Consumer Complaint: In a recent check of my credit score, I noticed that PHEAA is reporting a default on a student loan that they say I took out in XXXX. After asking for validation and verification, I finally received a " Promissory Note '' that looks good until you get to the borrowers signature line. The promissory note that they forwarded to me, was not signed by me or anyone else. The borrowers signature line simply contains a bunch of numbers that look like my social security number, birthdate and other meaningless numbers. After receiving the promissory note, I took it to my attorney who agreed that a promissory note needs a signature by me in order to be a valid, enforceable contract. In order for PHEAA to recover on this promissory note, it needs to prove that the defendant ( me ) signed the promissory note, they need to prove that PHEAA currently owns or holds the note, and they must prove that the loan is actually in default. Therefore, PHEAA MUST provide me a SIGNED promissory note, as well as other documents showing an unbroken chain of assignment from the original creditor to the plaintiff. On XX/XX/XXXX, I was informed that PHEAA has now forwarded this debt to a collection agency. This action has added thousands to the debt the say they own. My lawyer and I are giving PHEAA 30 days to provide us with a signed promissory note, as well as the documents showing the unbroken chain of assignment. If those documents do not arrive, we are prepared to present evidence to a judge in common pleas court.

With holding correct or accurate information of first payment of delinquency with original creditor. Fraudulently creating new dates of accounts opened. According to my credit report these accounts are 16 years and 2 months old, but are still appearing on my credit history because of fraudulent activity. I have filed complaints with the credit reporting agencies, they are removed for a short period of time, but reappear on my credit report because of fraudulent activity reported.

Phone complaint ID # XXXX XX/XX/XXXX Complaint ID # XXXX XX/XX/XXXX Complaint No ID # I have received a statement that I am {$14000.00} behind in my payments. This is not true. I have in good faith made monthly payments of {$330.00} every month for the last two years. I am on an income repayment plan for the last three years. I have sent in the paperwork each year via mail in XX/XX/XXXX & XX/XX/XXXX in XX/XX/XXXX. In XX/XX/XXXX my salary increased and I was able to fill out the income repayment application online. I have a bank statement that shows payments each month in from XX/XX/XXXX to XX/XX/XXXX each month in the years of XX/XX/XXXX/XX/XX/XXXX and XX/XX/XXXX/XX/XX/XXXX. In the last year, my salary has increased so my income repayment monthly payment have increased to {$490.00}. I have called the FedLoan number to protest this bill of {$14000.00} There has to be some type of appeal process. I sent in the paperwork, I made every payment. I have been working at a XXXX XXXX for eight years. I am also on the public service loan forgiveness program. I made faithful payments for all of XX/XX/XXXX and now I am told that the payments do not count at all - that my default.

Consumer Complaint: I have spoken with Fedloan multiple times over the past few months about getting all of my loans into a REPAYE plan and placing all my loans on the same schedule as I am a medical resident and qualify for the PSLF program and need to be in an IBR plan. I was approved for the REPAYE plan on XX/XX/19 and all my loans were placed on the REPAYE plan. Then, a few weeks later on XX/XX/19, out of nowhere, some of my loans lost their forbearance and deferment status and were suddenly placed in repayment on a Standard repayment plan. I called and was told that this was a mistake and my loans were going to be replaced into forbearance so that all my loans would go into repayment at the same time. That was fixed and all my loans were back in REPAYE. Then, on Friday XX/XX/19 I received a letter saying my loan terms were recalculated and I was placed back into the standard repayment plan. I called on that day and was told that an error occurred on behalf of fedloan when my application for REPAYE was initially approved. They said I should have never been placed in the REPAYE plan and in order to get my loans back on the REPAYE plan they must generate an exit bill that I have to pay in order to go pack into REPAYE. My conversation was left stating if I pay the generated bill of {$5.00}, all my loans will go into REPAYE when they process my IDR application and I will not be responsible for any other payments towards my loans during the months it takes to process this. On XX/XX/19 I paid the {$5.00} bill and was told it would take up to 20 days to process my IDR application ( that at this point was submitted on XX/XX/19 ). Today is now 20 days since payment and my account has not been switched back into REPAYE and I received a new bill for XXXX of over {$3000.00} since I am still on the standard plan. Since I am eligible for PSLF, I have now missed out on 2 payments towards the program, which is frustrating as I am eager to begin making eligible payments towards the program. Throughout all of this, I have contacted fedloan multiple times via phone and email. My email on XX/XX/19 was never answered by the company.

Consumer Complaint: I have been paying my loans on time to MyFedLoans/FedLoan Servicing every single month since XX/XX/XXXX. I have the loans on autopay, so the payment comes out of my bank account on the XXXX of every month. I enrolled in grad school at XXXX XXXX University in XX/XX/XXXX but chose not to defer my loans, as I'm still employed full-time. I received an email from MyFedLoans/FedLoan Servicing on XXXX XXXX that XXXX XXXX University alerted MyFedLoans/FedLoan Servicing that I was enrolled in XXXX XXXX. Without asking me or giving me the option to opt-in, MyFedLoans/FedLoan Servicing auto-enrolled me in deferment. I have called MyFedLoans/FedLoan Servicing twice ( on XXXX XXXX and XXXX XXXX ) and submitted paperwork ( on XXXX XXXX ) trying to reverse this decision, but my loans are still in deferment, and I keep getting emails about my " request to defer '' - I requested ( via paperwork ) to do the opposite. I owe less than {$600.00} and just want to pay them off in early XXXX, as I planned. I'm surprised that it's even legal for my loan provider to opt me into deferment, especially since I have paid on time every single month for nine years.

On XX/XX/XXXX, Fedloan Servicing, stated that a " thorough investigation '' into the ( 6 ) student loan accounts were preformed by the OCA for PHEAA, concluded that the ( 6 ) student loan accounts were reporting accurately. On XX/XX/XXXX, I mailed a certified letter to Fedloan requesting validation of the debt. Fedloan Servicing mailed a letter on XX/XX/XXXX, in response. The letter received contained only ( 1 ) Master Promissory Note " dated '' for XX/XX/XXXX, along with a list of the ( 6 ) student loans. However, none of the listed student loan accounts reflect XX/XX/XXXX as a disbursment date, which means this is factual proof of ( 6 ) six unverifiable student loan accounts. In addition, the listed " Current Principal Balances '' on the student loans DOES NOT MATCH any of the information being reported to XXXX, XXXX or XXXX. ( Enclosed in the attachments are the credit reports from XXXX, XXXX, and XXXX, reflecting inconsistent, contradictory and unverifiable account information. ) I demand the immediate deletion of all ( 6 ) student loan accounts, as it pertains to federal and North Carolina state laws.

Company has been notified multiple times of this fact and continues to attempt to collect. The company is NOT a nonprofit. These facts in place means the loan is able to be discharged in bankruptcy. They continue to report negative information on my credit report denying my right to a fresh start and causing much distress

Consumer Complaint: Fed Loan continues to make extremely expensive mistakes with my student loans. I am on a income driven repayment plan as well as the Student Loan Forgiveness Plan as a XXXX XXXX XXXX. Every year I submit evidence of employment and as for a calculation for qualified payments as is recommended by Fed Loan. And every year they make mistakes calculating how many of my payments are qualified when they are clearly all qualified. This year, they are claiming only 6 payments are qualified. I havent missed any payments. I pay what they told me to pay. I fill out all the forms on time. I do everything they tell me to do. And when they make mistakes I tell them so. And they deny it. Every. Single. Time. Its like corruption is part of their policy. Its like they try to see if people are paying attention and what they can get away with. In my case, I stand to lose thousands of dollars. My anxiety caused by having to deal with this totally corrupt and insanely disorganized company has profoundly affected my life. I cant afford a lawyer to sue them, and they need to be sued. The CFPB is my only hope. I need the last two years need to be recalculated. The last time I requested the CFPB to help with my account you found over 10 of my qualified payments hadnt been counted!!!!! And now Im having to reach out again for the same reason!!! Its unacceptable!

Consumer Complaint: I have tried multiple of times to get fedloans to send me my past applications for my forbearance and deferments and they only sent a letter stating my loans are in good standing but my loans are showing past due XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX which is causing me to have multiple late payments hurting my credit score when i have always made sure my loans were deferred until i am able to pay which is soon but i need this fixed on their part. Consumer Complaint: The loan was initiated when I hadn't been formally accepted in to a graduate program. It was submitted with paperwork affirming my cosigner was financially unable to pay the loan and that I would solely be responsible in accordance with the origination policy. In XX/XX/2012, they put me in to repayment while I was still a student and attempted to harass my cosigner in to paying the full amount several months before they claimed my first payment was due. I was referred to a forbearance process that didn't actually exist -- no paperwork or forms despite what I'd been told over the phone by multiple representatives -- before being placed in to repayment. The company abruptly ended my payments without my consent several months later after I'd made a dent in the principle. When my payments were resumed, it was based on a total that included accrued interest from the period when I was in non-payment for being a student. In the years since then, AES has directly debited my account without issue. I have not done anything that would cause them to negatively attack my score, like miss a payment. The company has recently updated my credit report to say that they can not contact me yet continue to take my money and e-mail me to say that the transaction was successful. They call several times a week ( as they have for years ) to harass about the loan despite the fact that the account is not in arrears.
