Consumer Complaint: Multiple inaccuracies were discovered om my EQUIFAX, XXXX, XXXX XXXX Profiles, which are direct violations to Me as a Federally Protected Consumer. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' Equifax and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies Equifax and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to Equifax, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Equifax and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

I was not told that my nonpublic personal information would be given to a third party, nor was I given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party, nor was I given an explanation of how I, the consumer, can exercise the nondisclosure option Per 15 USC 6802. While looking at my credit reports I found that XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX all have my transaction history listed. Per 15 USC 1681a a consumer report DOES NOT include any report containing information such as transactions or experiences between the consumer and the person making the report. Also the accounts from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX account ending in XXXX have all been charged off. Per topic no. 431, canceled debt on the irs.gov website if your debt is canceled, forgiven, or discharged the amount of the canceled debt is taxable and you must report any taxable amount of a canceled debt as ordinary income. Which means that charge offs are counted as income and income SHOULD NOT be reported on a credit report. Per the privacy act of 1974 No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains.

Consumer Complaint: I filed a dispute for incorrect information on my credit report. I received an email from the credit bureau stating that they are assuming the disputes are coming from a 3rd party. They in fact did not come from a 3rd party. l even called them to verify it was me and they still refused to process my disputes. I wasted money on mailing my disputes out. I sent personal information to verify my identity through mail, just for them to not thoroughly investigate.

Consumer Complaint: Complaint Regarding Credit Report Inaccuracies Dear CFPB, I am writing to file a complaint regarding inaccurate information on my credit report. I have been actively disputing these inaccuracies with the credit bureaus, but they have failed to adequately investigate my claims or remove the incorrect information. In accordance with the Fair Credit Reporting Act. I attached the XXXX file below containing the list of items that have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Credit Bureau stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify or delete accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I also believe that the credit bureaus have violated the Fair Credit Reporting Act ( FCRA ) by failing to : 1. Investigate my disputes in a timely and reasonable manner : The credit bureaus have not provided a clear explanation for their decision not to remove the inaccurate information, and I believe their investigation was inadequate. 2. Furnish accurate information to creditors : The inaccurate information on my credit report is harming my ability to obtain credit and other financial services. 3. Follow the FCRA 's dispute resolution procedures : The credit bureaus have failed to comply with the timeframes and procedures outlined in the FCRA.
