Consumer Complaint: I 'm currently dealing with a situation the mortgage lender, Ocwen. I received a statement dated XXXX XXXX, XXXX from Ocwen whereby there was a fee of {$300.00} charged for what the company says was for a valuation of the property. My son, intervened on my behalf to inquire why was the charge there, and when, if any valuation was done, what was the date? In addition, my son, who I granted authorization to work on my behalf with Ocwen, questioned the company about the valuation, ie. what company performed it and was there a report written, he was told that the information was not available and they could not tell him the actual date of the valuation. Furthermore, on the date XXXX XXXX ) in question when a valuation was supposedly done, I was at my residence and did not notice anyone performing such valuation. The entire conversation with Ocwen, when my son was on the phone with them was vague and not much information was shared. In addition, a request was made to speak to a supervisor to which the response was, " none were available at this time. '' My son asked was there another office that he could contact so that he could get to the bottom of the {$300.00} fee, and again, he was told " no. '' I do not believe this fee is legitimate nor fair since no one from Ocwen can tell me when and why the valuation was done on my property. In addition to the {$300.00} fee, there have been other fees that Ocwen has been charging me in the form of inspections at {$25.00} per, however, I do not have those older statements.

Consumer Complaint: I was unemployed so I contacted Ocwen about an unemployment forbearance. I paid every one of my forbearance payments every month. After the forbearance period ended, Ocwen declared that I was 5 months behind on my regular payment amount, placing me in an impossible position and attempting to force me into foreclosure. They are demanding many thousands of dollars at once in order to " reinstate '' my account, which I had been paying my payments on every month until then.

Consumer Complaint: I have XXXX loans with Ocwen ( mortgage and Equity ) It was clear to me about escrow going in mortgage but, after discovering from my Equity loan billing statement that part of my payment was also going in escrow. I immediately called and asked why. I then requested information on how long the company was charging my escrow account. Ocwens then stop all billing statements. Consumer Complaint: I am XXXX XXXX. My husband, XXXX XXXX, died XXXX. He had taken out a mortgage with Ocwen Loan Servicing. The note is insured & should have been paid off upon his death. Ocwen refuse to pay off the loan & requires that I continue to pay it or they will foreclose. They said the insurance is for their protection. I have to pay this mortgage although I did not sign or authorize the mortgage. Ocwen was notified of the death of the borrower ( XXXX XXXX ), and a death certificate sent to them, yet they refuse to use the insurance to pay off the mortgage. Ocwen, consistently states that they can not communicate with me because I am not authorized on the loan ; yet, they continue to require monthly payments, or they will foreclose on the property. Ocwen should return all of the money that I have paid after the death of XXXX XXXX, for the past 2 1/2 years ; with interest. Ocwen is being paid double. Ocwen states that I I am not authorized on this loan, yet they continue to send & request payments each month & will not/have not used the mortgage insurance to pay off XXXX XXXX 's loan. This is not a good practice and it 's causing me great financial hardship and stress.

Consumer Complaint: We applied for and received a XXXX loan modification last year in XXXX 2015. Ocwen Loan Service was the loan servicer, it was a truly difficult process. We owed about XXXX at 6.5 % payment about {$2900.00}. We were approved, 4 years at 2 %, then 1 year at 3 %, then 1 year at 4 %. Our payment now is about {$2300.00}. In XXXX 2015 the loan was transfer/ sold to XXXX XXXX and I received a notification that we were short on our escrow of {$3000.00}. As I dug into the paperwork, I saw a {$2900.00} payment out of the escrow and it looks like it went back to Ocwen in late XXXX. I wrote both companies and complained about the issue and they responded that everything was right. But everything is not right. I just sat down to do our taxes and it was reported that we paid Ocwen around {$3000.00} in interest and paid XXXX about {$3000.00} in interest. total about {$6000.00} We usually pay about {$16000.00} in interest a year. I glanced at the statement last night and it looks like the credited themselves about {$9000.00} XXXX XXXX different {$1500.00} payments ) from interest payments back to Ocwen in XXXX 2015 XXXX around the time of the modification ). I am currently looking for an accountant or attorney that may be familiar with XXXX rules to help look through this process and see if it was handled correctly? I believe that that the HAMP modification performed by this company has been thoroughly screwed up. I would like to know if you have heard of other people complaining or are concerned that Ocwen may have taken advantage of? I would be willing to send all the appropriate documentation if there is someone that may be willing to help me go through this issue.

Consumer Complaint: I applied for a modification due to XXXX XXXX. I was n't late but I was struggling to make payments now with XXXX additions. I called Ocwen and was told they are sorry they ca n't do anything for me because I have never been late since in 5 years. So, I became late in order to be approved. A partial reduction of balance was granted ( monthly payments remained the same and increased by a few cents ). I was placed on a payment plan, but due to incorrect online account balances, non updated & erroneous balance on Ocwen 's phone system, that paper statements and rep informing me wrong infor when I called to verify which payment do I pay, my payments were returned on several occasions. By the time the payments were sent back to my bank, it was 30 days or more. I explained countless time the money needs to be returned timely so I can use it to pay off the balance, but was always given bad run around info. I received a call from a relation manager that said I no longer have to pay the payment plan, and he has ended after paying them. So, I asked if I can get something in writing. He said he is updating the system and they do not send out anything because his word is in the system. Weeks later I received a call apologizing for the information that. Confused, I attempted to do a phone payment with him so I pulled over only to be told he can not get partial payment and that now this makes me late " But, XXXX XXXX you do have to pay it. '' In turn they reported me as being late and charge me late fees more than the {$10.00} reported on statements and Certified mails fees because they said they had to send someone out to do a property inspection to visit the place, which was not done especially because it is a double-door security keyed camera entry unit, yet they charge me over and over. Secondly they send out XXXX statements a month whenever they feel like. Monthly statements should occur every month. Double statements were sent for the month of XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, and XXXX XXXX. And, each time charging late fees. Now, I have XXXX mortgages with Ocwen. I became current and paid of account # XXXX ( 10.3750 % ) XXXX XXXX. The larger account XXXX ( 3.125 % ) had an Ocwen forced placed XXXX policy. I purchased my own and it took a great deal of work just to get them to update that and remove their forced placed. Whenever I call to ask for an updated balance for XXXX they are unable to provide the new numbers with an updated balance and tell me to call back. I do. Same thing. Next thing I know I 'm getting foreclosure notices and more fees. I 've depleted my savings out of fear of losing my place. The forced policy was an additional and additional {$100.00} a month. Why are so many statements going on. On top of that on XXXX/XXXX/XXXX XXXX XXXX Agent # XXXX said that the balance is {$1100.00}. When I log in, they reported me to the credit bueaurs for {$3200.00}. They told me if I pay anything other than what is reported the payments will be returned the same way they were received and they can not put me on a payment plan unless I pay them off in full. Ocwen takes advantage of people to the extreme.

Consumer Complaint: I am writing because my Mortgage Servicer Ocwen reported a discharged amount to he IRS in the amount of {$22000.00}. They did not suffer a loss for this amount nor was my principal balance reduced by this amount after I completed a HAMP Loan modification in XX/XX/XXXX. I called Ocwen on XXXX/XXXX/XXXX and after spending 30 minutes on the phone the representative was unable to tell me why this amount was submitted and also confirmed that this amount does not reflect in my mortgage history. This is a huge error on their end and I can not file my federal income tax until it is resolved, otherwise the IRS will be looking to tax me on this amount as earned income which it obviously is not. I understand that during the course of the next 5 yrs there will be deferred interest and a principal reduction, however a loss can not be written off in advance prior to it happening. So Ocwen needs to either reduce my principal balance by {$22000.00} OR amend the XXXX and provide detailed information that reflects any loss they are reporting.

I have listed the acts that pertain to my situation and the rules that were violated. They also failed to follow the guidelines of XXXX XXXX. The following is taken from XXXX XXXX website A Servicer is expected to comply with all applicable federal, state and local laws, regulations and orders. ... borrower privacy, ... fair debt collection practices ... Taken from the " Fair Debt Collection Practices Act ' 804. Acquisition of location information [ 15 USC 1692b ] Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall -- ( 3 ) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information ; ( Communicated with XXXX a 3rd party more than once ( XXXX XXXX of XXXX XXXX wrote, " spoke with woman, said we 've been here before looking for defendant.. '' ) listed her name address, and my personal relationship information on a " foreclosure '' which is a public record that anyone can view. See Exhibit E. Consumer Complaint: When with GMAC as our mortgage provider, we were contacted by XXXX XXXX ( affiliated with OCWEN ) to refinance our loan at a lower rate. When the loan information was presented to us, Freedom/OCWEN neglected to include our school taxes ( currently school taxes make up XXXX of our XXXX ). OCWEN has now come back, 1 year later, indicating that their Escrow projections were off and that we owe over {$5000.00} in taxes. Upon review, OCWEN admitted that the school taxes were mistakenly not included in the loan refinance documentation. The majority of the monthly reduction in the cost of the new loan was based on XXXX/OCWEN NOT including the school taxes as a part of Escrow, and this reduction was what they used to push us to move forward with the refinance. They have admitted the mistake. But thus far, we have not been compensated for their deceit.
