Issue: Struggling to pay your loan
Subissue: Denied request to lower payments
Consumer Complaint: I have been a customer with Santander since XX/XX/2018. At which time I was not advised of the upside loan agreement and after several months I become disabled and I notified the company multiple times advising of my separation from work, consistent hospital admissions and XXXX. I offered to setup payment arrangements and I continued to have my late payments reported to the credit bureaus and was threatened to have my vehicle repossessed. I'm unable to refinance due to the high interest rate and the balance, although I made payments I was told those payments were applied to the interest and the principle balance. When I was by Covid19 I notified Santander and was advised assistance would be provided and that agreement never took place again attacking and damaging my credit score. I was notified in regards to the lawsuit against Santander and contacted Santander and I was advised that information was in accurate. The Truth and Lending Act clearly shows Santander manipulate low income families and refuse to accept responsibility. I'm in desperate need of help at this time with resolving this issue. I have contacted my Attorney General and as of now they were unable to assist. I was advised to review the website https : XXXX? XXXX In regards to updated information, and at this time I'm unable to make payments which continues to affect my credit score.

Consumer Complaint: I purchased a vehicle with a loan from Santander. In XX/XX/2017, my car was totaled. My insurance paid the amount that my car was valued. I submitted everything needed for my GAP insurance to cover the rest. My GAP insurance sent the payment to the dealership I bought my new car from instead of Santander. Once I found that out, I had the dealership cut a check to Santander for the remainder. Santander took 4 months to close out my account after they got the remainder of the load payment. Santander now has 5 charge offs on my credit report for payments that were late even though it was out of my control because of the wreck and GAP insurance company. I have tried contacting Santander but because I no longer have an account with them I can not get in contact with anyone. I filed disputes on all credit bureaus but nothing has changed.

I have submitted extensive documentation showing that I was not even in the country at the time the transaction took place, police reports showing theft of identifying documentation just a couple months prior to this incident. I also had a forensic document examiner to review the signed contract. The examiner, proved that I did not conduct this transaction. I have written to XXXX, Santander, and XXXX XXXX to let them know of the fraudulent activity way back in XXXX. It is now XXXX and no changes have occured, the account is still listed on my credit report and it is causing harm.

Consumer Complaint: I am filing a complaint against Santander, but I believe they have failed to comply with my SCRA rights. On XX/XX/XXXX, I received orders that called me onto full time XXXX XXXX duty. I reached out to Santander on XX/XX/XXXX by email and asked that they apply the SCRA benefits to my account ( lower my interest to 6 % or less and retroactively adjust my account ). I included my military orders along with this email. Since XXXX, I have been called on to XXXX XXXX sereval times. I have included all of the orders as an attachment. I emailed again on XX/XX/XXXX to follow-up on my request, but I still have not received a response. When I log into my online account, I am unable to see my current interest rate. I reviewed my account transactions I do not see any adjustment to my account. I would like Santander to immediately apply these corrections. In the future, I would also appreciate much more responsive communication.

Consumer Complaint: A XXXX XXXX XXXX vehicle I financed with Santander USA was wrongfully towed by the XXXX county police impound during the COVID-19 lockdown on XX/XX/XXXX, due to expired tags. And Santander USA failed to regain possession of the vehicle from the impound before the Police Auction date of XX/XX/XXXX that was provided to them weeks in advance. The vehicle was auction off at {$15000.00} way less than the {$20000.00} market value, which leaves me liable for a large portion of the remaining loan balance because they failed to pick up the vehicle in due time even though they were advised to. And now Im left to pay for a vehicle I no longer have possession of because they fail to regain possession of it.
