Consumer Complaint: I sent a letter to LVNV Funding LLC XXXX collection agency XXXX disputing and requesting validation for an account on XX/XX/2021 and mailed it certified, return receipt requested. I tracked the letter via the online United States Postal Service website and noticed that LVNV received the dispute letter on XX/XX/2021. I was not contacted nor was my validation request honored within the 30 day timeframe. Therefore, I sent a follow-up letter on XX/XX/2021, which was received by the collection agency XX/XX/2021, to request removal of this information due to the company failing to respond. I finally received a response from LVNV in XXXX, however, it was past the 30 day mark. Per the Fair Credit Reporting Act, Section 611 ( a ) ( 5 ), you have 30 days to investigate disputes. If you can not verify the information within the 30 day time period, you must delete all of the disputed accounts from my report. With that being said, I am requesting for LVNV to delete the disputed and unverified accounts.

Consumer Complaint: I went through the help of a debt consolidation company, XXXX XXXX to help with the overwhelming debt I incurred over the years. The payments went smooth and everything was paid on time. My XXXX mega group account was from original balance of {$2700.00} to the settlement amount of {$1000.00}, and was paid off and resolved in XXXX of XXXX. That account was taken out in XXXX of XXXX. Starting in XXXX I started getting letters in the mail that the account was charged off and sent to a collections agency. I've disputed the information and requested a payoff letter from XXXX to which they have never provided. I disputed it with LVNV Funding and Resurgent where the collection letters came from. They said that my information wasn't enough to prove that it was paid off when I have the literal receipts of payment. This is putting my livelihood at jeopardy because I'm not able to do things that a credit check is needed for.

Gravens ( Mo ) 281 SW 715, 719, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. In a good faith effort to resolve the matter amicably, I restate my demand for proof of the debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of the authority in this matter. Absent such proof, must terminate this collection action, and correct any erroneous reports of this debt as mine. Lvnv Funding Llc never provided any proof, as well as left Derogatory marks with the intent to hurt my ability to obtain credit which causes a detriment to my lifestyle.

These laws are to make sure that a level and fair playing field exist to protect American consumers from abusive reporting procedures on credit reports, as well as illegal and deceptive collection practices. Consumer Complaint: I wrote XXXX starting in XX/XX/XXXX about a Collection company Lvnv reporting on my credit and ask to have it removed. As a result they did not remove it saying that it is mine. However, I wrote to all three credit companies and two of them XXXX and XXXX did remove it and then Lvnv tried to place it back on my report after it had been removed I reported it to them and they removed it again. So I wrote XXXX again and again and ask them to verify it and they did not but still has not removed it. I also wrote the company as of XX/XX/XXXX and they could not or did not verified they sent me a statement from the original creditor without any type of signature of mine. So as of now I have wrote back to them asking them to provide evidence that this is my account bearing my signature and let them know that what they sent to me for verification is not FCRA proof for what they sent is a statement letter from the original creditor and asked for immediately removal as of now has not complied or reported to XXXX that I am disputing these accounts. Not only that XXXX has allowed them to reopen this file on my credit report which was showing closed when originally disputed. Also it shows an inaccurate date, past due date, wrong high balance from when it was originally reported and a inaccurate date of last activity and is missing information and the account numbers have been changed several times and so has the addresses. This is my second step before I file a small claims against XXXX and Lvnv. All my disputes have been sent certified mail and I have all the copies, accept the one I sent through XXXX XXXX. This is damaging to my credit profile and as a result I am unable to receive a mortgage loan without this being removed off my credit report and they ( XXXX and Lvnv ) have left me no choice but to take action.
