Consumer Complaint: I make reference to my complaint number XXXX and several others before that, under which Ocwen keeps sending previous responses stating that they acknowledge that my loan # XXXX has been satisfied and that they have 'filed the corresponding documentation with the county clerk 's office ' ; however, Ocwen does n't include such filed documentation nor indicate with what county clerk 's office did they do such filing. I have recently had a title search done on property XXXX XXXX XXXX - XXXX - XXXX XXXX, NY XXXX and no recording was found. Ocwen keeps being oblivious to my request and keeps reminding me that the loan has being paid off, forgetting that I was the one paying the loan for 28 years and therefore, I am completely aware that the loan was paid off on XX/XX/XXXX. Ocwen does n't need to tell me nor remind me that the loan was paid off on XX/XX/XXXX but they rather need to send me the proof that I 've been asking for : i.e. Document they indicate have submitted to the county clerk 's reflecting the pay off of the loan. Ocwen 's letter dated XX/XX/XXXX, asked that I send a letter directly to XXXX XXXX via mail. They only provide a PO box address. They also provide a phone number ; however, no one answers. One has to wait at least 48-72 hours for someone to answer a phone call (? ). Something seriously wrong is going on with this institution : They do n't answer calls and when they answer any correspondence, they answer anything but the requested issue. I am sending a letter directly to XXXX XXXX with the hope that this time my request is understood and thus Ocwen provide me with the proper response and that Ocwen finally comply with its obligation. Consumer Complaint: The property located at XXXX XXXX, XXXX, GA XXXX was purchased in XX/XX/XXXX by XXXX XXXX the borrower and I XXXX XXXX, her husband, was added to the title only at closing. On XX/XX/XXXX we were granted a divorce and the property was awarded to me. Thereafter I learned that the payments had not been made and was {$4700.00} due which I brought current. I continued making payments until I was laid off and collected unemployment at which time I sought the help of an attorney to assist with a modification. The firm of XXXX reviewed my financials and gave me a schedule which included {$5500.00} for the mortgage company, plus other debts totaling {$12000.00} for 60 months at {$230.00} monthly. until it was dismissed, The loan was with Homeward Residential, Loan # XXXX and sold to American Home Mortgage Loan # XXXX which statements were being sent in my name since I was making the monthly payments after the decree.and quit claim deed was sent for their records Thereafter the loan was again sold to Ocwen Loan Servicing Loan # XXXX and when I tried to communicate with them they refused stating I was not the borrower. I tried for months to communicate but was unsuccessful until I received correspondence in my name that the property was being foreclosed. With the help of a housing counselor we contacted the attorney who assisted with us to be able to speak with a supervisor at Ocwen where I was assigned a Single Point of Contact who scheduled several appointments and gave me information to submit forms and complete documentation for a modification which was done. The foreclosure was postponed and I requested to have the property refinanced in my name which I believed was being done. I later learned that the modification could not be done in my name as my ex-wife was the only one on the mortgage.I was then offered a short sale and took all the steps to provide the required paperwork. I inquired if my father who was living with me at the time could purchase the property and was told yes and had him qualified.. In speaking with the Counselor who informed me that it was unusual to do an arms length transaction and suggested I speak with someone directly in the Short Sale department who stated it could not be done. At the last scheduled appointment the XXXX informed me that I could reinstate the loan the day before the new scheduled foreclosure sale date which is XX/XX/XXXX by paying the amount of {$47000.00}. At this point I am requesting your assistance in what can be done to keep my home as it have been over two years and I have had no resolve.without getting the proper information from the mortgage company.

Consumer Complaint: In XX/XX/XXXX, I declared bankruptcy and surrendered XXXX rental properties ( XXXX in XXXX and XXXX in XXXX. I was, and am, an XXXX military XXXX. These rental properties were meant to be a large part of my retirement income. At the time of the bankruptcy, I had great credit and no debt beyond the mortgages, but was forced to declare bankruptcy due to the housing crash and a real estate scam. While I was XXXX in XXXX and XXXX from XX/XX/XXXX to XX/XX/XXXX, I kept getting notices from my property manager in XXXX to send money to repair things. Once I returned to the states, I flew to XXXX and found out that I had been part of a real estate scam. My properties had been gutted bringing their value down to {$10000.00} and the real estate ring was charged with mortgage fraud. This left me with no alternative but to file bankruptcy to surrender the properties. I filed XX/XX/XXXX before XXXX in XXXX and my bankruptcy was discharged in XXXX XXXX, XXXX. The XXXX properties, at this time, were in good shape and rented for more than the cost of the mortgage and other related fees. Although the mortgages on these properties were less than the sales value, they were profitable. I surrendered the profitable XXXX properties as part of my estate and had the renters move out. The XXXX XXXX properties have since foreclosed, but the XXXX XXXX properties have yet to foreclose after five years and I have just been served with {$17000.00} in fines by the HOAs. I was served with these papers while currently XXXX in XXXX, and have had extreme difficulty in reaching the banks to try to resolve this issue. My wife, who is in the states and has my power of attorney, has also been unable to reach the banks to resolve this issue. These properties have not foreclosed even after papers being filed with the courts in XX/XX/XXXX and XX/XX/XXXX. If I had known that the banks would not foreclose for over five years, I could have kept my renters in the properties and paid all fees associated with the houses over all of these years. Instead, in good faith, I surrendered the properties and did not feel I had the right to rent them out. These properties have now sat empty for five years rendering them less likely to rent or sell and have been accumulating HOA fees and fines.

Consumer Complaint: I have a home loan that is serviced by Ocwen. There is a large descrepancy between the loan balance reported by Ocwen, and what the amortization schedule indicates it should be. I complained a couple of years ago by way of a phone call to Ocwen. They could not explain the large descrepancy. I emailed an inquiry to Ocwen a couple of weeks ago. They still have not explained the error, but they did get back to me about 10 days after I sent the email request. They claimed my initial request to not include enough information, which I do n't believe is true. I called the phone number the provided me with, and I provided Ocwen with requested account details. A weird thing that happened after my email request, concerning the large descrepancy between Ocwen 's reported balance the amortization schedule 's stated balance. The amortization schedule was removed from the Ocwen website. I do n't trust Ocwen.

Consumer Complaint: Since the beginning of this year I have been applying for a remodification for my mortgage while in foreclosure status but have been denied twice by my loan servicer Ocwen. After they have moved the sale date twice as a result of my remodification application, I was informed by XXXX different people on XXXX different occasions that my property was not in foreclosure anymore, but delinquent. But the company still went ahead with their foreclosure proceedings and foreclosed on my house on XXXX XXXX. I only received a from their trustee after the proceedings occurred, and that letter was dated XXXX XXXX. I have filed a dispute with the XXXX at Ocwen for wrongful foreclosure, due to their employees willfully lying to me about not being in foreclosure, but they have denied any wrong doing, and are proceeding with the foreclosure. I live in this property with my wife and kids, and I should n't lose the when I have been falsely informed so I can lose the home. I would like to remain in the property and make my monthly mortgage payments.

Consumer Complaint: I am a housing counselor. I have helped a client obtain a HAMP modification on their Ocwen loan. It is not a GSA. Mortgage payment is great. But in reading over the permanent loan modification agreement, I noticed a discrepancy as referred to the Principal Balance Deferment. The homeowner owes around $ XXXX on the home, approximately $ XXXX will be the Principal Balance Deferment and remaining balance of over $ XXXX will have interest of 3.25 %. In the Balloon Disclosure, the principal balance deferment was over $ XXXX. When I asked for an explanation, I was told by a supervisor that the additional $ XXXX was interest that Ocwen would have gotten over 40 years on the principal balance of $ XXXX at 3.25 % which they will not collect because the modification has a maturity of 20 years. No where in the loan agreement was it ever mentioned how they came up with this figure. In fact they refer to the figure as " Deferred Principal Balance Due on Maturity '' and show the amount starting and finishing at over $ XXXX. In the loan agreement they also refer to the {$23000.00} as the " New Principal Balance '' which shall be deferred ( Deferred Principal Balance ). In asking why there is not explanation, I was told that they use " generic '' papers and do not have any place to explain what they are doing. In getting this explanation, I had already escalated the call to a supervisor. After the explanation, I submitted something by fax to the " Research Department '' since I wanted something in writing.
