Consumer Complaint: My XXXX Mortgage changed from an Interest Only Loan to 10 year fixed loan. My loan amount is {$35000.00} the changed from 4 % to 4.25 % ( when I ask for an explanation I ca n't get one ). My complaint is they have calculated my payment incorrectly. My payment should be {$350.00}. The first statement I received had my payment at {$400.00} with the conversion to a fixed rate loan when I questioned the payment I was told it was changed to 4.25 %. This would make my payment {$350.00} not {$400.00}. The last statement I received has my interest rate at 4.25 % with a payment of {$410.00}. I have had XXXX conversations about this with the lender who keeps saying they will get back with me.

Consumer Complaint: Ocwen Loan Servicing received my loan in XXXX XXXX XXXX XXXX Ocwen representatives told me not to make a payment or it will be returned because I was in default. This was impossible because my mortgage was paid up to date and I had to track the location of my mortgage. It was transferred from Homeward to XXXX to Ocwen. After many attempts to correct this and attempts at refinancing to keep my house in play, I eventually I acquired an email in XXXX from Ocwen 's ombudsman stating that I was not in default XXXX XXXX but they could find no recording of their representatives stating their instructions to not pay. However, I have made recordings. My mortgage has not been accepted since then and now Ocwen has attempted to foreclose on my property several times by adding inspection fees, late fees and reporting to the credit bureaus. The fees have added up and the stress is debilitating. When I wrote a letter to Ocwen through Ocwen lawyers threatening to report Ocwen with the recordings to additional authorities and law enforcement authorities. Ocwen had a lawyer contact me to settle with me but the aspects of the proposed settlement benefit Ocwen only. They acted as if they had done no damage to me nor to my account. Ocwen must be stopped and made to remedy their thievery. I will pose again to our State and Federal agencies, that Ocwen be investigated as an internal XXXX XXXX threat.

Consumer Complaint: Why is Ocwen sending me statements for a mortgage paid in full and Why have n't they released the lien in my house? They need to collect the {$260000.00} and {$60000.00} from first XXXX and {$35000.00} from XXXX paid twice and arrow and ozark financial who had NO security interest in any property I EVER owned and any funds paid to XXXX after XXXX. ANY funds paid to XXXX XXXX that were not directly paid to the amount shown on the statements I received from them. REFUND WITH INTEREST ALL payments to XXXX XXXX or any payments made to my duplex at XXXX XXXX including escrow payments that are NOT included in the loan on my HOUSE. OR ANY Duplicate payments EVER made. By anyone to my property.and including any payments made to properties I DONT own. I had a {$260000.00} loan to which I paid {$360000.00} and {$510000.00} to the loan I paid off. I paid all of the principal balances back to all of the prepaid credit and interest ito the amounts added to my mortgages. I did n't owe interest on any escrow added back to my loan. The field adjustments added to the modification on my house were already paid to XXXX XXXX XXXX, XXXX XXXX and midland. I do n't want to borrow HAMP incentives and I want the payments I made to XXXX applied to the 2004 payoff and {$23000.00} I did n't owe XXXX and credit for the payments made to XXXX XXXX for the {$32000.00} field adjustments plus the {$9400.00} escrow and any other part of the {$41000.00} payoff on my duplex. I want credit for all of the {$49000.00} and {$18000.00} paid to XXXX and {$5700.00} + {$33000.00} paid to XXXX and {$24000.00} + {$15000.00} paid to XXXX I WANT CREDIT FOR ALL OF THE {$840000.00} cash payments I made to XXXX properties serviced by Ocwen ( for the final servicers of loans with ; XXXX XXXX and XXXX XXXX ). And the funds from the foreclosure of my duplex with any escrow used or paid from or by any of these servicers.

Consumer Complaint: I still do n't understand what is going on with the payments I made to XXXX XXXX on my duplex at XXXX XXXX. The IRS form XXXX XXXX showed a balance of {$53000.00} and a market value of {$62000.00} when they foreclosed. I believe they were servicing a XXXX mortgage to which I had paid {$130000.00}. They sold my property for the XXXX remaining payments and their attorneys stated the value at the tax value of {$78000.00}. ( XXXX XXXX thought it was worth {$150000.00} ). The loan was current in XXXX when the returned 3 of my payments ( the last payment was accepted in XXXX and applied as the XXXX payment. We were offered at loan modification with a payment nearly double of the original amount. Our request for a modification extending the remaining months was denied 22 hours prior to the foreclosure. The application amount and three additional payments were also returned. The taxes and insurance were paid to date with {$600.00} insurance refunded to them. I HAD A CREDIT BALANCE. With the sale I paid {$190000.00} to this property. Furthermore the note required payments of {$360.00}. Through the foreclosure date I paid to XXXX XXXX {$62000.00}. {$32000.00} taxes and insurance paid over the life of the loan was added to the loan modification on my HOUSE. I want to know WHY! This amount also happens to be the exact amount of the XXXX payoff less the beginning escrow balance on XXXX properties. I made separate payments on the other property to XXXX. XXXX only acknowledges payments of {$15000.00} when in fact I paid them over {$130000.00} Between the XXXX properties on which XXXX XXXX was paying taxes and insurance I paid {$260000.00}. PLUS {$62000.00} sale AND the buyers XXXX mortgage of {$91000.00} was paid off at the same time XXXX XXXX XXXX released XXXX mortgage XXXX of which was released TWO times. In fact of XXXX mortgages released in XXXX XXXX XXXX were released for the second time. And at which time we had paid {$92.00} to the loan modification - on our house Apparently we paid {$220000.00} and a duplex for what would be 30 years of taxes and insurance on these XXXX properties. {$220000.00} + XXXX {$35000.00} XXXX release and {$14000.00} I paid to XXXX + {$15000.00} they say I paid and {$130000.00} I REALLY paid comes to {$360000.00}. with miscellaneous adjustments for payments to shortages it comes to {$350000.00}. XXXX XXXX {$360.00} x 92 payments at foreclosure is {$33000.00}. I paid {$62000.00} ( not counting {$69000.00} previously paid ). Means {$29000.00} was paid to the escrow account {$12000.00} disbursed. With the {$61000.00} sale + {$16000.00} escrow - {$53000.00} balance WHERE IS THE OTHER {$23000.00}? Foreclosure {$61000.00} pays off XXXX.+ {$30000.00}. + {$30000.00} to XXXX {$5700.00} to XXXX {$66000.00} + XXXX. + {$5400.00} ( paid to escrow in first trial ) WHAT IS GOING ON? {$130000.00} to duplex {$140000.00} to VA {$510000.00} to house ( {$840000.00} my estimate of total payments ) + duplex value and lost income I do n't owe {$270000.00} statement balance. They owe me more. {$560000.00} from XXXX I believe they OWE me {$280000.00} They should pay the {$150000.00} extra I paid for the duplex They should refund at least {$30000.00} to the VA loan I did n't add or refinance. I PAID IT OFF! reinstate {$120000.00} prepaid credit. Extinguish {$230000.00} escrow I do n't owe. Release lien. Release the lien on my house. I deserve more.

Consumer Complaint: Since XXXX, we have been asking American Home Mortgage Servicing , Inc, now known as Homeward Residential ( servicer prior to Ocwen ), to provide evidence that XXXX XXXX Bank, XXXX as trustee for Option One Mortgage Loan Trust XXXX was the owner of the note. Each time they sent us a copy of the note, it never included an allonge. But in XXXX, AHMSI presented an allonge that was blank and a later allonge that was stamped. Once Ocwen became our servicer, we asked Ocwen to validate the debt. In a response from Ocwen, Ocwen states that they " would not be able to provide us with the original wet ink signature loan documents '', but an attorney for Ocwen claims to have the original wet ink signature loan documents.

Consumer Complaint: XXXX/XXXX/XXXX - Contacted my mortgage company for information on how to apply for a XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Was informed that the process can be applied for on-line and would take approximately 30 days. XXXX/XXXX/XXXX - Applied for XXXX on-line. To sum up what was told should take approximately 30 days took almost 2 years. - In excess of more than 40 telephone calls regarding status of my HAMP application - Having to submit documents more than 6 times - Receiving XXXX different " Forbearance Agreements ''. I sent my 1st payment for a Forbearance Agreement. It was returned. I was told that the check that I sent needed to be a " Cashier 's or Bank Issued Check ''. Nowhere in the " Forbearance Agreement '' did it mentioned this. Reissued a Cashier 's Check and that was also returned because they indicated that the Forbearance expired. - I had to hire an attorney to resolve the foreclosure issue and have the foreclosure case dismissed. - This entire XXXX process which was to take approximately 30 days that began on XXXX/XXXX/XXXX was FINALLY modified on XXXX/XXXX/XXXX per their letter dated XXXX/XXXX/XXXX. Almost a 2 year painstaking process. I have all Exhibits XXXX available for review and can be sent via mail or overnight. My notes are very detailed.

Consumer Complaint: Ocwen took over my XXXX mortgage from GMAC ( for reasons unknown to me ). When they did, my payments went from {$160.00} to {$940.00}. When I tried to get information on why this happened, Ocwen refused to explain and told me to " pay my bill ''. I have been struggling with communication with this company. I know that according the the California Homeowner 's Bill of Rights I have the right to a single point of contact that has decision-making authority of my account. Although they have technically appointed me a " relationship manager '', this person is never available when I call. I get transferred to another " relationship manager '' who does not have the ability to make decisions on my account. Furthermore, whenever I submit all the paperwork necessary for a loan modification, they either 1 ) lose my paperwork ( the first time I faxed it and they claimed to have never received it ) or 2 ) Claim to be missing paperwork ( even though I have proof that I emailed it ). I have paid this company XXXX % of what I owe in a lump sum and they are still claiming that they are going to foreclose on my house in a week ( even though I am current on my first mortgage with another company ). They have not sent me an updated statement even though the loan has been reinstated. Instead, I received a letter that says they simply postponed the foreclosure. They also claim that their hours are " Mon-Fri XXXX-XXXX, Sat XXXX-XXXX, Sun XXXX-XXXX ET ''. However, when I have called on the weekends AFTER making a payment of over {$28000.00}, their offices are closed. I can no longer reach them during their weekend hours.

Consumer Complaint: I am filing for a loan modification through the program harp set by the government because i am behind my mortgage payment with Ocwen mortgage servicing, llc, and the relationship manager for my case have encouraged me to do so since the principal amount and interest have been accumulated to {$21000.00} u.s and the bank will not consider a deffered mortgage payment. However, i need help to obtain the modification with OCWEN mortgage, because all papers ' work has been filed and sent to the bank three months ago. But the bank consumer department issued a relationship manager to help with each case.However, this relationship manager by the name XXXX XXXX working for the bank has developed a tactic to prolong the papers'work by extending the scheduled appointment each time for next month under the pretext that my papers works or documents are not completed so that the principal amount for the mortgage will be accumulated every month and the interest accrued before sending my application for loan modification to proper authority or government agency for practical review. I inquire and suggest a torough investigation to be conducted by the consumer finance department about my loan modification application for my property and the time consuming to obtain my approval and all the papers works which were provided to them along with my application. .
