Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: On XX/XX/XXXX upon viewing my credit file via XXXX credit monitoring, I noticed a collection account by Resurgent Capital Services of a debt that I have no recollection of. Worth noting is that this is the only collection account reflecting on my credit file and has caused my credit score to significantly plummet. I have never received any communication of this debt from Resurgent Capital Sevice. More importantly, they did not provide me with any notification what-so-ever of my right to dispute the debt. Today, onXX/XX/XXXX, I contacted the above-mentioned collection agency and spoke to an agent, who I asked to verify their mailing address. Attached is a copy of the letter I mailed to them on XX/XX/XXXX asking for a verification of the debt.

Consumer Complaint: I have repeatedly disputed the accuracy of reported debt to XXXX the last 2 dates are XX/XX/XXXX and XX/XX/XXXX The accounts disputed were XXXX XXXX reporting an {$840.00} balance and XXXX XXXX with a balance of {$490.00} which is not accurate. Therefore should be removed. They do not notify me at all not by paper letter or electronic. When I spoke to XXXX they simply said they verified the account was mine, no mention of the balances date of accuracy nothing. My lifestyle is being impacted by their negligence to report my credit file accurately. FTC laws are suppose to protect consumers from this type of activity and behavior.

Consumer Complaint: XXXX XXXX of Resurgent Capital is continually reporting negative information to the credit bureaus that should not be on my credit file. I have disputed with the Credit Bureaus, 2 bureaus have removed the collection. Also according to the State of Florida neither company is registered to do collections. I have attached the pictures from our State website. Unless this company can provide a signed contract where I XXXX XXXX owe this debt and proof their license are active in Florida these collection account needs to be removed ASAP.

Consumer Complaint: I have sent numerous debt validation notices and never received a response back from the creditor. As per the Fair Debt Collection Practice Act ( FDCPA ), a creditor is supposed to response and no attempt to collect until they have responded. However, this creditor has not responded and is still attempting to collect, which is in violation of the FDCPA.

Consumer Complaint: After checking my credit report on XX/XX/2018, I noticed that there was an open collection wilth XXXX XXXX. This account was originally with XXXX XXXX XXXX which I was a victim of Identity theft and it was removed from my credit report. I have not had any communication with this company and there has not been any communication notices made to me from this company to notify me that they were attempting to collect money from me. They have violated my consumer rights under the Fair Credit Reporting Act. Withholding Notices You are entitled to notices concerning the reporting, handling and use of your credit information. Notice violations under FCRA might occur when : a creditor fails to notify you when it supplies negative credit information to a CRA a creditor fails to notify you of your right to dispute inaccurate credit information or the validity of the debt. This account was disputed with XXXX XXXX XXXX and as soon as it was deleted from my credit report, XXXX XXXX purchased this debt, did not notify me in writing but simply placed this account on my credit without notification. I would like to file a complaint to have this incorrect reporting deleted from my credit report and have this company blocked from future reporting of this account. XXXX XXXX has performed unethical business practices.

Consumer Complaint: XXXX XXXX continues to report inaccurate information on my credit report with XXXX, XXXX and XXXX without sending in proper documentation as proof that the account is in fact my debt. This is a direct violation of section 609 and 611 of the Fair Credit Reporting Act. The credit bureaus fail to protect me as a consumer and do not follow the proper guidelines in place to verify debts on consumers credit file.
