Consumer Complaint: On XX/XX/XXXX a foreclosure complaint was filed against me. On XX/XX/XXXX, I filed a counterclaim against the Plaintiff. On XX/XX/XXXX, I submitted a request for a loan modification request to Ocwen, the current servicer for my loan. On XX/XX/XXXX, Ocwen acknowledged it received my request and on XX/XX/XXXX, Ocwen asked for some additional documents. There were a few more requests, and on XX/XX/XXXX I was approved for a modification. On XX/XX/XXXX, the lawyer for Ocwen sent me a letter discussing a settlement agreement would be drafted if I liked the modification. XXXX XXXX, Ocwen 's lawyer then told me that I had to dismiss my counterclaim with prejudice in order to get the modification. I then filed a motion to dismiss my counterclaim which was granted. However, Ocwen 's lawyer refused to dismiss the foreclosure complaint and said they were going to proceed with litigation and the case was continued to XX/XX/XXXX. On XX/XX/XXXX, I did receive my final signed loan modification, but the foreclosure complaint is still pending. I read in the CFPB settlement that a bank can not make me dismiss my counterclaim as a result of a modification. I had to go through underwriting, and I was eligible for a medication. I dismissed my counterclaim for fear I would lose the home my mother built.

Consumer Complaint: Do to medical situations Myself and my Wife can no longer make our mortgage payments. Our home has been for sale since XX/XX/XXXX with not even XXXX offer until two weeks ago. The offer is less than the total balance but agreed to the lesser amount. Myself and real agent submitted the paperwork that was requested by Ocwen XX/XX/XXXX I received a letter from Ocwen XX/XX/XXXX stating " kindly provide a copy of XXXX benefit statement income in financial form of RMA ( XXXX XXXX XXXX '' The next line stated " Kindly provide a valid copy of bank statement reflecting XXXX latest transactions for the XXXX income. ( XXXX ) My wife faxed Ocwen the requested information again on XX/XX/XXXX. Another letter was received from Ocwen XXXX XXXX stating " Kindly provide a copy XXXX benefit statement income mentioned in financial form of RMA. " I called and spoke with a representative and asked them to be more specific on what exactly they are requesting. After I explained my wife does not receive a monthly statement from social security and the XXXX confirms her yearly earnings and the bank statement confirmed her monthly earnings the representative agreed and said that was all they needed. So today I have received another l asking me to provide the same information. Another call to Ocwen was terrible and they could not provide me with the what they need for additional paper work. I was transfered to a manager that basically would not listen to my questions and could not provide the correct answer as to what documentation they want. My real estate broker told me its a horror show dealing with Ocwen and now I agree. I had to spend alot of my time in a hospital. I feel so bad to sell my home and its turning into something no one should have to go thru tryning to deal with Ocwen.

Consumer Complaint: On XXXX XXXX, 2015 at XXXX, I contacted Owen Loan Servicing in reference to my account. I spoke with XXXX XXXX XXXX and asked about some documents that were being requested ( Form XXXX ). The complete package has been faxed over twice and the form XXXX was faxed along with the package. It is very difficult to get assistance when calling to the company because not one understands or speak English well. Ocwen continue to ask for the same documents repeatedly although the package has been sent twice.

Consumer Complaint: Ocwen Loan servicing applied a lender-place insurance on my account by mistake. I always had insurance. So, finally after almost five months of requests ; they addressed the issued and applied the amount of the error ( {$5900.00} ) towards the principle balance instead of the escrow leaving the escrow account negative for the above mentioned amount. The Loan was transferred to a new service company ( XXXX ) which has not been able to resolve the problem too ( 3 months so far ). I keep being bounced back and forth between them and nothing has been resolved. In total I have been dealing with this issued caused by Ocwen for over 9 months between both loan service companies ; amount of months I have been overpaying my mortgage by {$100.00} since my monthly payments increased due to the negative balance in my escrow.

I have made all payments from XXXX in full and on time. until XX/XX/XXXX when they advised I was 5 months behind on my payments. I have sent all the information to Ocwen XXXX times proving all of the payments were made by the trustee and myself.. they still advise I am behind and are threating to foreclose they returned my XXXX payment I have contacted a attorney they advise I file a complaint the you first.

Consumer Complaint: My wife and I have been trapped and dealing with OCWEN since 2013 when I first lost my job. They said we needed to be behind on payments before we could qualify for a HAMP Program. We also hired a company that deals with OCWEN called XXXX XXXX XXXX, they told us along with OCWEN that they work together to help customers reduce interest, payments and ultimately save your home. We feel both of these companies have deceived and taken advantage of us especially by OCWEN saying they work with them. To date OCWEN continues to change the amount owed on our home, we have made our trial payments on three different modification plans, our interest rate to 4.6 % when in 2013 when we originally agreed to the plan it was 2.3 %, they extended the terms of our loan to 555 months even after paying on our original loan for over 8 years, they continue to add un explainable fee 's. We have not been offered any forbearance or any programs to help short term, they will not tell us why. Our relationship manager has changed two times and neither one would make effort to call us at times that were schedule by them or their staff. OCWEN continues to call 5-10 times per day saying that we need to make payment, even though we pay every month on time. OCWEN refused to accept our XXXX payment in any form unless we spoke with our relationship manager. We sent a check certified to the payment department, they recieved it but have not cashed it yet. Your help would be greatly appreciated, help with dealing with OCWEN and saving our home

Consumer Complaint: My husband and I refinanced our mortgage in XX/XX/XXXX with a broker named XXXX XXXX XXXX of XXXX, FL. The Mortgage ( attached ) was dated XXXX XXXX, XXXX, was assigned by Assignment of Mortgage on the same date to Option One Mortgage Corporation. Both of these instruments are recorded in the Public Records of XXXX County, FL. We built this home in XXXX on land we owned free and clear, and moved in XXXX of XXXX. We learned through a succession of loan services for our mortgage ( Option One, American Home Mortgage, Homeward Residential, and now currently Ocwen Home Mortgage ) that our mortgage refinance from XX/XX/XXXX was placed in a mortgaged-back trust. We have a HAMP modification and are not in default, nor have we ever been in default or had foreclosure proceedings brought against us. My husband and I are planning to pass our home to our daughter when we pass away, and based on information we have learned from the mortgage crisis, our title is probably clouded. We want to know who owns our mortgage ; what entity will issue the Satisfaction of Mortgage when we pay it off? Clearly, many homeowners had to deal with fraudulent assignments " after the fact '' because the trusts had to show ownership for them to foreclose. Since Option One went out of business shortly after our mortgage was executed ( and the successor company no longer dealt in mortgages ) ... but our mortgage trail has no assignment ( s ) to the real estate security trust ... and creating assignments at this point to recreate that train of title would be fraudulent ( because the pooling and service agreement for the trust stated that the assignment to the trust had to be accomplished years ago before the trust closed ) ... how in the world is legal title going to be accomplished when the mortgage is satisfied and we own the house? We need to know what to do to establish clear title and guard ourselves against Ocwen Home Mortgage ( a known violator of fraudulent assignments and " robosigning '' ) from creating any fake documents.

Ocwen confirmed receipt of documents and stated a review had been opend. on XX/XX/2015 ocwne Stated nothing was needed. On XX/XX/2015 ocwn stated they needed a date of when hardship started. That info was given to them that same day. XXXX was called on a daily basis. Nothing was needed from them and the file was under review. On XX/XX/2015 Ocwn called and stated they would not review the file any further as the sale date was too close. They stated that there was missing info which was the date of hardship and that is why they could n't review the file. That info was given to them same day it was requested. Ocwen is refusing to assist the homeowner per XXXX XXXX and per supervisor XXXX XXXX. Ocwen is discriminating against XXXX XXXX because she is XXXX. Ocwn is discriminating against her based on her race, national origin and sex,. Ocwn needs to treat her file as any other file and properly review the file.
