Consumer Complaint: XXXX continues to hurt my credit by saying my private student loan is in active collections. This account, originally owned by National Collegiate Trust and XXXX XXXX, was included on my 2015 Chapter XXXX bankruptcy case. The original lender was contacted regarding my Chapter XXXX petition, and they never responded or took me to court for payment. The judge and court discharged and closed my case. No other lender has done this. All the other accounts that were included in my petition have been closed and say " discharged in bankruptcy '' since 2015. XXXX reports this account as new, and active, which is FALSE.

Consumer Complaint: There are XXXX accounts i have with fedloan servicing and the accounts show late payments on my credit report. I had talked to the Fedloan Servicing employee at the time and they said that they have noted the account with the financial difficulty and that there will be no negative reporting to credit agencies. Few month later The negative report showed up on my credit report, i have tried multiple times to contact them to resolve the issue and every time they deny the request.

Consumer Complaint: I filed for bankruptcy in XXXX under Chapter XXXX. My student loans through AES were listed as an unsecured debt. The Chapter XXXX Plan stated that no interest was to accrue on any debt, and that I was to make my monthly student loan payments to AES, outside the plan. AES admittedly refused my monthly payments, and put me in forbearance, at an 8 % interest rate. The final Trustees Report in XXXX stated, on page 1, item 10, that my student loans were discharged without payment, in the amount of {$84000.00}, because AES was to have accepted my monthly payments outside the Plan. AES failed to do this. AES received notice of the Trustees Report in XXXX, as well as the Discharge of Debtor Order. AES did not object or file a timely appeal. In XXXX, the United States Supreme Court held in United Student Aid Funds XXXX Inc. v. Espinosa, that an order of the bankruptcy court was enforceable, even if it was erroneous. In that case, the bankruptcy court listed the debtor 's student loans as discharged, and the creditor waited over a year to try to collect. The Court held the discharge order was enforceable since the creditor never objected or appealed. I have paid more than {$20000.00} to AES in the past few years, after the discharge. I would like that money back, with interest, and mu account considered paid in full. Thank you.

Consumer Complaint: I believe PHEAA to be in violation of unfair credit reporting and collection tactics during the pandemic. My loans went into default at the onset of the pandemic despite me attempting to work out a payment plan with them. Not only did they continue to report that I was in collections but they reported that I was late as well thereby purposely and maliciously affecting my credit. If that wasn't bad enough they sent my account over to a collection agency and added a whopping XXXX, XXXX to my loan bringing my loan to XXXX from XXXX. I feel that this is unjust and malicious in nature

Consumer Complaint: Hello The fraud I experienced involves involves my student loans with the U.S Department of Education and Fed Loan Servicing. In 2018 ( I was recovering from XXXX XXXX ) and I was contacted by an agency that said their name was " XXXX XXXX XXXX. '' They also went by the name " XXXX XXXX XXXX. '' I am a licensed social worker in MA and this agency informed me that I was allegeable for a public service or loan forgiveness program, as I worked and continue to work for a non-profit. They had me complete some paperwork and then told me I was accepted for loan forgiveness and instructed me to stop making loan payments. I later learned that I had been scammed. They took money from me and I missed 4 loan payments that are now on my credit report. I did submit a " Direct Credit Dispute Form '' with Fed Loan Servicing and provided evidence of the fraud. Fed Loan servicing agrees that I was scammed but stated that I must contact FTC to make a report. I did submit a report with FTC - but it says clearly that its just for reporting but can not solve the issue. The FTC voice mail instructed me to contact Consumer finance to submit a report and provide evidence of the fraud.
