Consumer Complaint: Dear CFPB Representative, We signed a " shared appreciation agreement '' with Ocwen Loan Servicing , LLC who represents the note holder XXXX XXXX. In this agreement Ocwen was to, in exchange for, very high payments, forgive a substantial portion of the principal owed on their mortgage. Now comes, that after over a year of us making excruciating payments that have depleted our savings, Ocwen has pulled out of the agreement leaving us with a foreclosure, likely loss of our home, and our life savings gone. They claim that their employees / representatives misled us into this situation but that at the end they were canceling the agreement and moving forward with foreclosure. We have already received the foreclosure notice. The key provision of this agreement was the principal forgiveness. The note holder, XXXX XXXX, had us locked in what they call a " negative amortization '' loan, where the balance of the loan actually goes up instead of down. Together with the housing crisis of 2008 we have a very severe negative equity in our home. After the government prohibited these negative amortization loans, the note holder changed us into a regular ARM in order to what they termed " stop the bleeding ''. However the payments soon tripled in size and made things impossible. Subsequently Ocwen, now the new servicer of the loan, convinced us to sign this agreement in exchange for this principal forgiveness that would pull us back to a break even equity position. Based on that we signed. Now that the market has been improving, Ocwen has decided to pull out. In our opinion they have done so in order to bring in more cash for themselves from a foreclosure rather than having to comply with the principal forgiveness agreement they signed with us. They are covering their tracks by removing long time representatives from our account, bringing in bogus " customer advocate reps '', erasing electronic correspondence within our account at their website etc. We find this to be negligent and outrageous. We have been sent into financial disaster by Ocwen Loan Servicing , LLC and the note holder XXXX XXXX. ***A more detailed description of the situation is given in the attached documentation together with other related supporting documents***

Consumer Complaint: My credit report shows that I have or had a mortgage with Homeward Residential f/k/a American Home Mortgage Servicing, in the amount of XXXX and opened in XXXX 2006. I request that Homeward Residential f/k/a American Home Mortgage Servicing respond to the Debt Validation Letter and the QWR letter attached to this compalint. I have never signed a mortgage with Homeward Residential f/k/a American Home Mortgage Servicing. I am attaching a copy of my mortgage and note for reference. This goes back to my original theories that no one knows who exactly owns my mortgage and note and that all documents used, i.e., Assignment of Mortgage, etc. are all fraudulent. I want this investigated and I want answers.

Consumer Complaint: i have someone trying to purchase my home and I contacted ocwen inquiring about my payoff amount and when I finally received their quote o was appalled! It is so incorrect and on top of that they added on several fees and late charges which are not correct or right! I have my bank statements to show when they have been paid and on what date! After receiving this I decided to check my credit report and it shows that ocwen listed my mortgage closed back in 2013, which is NOT correct as I have been paying them monthly to this date! I now understand why I have been turned down so many times when trying to get a loan etc. this is illegal and a federal offense to not report to the credit bureau! I also have not received a monthly statement since 2013 and when I have inquired about this issue I was told each time they would correct it and send one, well I have yet to receive a statement! Now I know why cause who knows where my money has been going and based on their payoff quote and my credit report it sure has n't been going on my mortgage! I want this fixed immediately! As I have an opportunity to sell my home and due to all these circumstances and incorrect information I may lose the buyer as he cant wait forever for me to fix the problems ocwen has created!!!

Consumer Complaint: I have in the past filed many complaints with several regulatory agencies and with the judges and clerks of XXXX County, FL regarding the verification and validation of the collection of my mortgage loan by the servicer, XXXX / XXXX XXXX and now new servicer, XXXX XXXX XXXX, XXXX and I have never received a full certificated response to my Debt Validation Letters, and my QUALIFIED WRITTEN REQUEST, COMPLAINT and DISPUTE OF DEBT AND VALIDATION OF DEBT LETTER, TILA REQUEST lettrs. Neither one of these servicers ( debt collectors ) have complied with each request as required by the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) and by RESPA, Title 12 Section 2605 ( e ) of the United States Code as well as the Truth In Lending Act 15 USC Section 1601. Each of these debt collector have failed to follow the law. I have even sent them copies of my credit report showing someone else owning the debt and they still have not provided me with full, clear and certificated proof that they are the ones that have the right to collect the debt. There has even been documents such as Assignment of Mortgage that have been prepared which are suspected to be fraudulent. They continue to send me responses that do not provide enough information to verify the debt nor that they have the right to collect the debt. They provide documents stating that they are original but in court different documents are provided as original. They are not following the law and they are not providing what is required of them by the law. There is suspicion of fraud. Entities involved are : 1. Originator : XXXX XXXX a subsidiary of American Home Mortgage ( they filed bankruptcy and went out of business XX/XX/2007 ). Bankruptcy Case Number : XXXX 2. Sponsor : XXXX XXXX XXXX XXXX XXXX 3. Depositor : XXXX XXXX XXXX XXXX XXXX 4. Issuing Entity : XXXX XXXX XXXX XXXX XXXX XXXX 5. Servicers : XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX 6. Homeward Residential Holdings, Inc. : A company organized by XXXX XXXX XXXX in 2007 which included several platforms and one of them was American Home Mortgage Servicing d/b/a XXXX XXXX 7. Ocwen Financial Corporation : The company that acquired Homeward Residential Holdings, Inc. 8. XXXX XXXX XXXX, disbarred attorney who was part of the foreclosure mill in Florida and was disbarred for foreclosure fraud. XXXX XXXX XXXX was the attorney that drafted and filed the assignment of mortgage that was used in my foreclosure action and I suspect it to be fraudulent. 9. XXXX XXXX, Clerk of XXXX County Court : I sent a letter to the Clerk of Court requesting that an investigation be initiated regarding my foreclosure case and my land records because of suspicion of fraud. This has never happened. 10. Chief Judge XXXX XXXX : I sent a letter Judge XXXX requesting that an investigation be initiated regarding my foreclosure case and my land records because of suspicion of fraud. This has never happened. 11. CFPB : I have filed many complaints and have appealed the response from the different entities but nothing has been done. No investigation has ever been initiated. 12. Attorney General XXXX : A complaint was filed with this office but nothing ever happened. 13. DOJ : A complaint was filed with the DOJ as the settlement agreement with DOJ and XXXX XXXX XXXX list in their Annex XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX as one of the trusts that are part of the settlement agreement having to do with fraudulent activities of the banks.

Consumer Complaint: Our mortgage servicing company OCWEN every 6 months sends us a notice that our Condominium Association Master Insurance Policy on our rental property has expired. It then requires us to contact the Homeowners association and master insurance company to provide all the master policy information, endorsements, etc., etc. What on earth is the mortgage servicing company getting paid for if not for basic services like establishing contact the Homeowners Association to verify their Master insurance coverage? We are hounded every 6 months with this repeated huge paperwork exercise. OCWEN is getting paid to do this or do I misunderstand their obligations and what they are being paid for? We understand perfectly our requirement to verify we have homeowners insurance on the condo itself. This is just one of the regular hassles that OCWEN puts us through because they do not follow up on the information we provide or require repeated re-sendings of information and paperwork because they lose track of our material. OCWEN is without a doubt the worst organization we have ever dealt with concerning mortgages and insurance. Constant difficulties.

Consumer Complaint: on XX/XX/2016 I filed a complaint of the mortgage company adding additional charges to my loan with no explanation. Because of CFPB they finally got it all corrected on XX/XX/XXXX statement. So on XXXX I go to the web site to make my payment and the web site will only let me make the minimum payment again and not the fully amoritized payment so I add the additional amount. Now again on XX/XX/XXXX statement they have started again charging me fees with no explaination. When is this going to STOP!!!!! I just want to make my payment correctly, on time, and have them credited correctly!! WHAT A CONCEPT!!!

Consumer Complaint: ( 1 ) In XXXX 2016 I requested debt validation and verification from Ocwen in compliance with 15 USC 1692g to which they responded with photo copied information that did not comply FDCPA guidelines. After repeated requests for properly verified and validation documentation, Ocwen failed to respond in the within the given time periods. During my communications with Ocwen I informed them that I was invoking my private right of action and considered this matter closed as they failed to comply with my requests. As such, I also directing them to cease and desist all communications with me because I consider this matter closed. Ocwens response has been to completely ignore my request, they have shared my personal information with several entities which has resulted in debt collectors inappropriately calling my job, my cell phone, unsolicited emails and threats of foreclosure. ( 2 ) My desire is that Ocwen cease with their threats and send Notice of Full Release and Satisfaction and documentation reflecting a zero balance.

Consumer Complaint: OCWEN HAS ENGAGED IN CONTINUOUS PREDATORY PRACTICES, intentionally to avoid assisting me/ a borrower, in resolving the toxic, bad loan STILL plaguing me from pre-2008 meltdown/ bad debt. They have EVERY time sabotaged ( I have proof ) the process to avoid ANY RESOLUTION to the toxic loan I am still saddled with. For over 1.5 years I have attempted a conventional refinance, a HARP refinance, a modification, and a short sale among other attempts to resolve. OCWEN BURIES the process and SABOTAGES it : Hiding behind bureaucracy so egregiously that the applications expire, and/or documentation expires, creating the continuous requirement of new documentation and notifications of FURTHER DOCUMENTATION REQUIRED, EVENTUALLY REQUIRING US TO APPLY FROM THE START ALL OVER AGAIN, AND THE SABOTAGE CIRCULARLY CONTINUES AD INFINITUM. ALL-ALL-ALL LEADING TO " DECLINING THE APPLICATION '' AND NO RESOLUTION. OCWEN IS PREDATORY and blatently avoiding borrowers receive government assistance programs or working on a solution, ANY SOLUTION, to get them out of toxic debt caused by the residual bad loans that caused the 2008 meltdown.

Consumer Complaint: I requested a payoff from Ocwen loan servicing. There are extra fees totaling almost {$7000.00} When I called to negotiate the fees and/or the removal of them I was denied and told that according to the terms of the loan and modification. The problem is that one is a deferred principal balance fee of {$5200.00}. That was from the modification 3 years ago. I was to have that amount removed each year for 3 years. But 3 years ago I received a XXXX for the entire amount of {$15000.00} which we had to claim as income on our tax returns. So therefore according to our records with the IRS we have already paid taxes on that income ( which also changed our tax bracket to a higher bracket ). When I called today I was told this will not be removed. I would like this formally investigated and reviewed.
