I need this resolve, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence ( 1 ) In general No person ( company ) shall sell, transfer for consideration, or place for collection a debt that such person has been notified under section 1681c-2 of this title has resulted from identity theft. ( 2 ) Applicability The prohibitions of this subsection shall apply to all persons collecting a debt described in paragraph ( 1 ) after the date of a notification under paragraph ( 1 ). ( 3 ) Rule of construction Nothing in this subsection shall be construed to prohibit -- ( A ) The repurchase of a debt in any case in which the assignee of the debt requires such repurchase because the debt has resulted from identity theft ; ( B ) the securitization of a debt or the pledging of a portfolio of debt as collateral in connection with a borrowing ; or ( C ) the transfer of debt as a result of a merger, acquisition, purchase and assumption transaction, or transfer of substantially all of the assets of an entity. A person that furnishes information to any consumer reporting agency shall have in place reasonable procedures to respond to any notification that it receives from a consumer reporting agency under section 1681c-2 of this title relating to information resulting from identity theft, to prevent that person from refurnishing such blocked information. Consumer Complaint: This company is reporting inaccurate, incomplete, and old information on my credit report. They refuse to validate the debit. They also refuse to really address any disputes in a reasonable legit fashion. They are not following the FCRA guidelines and are unwilling to work with me to resolve either one of the illegally reported accounts they claim to have on me to the credit reporting agencies. This company has violated my rights to protected access by leaving messages claiming false statements about debit on public answering machines. One rep spoke with someone other than myself and clearly gave them my personal identifying information including social security number.

Consumer Complaint: my complaint is about blatant violations by LVNV/Resurgent and XXXX, XXXX and XXXX. I asked LVNV to validate a debt they have listed on my credit reports. The first letter I sent was in XXXX they sent a bill to me. I again asked them for proper validation and they ignored my request. Since then I have sent 4 other letters and got no response. I can provide the letters upon request. I then disputed with the credit bureaus using the factual evidence from my reports. Needless to say I found several violations and inaccuracies so I disputed those as well even so they continue to report with no regards for the laws. I will attach pages from my report so you can record these violations. Each bureau has been reporting different information which can't be accurate. such as trying to re-age an account, also moving an account to another area on my report. Changing a collection from open to closed then back open. XXXX even went on to say they were no longer reporting this LVNV account but it's still there. This account has been listed with consecutive Charge-Offs for 2 years straight as well as reported late and past due on this collection. See for yourself.They seem to think the laws don't matter. I can't be the only one they're doing this to. I could really use your help in this matter.

These letters also detailed the incorrect and inaccurate information being reported to my credit profile. Letting them know it had been 30 days and that I would filing a complaint with the CFPB. Consumer Complaint: LVNV Funding XXXX XXXX XXXX XXXX, SC XXXX XXXX Problem with LVNV Funding for allowing incorrect information to show on my credit report. According to FCRA section 609, when the consumer disputes an item and request for the original contract with my signature to be produced to me to prove the ownership of this fraudulent accounts. They have 30 days to produce and they do not produce contract with signatures, but allow these accounts to stay on my report. I have written and disputed this produce and no correction has happened. 1 ) LVNV funding # XXXX {$550.00} I have not done any business with these companies. Thus I am requesting an original contract with my signature and date. If they can provide it these three accounts must be deleted.
