The homeowner applied for assistance before the foreclosure sale date and has not been reviewed for help prior to this submission. Consumer Complaint: We have a very serious problem. We were just told that the above file was closed out rather than an extension being issued as requested on XX/XX/XXXX and XX/XX/XXXX. XXXX XXXX from my firm was told on the phone, on a recorded line that we were okay to close on the XX/XX/XXXX - a day after the approval letter expired. Friday the XX/XX/XXXX was a holiday and therefore did not count for the XXXX disclosure guidelines so we needed to close on the XX/XX/XXXX. We closed on the XX/XX/XXXX and the wire was then sent out and the attached documents were sent in to Ocwen. The deed was recorded, the buyer 's loan finalized - no rescission period in Maryland - so the loan has already been sold off to a new owner and then Ocwen returned the wire and asked that we change the XXXX to XX/XX/2016. This is a TRID violation so the title company would not back-date the XXXX after closing on the XX/XX/XXXX. I am filing this as a CFPB complaint. We are going to tell the title company to send back the wire as it should have been accepted the first time. Ocwen can not give us approval to close the day after on the XX/XX/XXXX and then a week later tell us that we could not close on the XX/XX/XXXX. This will be a title insurance issue and the buyers and the sellers will sue. This needs to be rectified XXXX. We can not re-submit the short sale package - Ocwen needs to do what they said they would do and honor the closing from the XX/XX/XXXX. I am sure that the recorded conversation from XX/XX/2016 can be subpoenaed if necessary.

Consumer Complaint: Wells Fargo Bank foreclosed on the home I am a tenant in. Wells Fargo gave conflicting information to me and the other tenants about whether Wells Fargo would settle with us in order for us to move out. First the bank asked us how much it would cost to get us to move, then the bank said " everything is on hold '' because the former owner is suing the bank. Wells Fargo has repeatedly said it would send a representative to the property to discuss the foreclosure with the tenants and give us information, but it has never done so. Wells Fargo is obligated to assume payments for our utilities, which are included in our lease. However, Wells Fargo has never assumed its obligation as the new owner of our home. We have received multiple shutoff notices for the water and electricity. Wells Fargo has refused to return our calls about the utilities or the status of our tenancies. We believe Wells Fargo intends to constructively evict us by allowing the utilities to be shut off. An attorney for Wells Fargo, XXXX XXXX, sent us a confusing notice about our tenancy, but has never returned our calls.

Consumer Complaint: For the past five years Ocwin has what we believe is an effort to lose our payments so that they could annul our loan modification. If we get behind on our payments we lose several benefits that must be paid by the lender. They been successful by changing our payment amounts then charging the difference the next month, on several occasions simply rejecting our payments without notification. However this complaint is about Ocwin scrambling our payment history when we decided to push back against the most recent lost payment. Please see attached reported current history from Ocwin. We can not make a determination of our owed payments with Ocwin because they refuse to give us an accounting.

Consumer Complaint: US Bank has failed to answer my questions and provide the documentation as we requested per our complaint with the CFPB, XXXX. US Bank forwarded this complaint to XXXX XXXX XXXX which XXXX also failed to answer our questions and provide the documentation as we requested. Since this occurred, we are exercising our right to re-submit another complaint against US Bank. Failure to comply will result in more complaints filed until we get the answers that we are seeking. Now, per US Bank, role of the trustee, ( US Bank own submission ) US Bank holds an interest in the mortgage loans for the benefit of investors, maintains investors/securities holder recorders, collects payments from the servicer and distributes payments to the investors/security holder. Now, we are requesting the following in writing ; 1st, we request to know what was the date our Note/Deed of Trust was transferred into the trust, XXXX Mortgage Loan trust XXXX which US Bank is the trustee for? 2nd, we request documentation on the investor who US Bank N/A provided the certificate too at the time of the transfer into this trust/securitization? 3rd, since XXXX, our original lender in 2006, which certificate holder/investor has US Bank N/A been sending our monthly mortgage payments to for our property/Note? 4th, what were the payment amounts that US Bank has sent to the investor, investors or certificate holder? 5th, what were the dates of these payments made to the investor/certificate holder? 6th, does US Bank know where the original Note and the Original Deed of Trust is located at? If so, where are the original Note and original Deed of Trust located at and with whom? 7th, does US Bank know where all the assignments that was provided to each investor of our mortgage loan? If so, where are these assignments located at and with whom? 8th, is US Bank fully aware that XXXX failed to track assignments for our Note/Deed of Trust so XXXX would not need to record transfers from one investor to another? 9th, since XXXX did not record any assignments and failed to keep track of assignments from one investor to another, does US Bank know why XXXX failed to do their job correctly? Please answer the above questions in writing and provide documentation! Now, due to the fraud that has occurred by the companies that are handling our mortgage loan, this information does in fact pertain to our mortgage loan and we have the right to have to this information. Failure to comply must result in the following but not limited to the following ; a full investigation from a federal agency, fines being imposed, loss of business license, criminal charges filed, incarceration, lawsuit, compensation for damages, mental anguish, and emotional distress.

Consumer Complaint: My husband died, the mortgage was not in my name. I was working with Ocwen on a simple assumption and I was approved for a trial modification with Ocwen. I made all 3 trial payments and my loan was sold to XXXX. When speaking with Ocwen they stated that all my information would also be transferred including the fact that my loan was about to be modified and put in my name and that I had made all three trial payment on the trial modification.

Consumer Complaint: Began a refinance process with Homeward Residential XX/XX/2016. From XXXX - XXXX I was passed to XXXX different loan processors and was asked to provide the same information several times. The different loan processors would come back asking for the same information over and over. The last loan processor reported that there were liens against my property which they are not and was asking me to prove that there were no liens. They continually asked for payoff information which had been provided three times. They did XXXX appraisals saying that the appraisal did not provide the information they needed but they continue to use the same appraisal. The last processor called and asked for information identifying herself as a loan processor but when I began asking why I was continually being asked to provide the same information she stated that she was a underwriter. This company strung me along for six months and still no refinance and they have several of my documents.
