account. My home loan payment was supposed to change from {$1100.00} to {$820.00} according to the Keep Your Home California recast. I was told this recast was not optional. I signed the document OCWEN sent to me months later in XXXX 2016 even though OCWEN did not include a return envelope. I used the address on the document and took a photo with my iphone and sent a copy to XXXX XXXX at OCWEN so he would know what address I sent the notarized document to. OCWEN did tell the Department of Justice that they did not receive this document and yet they made no effort to send me the document again and would not return my calls and emails regarding the fact that I needed an envelope. I had to try to remedy the situation without any help from OCWEN. They are non-responsive at this time.

Consumer Complaint: Mortgage Company complaint is with Ocwen Loan Servicing. Back in XXXX of XXXX Ocwen proceeded to pay my homeowners insurance as instructed to do so in contract, with XXXX XXXX XXXX, A check was mailed to XXXX at XXXX XXXX XXXX XXXX, XXXX, Ill. XXXX ; as noted on check # XXXX, dated XXXX/XXXX/XXXX and a copy of which is included with this complaint. ( See attachment ) On the back of this check is endorsement stamp by company XXXX and has a persons signature on it too. Deposited in XXXX XXXX bank. XXXX claims NEVER receiving this check ( for this reason, XXXX cashed it ). So XXXX preceded to notify Ocwen that they still needed payment for the homeowners policy to remain in effect, so Ocwen, instead of telling XXXX that they sent a check to their office in XXXX Ill, they write a second check of {$950.00}. See attachment, included ). So now I 'm really short funds in my Escrow account with Ocwen. I thought this matter was resolved in XXXX, after much conversations with Ocwen agents concerning this matter. I received my escrow account summary in XXXX of XXXX and notice that my balance is way negative, so I 've been trying diligently to get this matter resolved but with NO success. Just being told we 're working on it. Well they been working on it for almost XXXX years. So I do n't believe it, and I need help getting my {$950.00} back in my escrow account. I just want the {$950.00} restored where it belongs in my escrow account so I can have a new escrow evaluation and my monthly payment reduced. Also attached is my first page of my escrow summary for XXXX, which shows Ocwen 's contact info and my loan number with this account.Loan number is also on both copies of the canceled checks. Also attached is a word doc that lists Ocwen agents I contacted recently and the agent at XXXX I talked to that said she would try to locate the check in question and she forwarded a copy to agent at Ocwen.

I am attaching the letter I received from Ocwen wherein they state that the mortgage payment was increased to {$840.00} on XXXX/XXXX/XXXX and payments of {$800.00} we received after that. I am attaching a copy of Ocwens Escrow analysis dated XXXX/XXXX/XXXX that says the monthly payment is to be {$800.00} as of XXXX/XXXX/XXXX ( NOT the {$840.00} Ocwen now claims ), along with copies of the statements received from XXXX/XXXX/XXXX to XXXX/XXXX/XXXX ( after which they stopped sending statements ) which also show that the " Total Regular Payment '' for this time period is {$800.00}. which is the amount that was paid. Needless to say I am still disputing Ocwens claim that any monies are due, the attached " Cancelled Checks '' show we have paid the full amount due " Per the Statements '' we have received through XXXX/XXXX/XXXX, plus {$800.00} was paid for both XX/XX/XXXX & XX/XX/XXXX. I am willing to bet their current escrow balance is incorrect also. So what do we do now? I have repeatedly responded, in writing, to their " Notice of Pre-Forclosure '' letter whereby we request a " In Person '' meeting per page XXXX of their letters. The only response I have ever received is a new " Notice of Pre-Forclosure '' letter, all have been identical save for the date issued, all have been respoded to requesting a " In Person '' meeting. I have now received the same letter dated XXXX/XXXX/XXXX ( which I will respond to tomorrow, requesting a In Person meeting ).
