Consumer Complaint: My mortgage was sold to OCWEN by GMAC. With GMAC, I had the ability to prepay principal ( as my note allows ) anytime I wanted via ACH through the GMAC website. OCWEN has no such functionality. So I have to call them monthly to prepay principal. Here 's the issues1 ) They do n't let me prepay principal if it 's between the XXXX & XXXX of the month as they consider my mortgage " late ''? That is not what the note says. So I 'm forced to wait until they clear my monthly mortgage check ( which has NEVER BEEN LATE ) to make a principal payment. 2 ) XXXX out of XXXX times they apply this principal payment to an upcoming mortgage payment even after I have directed it to be applied to principal. When questioned, they say it 's their system limitation Well now I notice that they actually apply the principal payment when I finally call them to have it fixed!! Not when they received it. So my amortization schedule is incorrect. They are horrible!!! I 'm considering paying off my mortgage to avoid having to deal with them!! They should be banned from mortgage processing due to their gross incompetence!

Consumer Complaint: We where given a MHA modification effective XXXX XXXX 2014 with our mortgage company Ocwin Financial. The program was MHA 's Principal Reduction Alternative ( PRA ). Ocwin issued a XXXX Cancellation of Debt dated XXXX XXXX 2014 showing a discharged amount of XXXX. However the program is structured so that the balance is a forbearance and then XXXX of that forbearance will be forgiven on each XXXX year anniversary for a XXXX year period. Ocwin should not have issued a XXXX for the forbearance on XXXX XXXX 2014. We have contacted Ocwin on serveal occations and the refuse to issue a corrected XXXX. This has resulted in a XXXX dollar tax bill. We where expecting a return of XXXX that was going to be used to help make our mortgage payments. Ocwin 's mistake has resulted in us being unable to make our mortgage payment and accruing interest and penalties with the IRS because we can not afford to pay the outstanding balance with them. We feel like we are in a catch XXXX. If would could resolve this issue it would save our home.

Consumer Complaint: Ocwen is reporting me late to the credit bureaus even though I 'm using their bimonthly service. For example, payments will be received timely by Ocwen, but they do not post them timely. Most recently, I received a default letter from Ocwen, when my payment is current. I 've called Ocwen before about this, and was told numerous times, that I was n't being reported late to the credit bureaus. In my opinion, Ocwen does n't know how to handle a bi-monthly payment - they are holding funds in the suspense account w/out applying them in a timely fashion. I want my credit report corrected to show that I have had no late payments with Ocwen since XXXX, XXXX. They are reporting me late for XXXX, XXXX and for XXXX, XXXX.

Consumer Complaint: I was transferred to Ocwen from XXXX XXXX a few months after I lost my job. I had completed a loan modification and there was not enough time to review it before the transfer to Ocwen. A month later, I asked Ocwen about the paperwork and they denied getting it. Told me to give it another month. In XX/XX/XXXX I submitted the loan modification to Ocwen. They put me off, ask for papers that had previously been filed. Wasted 8 weeks and told me I had been denied because I was on unemployment and that did not count as income. We argued back and forth, the President made the announcement that unemployment was income, so Ocwen had me repeat the entire document. This went on with excuses such as, various papers never arriving again and again and again until time had run out and they told me to start the entire process over again. I was unemployed, my unemployment benefits ran out XXXX, I applied for XXXX but kept getting turned down. I was trying to pay a {$1400.00} mortgage, credit cards, and utilities. I had sold all stocks, bonds, XXXX, cashed in pensions, sold my jewelry and my inherited jewelry and silver to pay the bills.By XX/XX/XXXX I did not have a penny ; Ocwen could have cared less since they had a Foreclosure date of XXXX XXXX. The credit card companies kept saying I did not qualify as a hardship. I had my XXXX hearing date around XXXX XXXX. I had previously applied to the Foreclosure Prevention Fund, but I had not heard anything. I had the XXXX hearing and won XXXX benefits, but the hearing judge denied my {$30000.00} in back pay. Something he does inconsistently, so says my attorney. I caught the judge on the day he denied back pay if the applicant got unemployment six months earlier. Discrimination? On XXXX I was approved for the FPF program who paid Ocwen {$34000.00} in penalties and past due mortgages. I called Ocwen for the five days before the sell date of my home and got sarcasm and a heavy hint that I was lying. On the XXXX, Ocwen sold my home. I called the attorney practice representing Ocwen and told them of the stay since the XXXX and I heard the attorney scream loudly as she dropped the phone and ran out of the room. I was told XXXX XXXX intervened and returned my home to me. OCwen, acting like the bunch of fools they are, called me falling over themselves with the FPF offer and said I now would get my loan modification. Towards the XX/XX/XXXX when the FPF were through with their work, I received a call from Ocwen saying my loan modification was denied. I cried for four hours straight and decided the last thing I could do, the last person on this earth that would help me was the President of the United States, XXXX Obama. I phoned the White House, the gentleman who answered asked what I needed and I burst into tears speaking with him about it. He obviously could tell I was not lying and gave me the President 's personal email address, told me to be brief and to the point and to never use that email address again. Within a few days, a woman from the Treasury Department called saying because of my letter to the White House, she had a team on their way to visit with Ocwen and XXXX XXXX on why almost 2 years had gone by without a modification. Cross my heart, within a month I was modified and now had a mortgage of {$700.00}. Anyone care to criticize the President? Call him names and disrespect him? He saved my life and from the bottom of my heart, I thank him and wish him all XXXX grace on him and his family. Our most Honorable President we have had in years.

Consumer Complaint: I was advised to contact you because I feel my mortgage company is not treating me fairly. I am paying a XXXX XXXX dollars a month for PMI insurance, and it seems to be very difficult for anyone to help me to get out of paying the PMI. They wo n't speak to me they wo n't give me a contact number, they 're making me put my request in writing which I 've done a couple times now. They are telling me that there 's no way I can get rid of my PMI insurance by using fair market value of my home and then I have to do a major home improvement in order to get rid of my PMI insurance. I am certain that I have enough equity in my house to have the PMI insurance waved however they will not help me get out of that insist that the only way I can is if I invest money into my home as in A major home improvement. I was advised by someone from another financial institution that this does n't seem right I feel I am being trade unfairly, and that maybe you can assist me

Consumer Complaint: Ocwen held our insurance proceeds checks from an XXXX 2015 hail storm which caused damage our home. We have submitted all checks and the requested documentation, other than the certificate of completion, to Ocwen 's Insurance Loss Department. We have also received an inspection - from their inspector - indicating that the repairs are 90 % complete. Ocwen continuously indicates that they are also missing an acknowledgement form ; but, they agree that the fax number and loan number we are using in our multiple faxes containing the 'missing ' acknowledgement form are correct. They refuse to give an email or other method for delivery. They also returned XXXX of the small insurance checks to us, with a letter indicating they had endorsed them - but, they had not. We are now incurring the yet another overnight delivery cost to send the checks back, in the hopes that they will endorse them and return them to me in a timely manner, so that I can make payments for some of the minor repairs. They refuse, however, to return our {$20000.00} check, even though their policy is to release the funds at XXXX % completion. Which, as referenced above, has been verified by THEIR inspector. On our most recent call, they have asked us to now sign a certificate of completion, certifying that all repairs have been made and the property has been restored to the condition existing prior to the damage. I explained to them that per their inspector, the repairs are only XXXX % complete. They refuse, however, to release the funds without the certification. At this point, our contractor has been without payment for the roof and gutters for several months and each time I call, Ocwen tells me there is nothing they can do, other than submit the forms, wait another XXXX business hours for their system to update, and call back.

Consumer Complaint: In XXXX, XXXX we filed for Chapter XXXX Bankruptcy and at the time of the intial filing, we reaffirmed our mortgage with GMAC. The Discharge was entered on XXXX/XXXX/XXXX. We never missed a payment and never made a payment late. In XXXX XXXX, due to GMAC 's bankruptcy filing our mortgage was turned over to OCWEN and so began the nightmare. It 's been one thing after another with this company - I do n't understand how they are still permitted to do business! During a routine credit report check, I found that OCWEN is reporting our mortgage as " Closed - Derogatory '' and in remarks it states " Chapter XXXX Bankruptcy ''. In XXXX of this year, I called them and was told I 'd have to provide supporting documentation to my claim that they were no longer allowed, under the laws of the FCRA to report such things. I did so via certified mail on XXXX XXXX, XXXX. I awaited a correction to my credit report, which was never made. I contacted OCWEN again on XXXX XXXX, XXXX and was told that they were sorry for the error, they did, in fact, have supporting docs on hand and this reporting was an error on their part that they would get corrected. I just received notification from them that states they will notify the credit reporting agencies to change the remark to show the loan was discharged through bankruptcy ... what????? TWELVE YEARS after the discharge ( and REAFFIRMATION OF MORTGAGE ) the only thing they should be permitted to report is the fact that our loan has been paid on time, never late!! There should be absolutely nothing in my credit reports about a bankruptcy - is n't that correct???? We have paid and paid and paid for our financial crisis, OCWEN should not be permitted to continue this type of reporting practice! I have spent hours on the phone and writing letters to these people and I feel like I am just beating my head against a wall. I have no doubt in my mind that we are not the only ones fighting this type of a battle with OCWEN. I do n't know where else to turn. We do n't have the money to hire an attorney and should n't have to. Please help!!!

Consumer Complaint: On XXXX XXXX, 2015 I wired a mortgage payoff to Ocwen Loan Servicing as part of disbursing a refinance loan I closed. I own a title company and disbursing loans is a major part of my job. The payoff letter states that " ... upon our receipt of the entire payoff amount, Ocwen will execute a release and discharge of the Deed of Trust/Mortgage .... ''. The payoff was wired to Ocwen on XXXX XXXX, 2015, and as of today, XXXX XXXX, 2015 the mortgage remains open of record. I called Ocwen to try to resolve this issue and they told me that they will not speak to me about this matter, only the owner of the property will be spoken to. I am not in the habit of bothering clients to chase down their cancelled mortgage documents and I believe Ocwen is acting unreasonably in this matter. As part of my normal course of work I had to issue a title policy to the new lender at the time of the refinance, giving them XXXX lien position. I did not hesitate to issue the policy because I knew that I had paid the mortgage in full, recorded the new mortgage and the other tasks necessary to fund a loan. I now find myself not knowing what to do since Ocwen is refusing to help me. I am the person that ordered the payoff letter, so I must be an authorized party to speak with them. It is imperative that Ocwen cancel this mortgage of record.

Consumer Complaint: Ocwen lost an {$1800.00} payment that was sent in XXXX then charged late fees and returned the check once they found it 3 months later. They continue to deny that they lost it stating they received the funds in XXXX when we clearly sent it in XXXX. They refuse to look at the envelope with the post mark date. This is not the first time a payment has been lost by Ocwen. Last XXXX they lost a {$700.00} check for 2 months. I have now sent a certified payment of over {$3000.00} overnight with signature confirmation and it still has not been applied to the loan. It was received by Ocwen on XXXX/XXXX/15 at XXXX. It is now XXXX/XXXX/15. This is extremely poor business practice and I want them reported for losing my payments multiple times. Someone has to be governing their accounting department and I want them notified. The late fees are illegitimate and I also want those removed. If nothing comes from this complaint, I will contact the attorney general.
