Consumer Complaint: Ocwen mortgage company is denying me a loan modification based on their claim that I do n't live at my home at XXXX XXXX XXXX XXXX XXXX. Massachusetts. On XXXX XXXX, Ocwen received XXXX utility bills, a bank statement and a credit card statement with the correct address on those items as proof, yet I 've received nothing for over a month from them about this! I want to know why they are ( allowed ) to deny my request to modify my loan citing that I do n't live at my home as their reason to deny my loan! I live here at XXXX XXXX XXXX and this denial has been going on for over a year and a half now. I am looking have the foreclosure sale date of XXXX XXXX, extended to XXXX or XXXX XXXX.

Consumer Complaint: OCWEN has engaged in fraud as it relates to my mortgage loan and fail to follow statutory guidelines pursuant to FHA loans that require a face to face meeting for loan modifications.. They have delayed modifying my loan three years even though I sent all required documents to them three separate times. OCWEN intentionally delayed so that they can foreclose on my loan. I am now in foreclosure and afraid that I will lose my home for sixteen years. This is utterly unfair and should be crime to allow them to treat minorities this way. I believe they target the minority community and defraud them and violate their rights.

Consumer Complaint: I have been approved for a HAMP tier 2 permanent modification of my loan with OCWEN. I have made all three trial payments, have sent in paperwork and they have yet to update my information or send me a copy of the loan documents and my account states that I owe another ( 4th ) trial payment, which is erroneous based on the hamp trial payment terms. I have to wait days, sometimes weeks to speak with my " relationship manager ''. I want resolution. I want answers. I want them to get their act together and behave responsibly when dealing with the financial fate of others. They are capricious and erroneous. This is my second complaint with CFPB regarding Ocwen.

Consumer Complaint: Ocwen is holding my shortsale hostage. deactivated and replaced payoff quote with same dates and {$3000.00} in extra fees days before closing. Approved for sale with first lender ( Ocwen ), and shortsale with equity line holder ( XXXX ) since XXXX, I got a payoff quote from Ocwen and am set to close this Friday XXXX. Today Ocwen deactivated the valid payoff quote and replaced it with another payoff quote adding {$3000.00} in extra fees, knowing that I will have to go to foreclosure if I can not get to closing before they bill me for another cycle of fees. Reading up on this practice, I discovered that Ocwen recently lost preditory lending suits, but is still abusing debtors in distress, and then suing them after they close for more money. Ocwen refers me to the Law Firm XXXX to make requests for fee reduction, and XXXX refers me back to Ocwen - a cycle completed 3 times in less than a week. Closing in on Friday. I need help. Consumer Complaint: Ocwen, initially approved a short sale for {$280000.00} if I 'm handling for a probate listing. We were waiting for the court appointed appraisal to come back which took some time, and it was {$280000.00} as well. In the meantime the buyer backed out and we got a replacement buyer for the same dollar amount and I was told it was a trustee sale at the end of the month no one told they wo n't postpone the trustee sale to even consider the offer because it needs to be 100 % of the market value in order to stop the trustee sale. Wish I have an initial short sale approval for {$280000.00}. The other issue is this is dual tracking which is illegal in California. Attached you will find the short sale approval that was initially given to us for XXXX along with our offer that is consistent with their approval.

Consumer Complaint: During a very slow and painful loan modification XX/XX/2015 our mortgage company, Ocwen, stopped paying our mortgage insurance from our escrow account. We were assured that once the modification went through, payments would begin again and bring the insurance premium current. Our modification was completed and I assumed payment had resumed as each mortgage statement included the amount for the premium. My husband passed away on XXXX XXXX, 2015. I called the insurance company to make a claim and was told that no payment would be made because the account was severely in lapse ( only brought current through XXXX 2015 ). Ocwen was made aware of the problem and I was told that yes, they had not made payments on certain dates, causing the policy to lapse. Nothing further was done. I called again on XXXX XXXX to make a formal complaint and was told they would look into it. Each week since that time they call to inform me that they have n't forgotten about me, but nothing new has been discovered. I understand that some research must be done, but my husband has been gone for 4 months now and I have continued to pay my mortgage on time ( plus additional towards principle ), as I have done each month in the past. I would very much like for this issue to be resolved quickly ( or as quickly as possible ) and I feel that Ocwen is dragging their feet in the hopes that I will give up and forget this issue. It seems that this is a common practice for Ocwen as we have experienced this behavior in previous dealings, which once included another formal complaint being made on our behalf by our Congressman 's office.

Consumer Complaint: I have a property in the State of North Carolina that Ocwen is attempting to foreclose on, but NC General Statute requires that the FDCPA debt letter be mailed WITHIN 30 days of the date of the original notice of foreclosure. The date of the original date of foreclosure was XXXX XXXX, 2011. I recently filed a complaint with this office stating that the appointed trustee never mailed the letter, but counsel for Ocwen responded by sharing a letter dated XXXX XXXX, 2011. This letter was not within 30 days of the date of notice and therefore, I was never provided FDCPA letter within 30 days of the notice of foreclosure as required by NCGS 45-21-16 ( c ) ( 5a ). The dates are clear and as stated Ocwen and its predecessors did not follow the law and provide the required 30 day FDCPA letter in accordance to law. Owen 's XXXX XXXX, 2011 was pre-mature, outside the 30 days and contained foreclosure fees that were not yet due. Ocwen must give us the opportunity that it gives everyone else when the full foreclosure process is not followed in accordance to law.

One of the accounts that was discharged was for a mortgage with Ocwen Loan Services ; we recently received communication from XXXX that they had purchased the loan and that we owed them for the house. We disputed this, stating that it had been discharged via bankruptcy, they sent us a copy of the original loan with our signatures on the promissory note and stated that this was proof we owed the loan. The account was discharged, that was confirmed by both Ocwen and another agent that had purchased the account, XXXX XXXX XXXX.

Consumer Complaint: Breach of Contract 1. I was approved for a HAMP Tier 1 Home Loan Modification back in XXXX XXXX, I followed all instructions as given to me. I signed and returned via fax the modification agreement that was supposed to be finalized. Ocwen did not fulfill their obligation under this agreement and I was rejected from the program due to no fault of my own. 2. Ocwen alleges that they sent notification to me via certified mail but I did not receive the correspondence. The letter was notification that they needed proof that my home address was in fact my primary residence. 3. I received a copy of this letter from Ocwen only in response to my initial " letter of complaint '' to the Georgia Office of the Attorney General 's office back in XXXX XXXX. The letter did have a United States Postal Service tracking number as reference of their attempt to deliver said notice. 4. I tried to use the tracking number to see what results I would get and due to the lapse in time my results were limited. I contacted my local Post Office that would have made the attempt to deliver this notice and discovered some shocking results. 5. Ocwen sent the letter from themselves to themselves therefore never being delivered to me. I have enclosed a copy of the letter as well as the tracking results I received from my local post office. This action by Ocwen is what has caused me to be rejected from the HAMP Tier 1 Home Loan Modification Program not any actions by me. Now Ocwen is once again attempting to foreclose on my property and the sale date is scheduled for XXXX XXXX, XXXX.
