Consumer Complaint: A coalition of attorneys, announced on XX/XX/2020, a settlement with Santander Consumer USA Inc. ( Santander ). The settlement resolves allegations that Santander violated consumer protection laws by exposing subprime consumers to unnecessarily high levels of risk. Santander has agreed to help repair consumer credit reports that were damaged by its alleged practices by removing the account from credit reports. In the settlement on page 9, paragraph 16, " Santander agrees to provide notice to each CRA to which Santander reports, requesting the deletion of the trade lines associated with the account for all Deficiency Relief Consumers and for the Consumers who receive relief pursuant to Paragraph 11. '' I have two letters to credit reporting agencies and have not received a response regarding this particular issue.

I don't have any knowledge of these accounts being open. They were opened fraudulently. I understand that under federal law, ( the Fair Credit Reporting Act. ) unauthorized inquiries, and fraudulent accounts shall not be allowed to be placed on my file unless I have approved it.The presence of these fraudulent accounts and inquiries on my credit report constitutes inaccurate information, which must be removed under the Fair Credit Reporting Act. Respondent, please have the following inquiries removed from my credit file immediately because I did not authorize them, these creditors do not possess my signature, on any documentation, conveying my authorization to inquiry for a loan, or a line of credit.

Consumer Complaint: Due to a temporary situation financially of having to care for and pay for my mother ( XXXX XXXX ) funeral and burial out of my own pocket and alone which caused me to have some late payments earlier in my loan. I have worked diligently to keep them up and consistently on time. I have never absconded and have been tirelessly in communication about the account. The agency ( Santander ) agreed thru a goodwill gesture to update my account and I was told they would rid any late payments statuses to all 3 reporting agencies and late payments would state ( XXXX ) or none. This is extremely important now because I had a background check performed and this was revealed to my employer. It could jepordize my future employment and other current situations by this reporting. This damage would be irrepairable and permanent. My plan is to pay this account in full by XX/XX/2020 and have put things in place to do so.

Consumer Complaint: Santander consumer USA has been an issue since Ive gotten their service. I complained to them in writing three times & then twice to the credit bureaus. They are saying that i made a late payment in XXXX. I disputed this late payment, they then moved it to XXXX on XXXX and XXXX but on XXXX reported it indeed XXXX. Making it look like two late payments. They also have the wrong number of debt owed. They are reporting my balance {$800.00} more then i owe & i make my payments on time every month.

Consumer Complaint: On XX/XX/2020 I attempted to pay off my vehicle loan with Chrysler Capital Account # XXXX. I received a payoff quote on Chrysler Capital 's website, but when I tried to make a one-time payment, the website said that the daily limit was {$2900.00}. I tried various methods online, none of which allowed me to make the payment. I then called Chrysler Capital, and they told me that they would not accept a payment greater than {$2900.00} on their website. I was told my options were to 1 ) mail a paper check, 2 ) make 12 to 13 payments of {$2900.00} each, or 3 ) figure it out with my bank on how to pay CC, such as getting a cashier 's check. I am not about to go to my bank in the middle of a pandemic to figure out how to pay an auto finance company, and I don't use paper checks due to identity theft that has happened to me before by using paper checks. So I guess I'm stuck with making 13 payments over the next 13 days, all while CC continues to assess daily interest on my account. The call was escalated to a manager and then to the executive support team. No one could tell me why the {$2900.00} daily limit was in place, so I am left to assume that CC wants to make it hard for their customers to pay off their loans so they can accrue more interest. Shameful - I've had ~10 auto loans in my life and I have paid all of them off early, either by a simple phone call or online. Chrysler Capital 's policy is clearly UDAAP - by saying they have no prepayment penalty, they neglect to calculate the additional interest a consumer will incur by navigating their arcane payoff methods. Chrysler Capital could teach cable companies a thing or two about making it hard for customers to end their service.

Consumer Complaint: I co-signed my sister for a Santander auto loan but it was a bad loan and Santander got sued by the feds for giving bad loans so in the deal they made with the feds they need to remove that from my credit and my sisters credit however that has not happened The car is a XXXX XXXX XXXX and thats year the deal were made as well ... And it got repoed in XXXX

Consumer Complaint: We sent a payoff check with confirmed delivery on XX/XX/2020 and they have yet to process it as of XX/XX/2020. Every time they are contacted via telephone, they tell us to wait and that it is in processing. The date of the first payment was coming due ( XX/XX/2020 ) and we were getting worried, so we sent them a message in writing through the online account. They claim the check was never received via writing and now refuse to communicate in writing only sending a form message telling us to call every time we send a message. We are looking at additional fees now to pay off the loan ( stop payment, postage and signature confirmation ). Any reputable company would apologize and try to attempt a resolution. Extremely poor customer service on Santander Consumer USAs part. Please help us get away from this terrible company and help spread the word so other consumers are not financially impacted by their poor business practices.

Consumer Complaint: I had a car loan with Gateway One Lending in XXXX of XXXX. Unfortunately, I had to file bankruptcy in XXXX. When I did Gateway One was one of the lenders that were part of the bankruptcy. In XXXX of this year, Santander Consumer Finance reported an account that was part of my bankruptcy because they bought out Gateway One well after my account with Gateway One. Santander not only is filing on my credit that I had an account in BK with them but they are also changing a couple of the numbers to closely match the Gateway Account. Santander also showed the account as a charge-off with a balance which XXXX has already removed and changed it to part of the BK and XXXX balance. I do not understand how Santander can show an account on my credit when I never had a loan with them. If they can, I ask how can they show the same account/loan filed under two different names, Gateway and Santander? I feel this is a very fraudulent report from Santander and needs to be removed from my credit. When Santander reported it last month my score dropped over 80 points. This made our mortgage company decline us buying our home. We hated to file BK, but we did and have been paying any and all of our loans perfect. How can an outside financial institution just add this to our credit just because they bought out a lender that we dealt with and again I say that we never had a dealing with. Not a contract or anything. Thank you for your help.
