Consumer Complaint: I had sent two ( 2 ) Certified letters on XX/XX/2018 and XX/XX/2018 to XXXX XXXX, XXXX, XXXX XXXX XXXX, XXXX, SC XXXX requesting them to send me a " validation '' ; that is competent evidence bearing my signature, showing that I have some contractual obligation to pay them. Never heard from them nor gotten any correspondence back from them. Instead, I noticed that they had indicated on their remark section for XXXX that " Account information disputed by consumer, meets FCRA requirements ''. XXXX and XXXX had not been reporting said collection account anymore. Since XXXX failed to produce requested documentations, I simply want them to completely remove said collection account. If needed, I can submit said copies of above mentioned Certified letters with respective return receipts. Lately, it seems like Resurgent Capital Services had join the fracas of sending me notice of trying to collect on the same item without involving any of the credit bureaus. Presently, only XXXX is the only one still bearing said collection item.

Consumer Complaint: Firstly, to the CFPB, this is not a duplicate. Listen, Resurgent Capital Services L.P. has an OBLIGATION under the law to me as a consumer to provide me with what I requested. This company is now stating that they will not investigate again, which they ARE NOT supposed to do. They HAVE NOT provided me what I have requested. They are claiming that my CLAIMS have been " substantially the same '' when I have HAD to repeat myself because they keep coming back with a lack of proof, validating and verifying the account on my credit reports! You all ONCE AGAIN sent me an attachment with bills and statements, which are NOT viable proof of an account 's validity under the FCRA! The addresses are even different on the BILLS and STATEMENTS. Verify that that address has ever been mine. They've not even provided proof of THAT. My credit reports are at stake here -- NOT theirs -- and I will sue for damages if they keep this up because they are NOT supposed to report accounts that do not have original, signed consumer contracts on file! In addition to this complaint now is their refusal to cooperate and give me due process while I have been doing my due diligence for over 7 months! The next step is litigation.

The problem I have now is that the date of first delinquency on my credit report is not correct. It is listed as XX/XX/XXXX when it should be listed as XX/XX/XXXX. You can see the date the last payment was received was XX/XX/XXXX per the attachment supplied by Resurgence Capital in my earlier complaint. Misreporting the date of first delinquency or " re-aging '' is an FCRA violation.

I have never or agreed to any contracts verbally or written with this company for any payments owed or debts due. I have never heard of this company and now I am getting an overflow of emails from this company threatening me that I have to resolve my account balance or it will be sent to a lawyer. I know that I owed XXXX XXXX for an amount way less than this company claims I owe. I tried to work with XXXX XXXX company back when I was unemployed and they were working with me until this XXXX XXXX XXXX appeared on my credit last year in XX/XX/2017, which this debt collector is holding my credit score down and restricting me from getting an apartment and auto loan. I do need a home and transportation for work and it requires to build up my credit. I thank you for your time.

Consumer Complaint: I explicitly requested from XXXX XXXX XXXX a scanned original consumer contract bearing my actual signature and they have not provided me with that at all. What was sent to me were some statements, bills, and itemized lists -- all of which are NOT proper validation under the FCRA and FDCPA. If XXXX can not provide the REQUIRED scanned original consumer contract / original instrument of indebtedness in its original form, then I demand that this account be IMMEDIATELY DELETED from my credit reports. Again, the law states under FCRA Section 609 ( a ) ( 1 ) ( A ) & Section 611 ( a ) ( 1 ) ( A ) that original consumer documentation is required to consumers, particularly upon their request. Furthermore, XXXX, you have also failed to provide the method of verification as required under Section 611 ( a ) ( 7 ). Under Section 611 ( 5 ) ( A ) of the FCRA you are required to promptly DELETE all information which can not be verified.
