Consumer Complaint: I XXXX XXXX has fulfilled every available legal means on protesting Pennsylvania Higher Education Assistance Agency having a student loan still posting on my credit bureaus, years after it was proven that the loan was a result of identity theft. I never attended college or any advanced education level above high school. The person who stole my identity is no longer located in the United States. I realize that he paid off the student loan, but as PHEAA is an authorized agency covered by the U. S. Department of Education, it should apply all of the subscriber rules to maintain an affiliation agreement with XXXX XXXX and XXXX XXXX respectively. The protest of this account does not fall under the Fair Credit Reporting Act, but mostly on the Fair Debt Collection Practices Act. In addition, the 84-month timeline also applies where the account should be deleted. I demand that this account be deleted permanently as PHEAA has an obligation to abide by its subscriber agreement with all pertinent credit bureaus. LEGAL DISPUTE REQUESTING FULL DISCLOSURE OF TRUE TIMELINES PERTAINING TO TRADELINE PROCUREMENT, IN ADDITION TO ACTUAL PAYMENT HISTORY PROVING ACTUAL INITIAL DATE OF FIRST 30-DAY LATE PAYMENT HISTORY, THUS TRIGGERING THE 7-YEAR RULE THAT RELATES TO ERRONEOUS OR OBSOLETE INFORMATION. 605. ( 2 ) Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period. ( 3 ) Paid tax liens which, from date of payment, antedate the report by more than seven years. ( 4 ) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years. ( 1 ) ( 5 ) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years.1 ( b ) Exempted cases. Consumer Complaint: I was a XX/XX/XXXX who was working towards PSLF from XX/XX/XXXX to XX/XX/XXXX. I left that job to take a job with the XXXX, as a federal employee in XX/XX/XXXX. FedLoan will not count my payment in XX/XX/XXXX ( despite being employed, on an income based repayment, and making that payment ) because on my payment due date, I had ended the XX/XX/XXXXjob and had not yet started my job XX/XX/XXXX I then asked if I had changed my due date to later in the month, if that payment would have counted. I was told it would have. But because I technically wasn't employed during the date of payment, the payment didn't count : even though for all but a few days in XXXX, I was employed and made a payment on an income based repayment plan. This was never explained to me prior. I was told there was no way to retroactively fix this.

Consumer Complaint: Fedloan reported delinquency on loan payments by failing to allocate payments correctly. I, the borrower, submitted the required payments as agreed, of which it is solely Fedloans responsibility to allocate the payments to all sequences of loans. Only Fedloan has power to allocate payments. As a Borrower, am can only submit a payment as whole, of which Fedloan segments and allocates.

Consumer Complaint: I have worked in public service in California universities for the last 16 years and have been crippled by educational debt while my lender continues to deny me Public Service Loan Forgiveness benefits. Though I have been paying off my XXXX loans since XXXX, and my graduate loans since XXXX, my current balance is over {$35000.00}, a balance, though 30 years old, is significantly higher than the principal I borrowed. Just this year, we were unable to secure a loan to refinance our home because of this staggering debt to income ratio almost exclusively from my student loans. Please find attached my letter for the CFPB Complaint Resolution Group regarding my formal complaint against loan servicer FedLoan and the US Department of Education and their failure to administrate the Public Service Loan Forgiveness Program along with attachments documenting FedLoan 's mismanagement of the program.

Subissue: Their investigation did not fix an error on your report
Consumer Complaint: My student loans were forgiven in XX/XX/2020 by fed loan servicing. For some reason the company intentionally or in error removed the loan completely as a trade line on my credit report. I asked them to please re report to the three credit bureaus reflecting paid in full, satisfied with no late or missed payments. The credit bureaus have no evidence fed loans has done this. In fact XXXX said if they had in fact done this it would have posted same day. Fed loans is dragging their feet and not helping me and they made the error by removing not completely as a trade line. This affects my credit score. I simply ask that they resubmit showing paid in full, satisfied with no late or missed payments. Thanks.

Consumer Complaint: A few years back we entered into an agreement to have my student loans reinstated and have a payment plan. Part of our agreement was to have the late payments removed from my accounts and updated with all 3 credit reporting bureaus. This was never done despite us following through. This is now negatively impacting my credit.
