Consumer Complaint: Ocwen has serviced my mortgage for years. My mortgage fell behind and {$5100.00} was owed. I was contacted by Ocwen Financial offering a modification. I was told to pay {$9300.00} no later than XXXX/XXXX/16 then mortgage will be current. The {$9300.00} was paid to Ocwen, via wire transfer, on that date. The funds were returned w/out notice. I called & was told : First, amt was {$300.00} short, then, I 'm not eligible for modification. I told them they offered it to me, then they said : " Ok now pay {$12000.00} by XXXX/XXXX/16 & you 'll be current & your next regular payment will be due XXXX/XXXX/16 ''. Why was n't it made current w/the original payment? All that is owed is {$6400.00} - why do they want {$12000.00}? I ask for agreement in writing, never get it. Amt owed keeps increasing w/no explanation. Filed a written complaint on Ocwen site - no response. All calls are routed to an XXXX call center - never able to speak w/someone that can help. Funds are available in a separate acct. I need help w/this.

Consumer Complaint: We were approved for a Home Affordable Loan Modification trial period plan by Ocwen on or around XXXX XXXX, XXXX. The details of the loan are as follows : * 3 monthly trial payments of {$3200.00} due on XXXX/XXXX/XXXX, XXXX/XXXX/XXXX and XXXX/XXXX/XXXX * Payment for Escrow, ( where permitted by law ), including real estate taxes, insurance premiums and other fees, if any, of {$1400.00}. * 2 % for life of the loan * Balloon payment due of {$380000.00} - XXXX * New Unpaid Principal balance is {$580000.00} We were told by our relationship manager, XXXX XXXX, who is part of Ocwen 's litigation department, that our loan would have to be escrowed as part of the HAMP Trial Payment Plan. Our original mortgage was not escrowed and we have remained current on our property taxes and home owner 's insurance since XXXX till current. According to the documents provided by Ocwen, part of the trial payment is to be for taxes and insurance. I received a mortgage account statement from Ocwen that states {$0.00} of the trial payment was applied to taxes and insurance. Per the mortgage account statement {$390.00} was applied to the Principal, {$2700.00} for Interest and {$24.00} applied to " Unapplied Funds ''. Our original mortgage payment to Ocwen was {$3100.00}. Seems our 1st trial payment was applied based on our original loan payment of {$3100.00} and not on the trial payment plan of {$3200.00}, in which {$1400.00} was to be applied for Escrow ( Tax & Insurance ). As you can see from the mortgage account statement, {$0.00} was applied to Escrow ( Taxes & Insurance ). Also, Ocwen received our first payment of {$3200.00} on XXXX XXXX, XXXX, but I received a mortgage account statement yesterday with a statement date of XXXX XXXX, XXXX in the mail that states payment is " due now ''

Consumer Complaint: XXXX Ocwen confiscated our XXXX Insurance check paid to us for damages incurred on our property. As homeowners, our mortgage is with XXXX which includes escrow account. XXXX XXXX made all checks payable us and XXXX, that make payments through our escrow account. When we initially send checks to Ocwen to endorse, they send it back insisting the new policy and IRS requirements is for all homeowners to endorse insurance check to the company to deposit into homeowners mortgage accounts for tax purposes. Unknowingly, we affixed our signatures and mailed the checks to them. After inquiring about the information given by Ocwen was not the facts, but them pulling mortgage fraud. We proceeded to inquired about everything. They proceeded to give us the run for XXXX and half month. The contractor pulled from our repairs due to nonpayment because Ocwen. We called Ocwen several times just be given the run around. Last when I called treating to report their action to law and newspapers about our lost, we received a call from them Ocwen, stating they mail checks to us yesterday with USPS, giving tracking number. Today I called Ocwen account information to check on our account, the automated system, acknowledged payments from us for total amount of our insurance claimed checks and also Informed us when our next monthly payments is due. This has prompted us to bring this matter to your attention. We are kindly requesting a complete investigation on our behalf in this important matters. Consumer Complaint: OCWEN has repeatedly misallocated payments on Principal to other lines such as interest, escrow, taxes, mortgage insurance. This practice has happened as much as bimonthly since their acquired my mortgage. I mark all my payments to their designated line in the account. However ; t this practice of money mismanagement is always to OCWEN 's advantage by delaying my progress on my amortization schedule and thereby suppressing suppressing my progress on reducing the interest ratio on my loan. This hap happens so regularly that I am sure it is " ripping-off, '' a large number of their customers, making it a systemic business practice.

Consumer Complaint: I am in danger of losing my house at foreclosure sale because my lender Ocwen has been switching us from one department to another, losing my paperwork and misleading me. I am behind on my mortgage, but our situation has stabilized and we now clearly make enough money to afford a fair mortgage payment. I was told by the Ocwen agents (when I could understand their XXXX) that I clearly qualified for modification help. But after nearly 3 years of trying to get reviewed and mailing in full packages to them on multiple occasions I am now facing a XX/XX/XXXX sale date. This property has been in my family for XXXX years, and I can not let it be foreclosed on!! I refinanced several years ago and found out later that this adjustable rate loan that was sold as the best deal has a rate and payment that goes up constantly. My interest rate is currently at 6.625% and will soon be at 7.25%. I worked as a XXXX for over 25 years but began XXXX and was soon on a fixed income. The problem was that my mortgage payment was going up as well as the cost of living etc. I began struggling with the monthly mortgage payment and contacted Ocwen and was told that I could apply for help I just needed to fill out some paperwork and send in my financial information. After the documents were received I was told by the agents at Ocwen that I definitely qualified for help, with my fixed income and my wife's employment with the XXXX we fit into guidelines. However, we then went through two plus years of back and forth with Ocwen. We were never able to speak to the same person twice; there was not a single point of contact, and when we did get someone on the phone we usually could not understand them because they were working at a call center overseas. A few months ago we were told that we were being denied for any type of help and that we needed to sell or move out of our house. I am not shocked that this has occurred, because I have read that Ocwen has a history of misleading and lying to homeowners in foreclosure and in fact they were fined XXXX by the US government for these actions. I am here to tell you that this is still a problem. I want to save my home. I have researched the guidelines for the government modification programs and I am sure that we qualify, the problem is that Ocwen has not conducted an accurate or timely review (if they ever conducted a review at all) of our current financial circumstances.

Consumer Complaint: I paid off my mortgage loan with Ocwen Loan Servicing , LLC on XXXX XXXX, XXXX ; however, I have not yet received the lien release document. I first contacted Ocwen regarding the lien release document in XXXX XXXX. I was told it could take up to 6 months, depending on the county and state of record. I waited and made several calls during XXXX, receiving the same standard " it takes time. '' On XXXX XXXX, XXXX, I insisted that my call be escalated to a supervisor. I was told that according to notes on my account that my file had been forwarded to the legal department on XXXX XXXX, XXXX. On XXXX XXXX, XXXX, I was notified by XXXX ( XXXX ) that my case had been turned over to the Lien Release Department. Someone in Lien Release needed to work with XXXX XXXX, the company from which Ocwen purchased my mortgage loan. On XXXX XXXX, XXXX, I contacted Lien Release, requesting an update. On XXXX XXXX, XXXX, I was told that my file had been transferred to legal and it might be several months before the issue was resolved. I reminded the lien release rep that my file had already supposedly been forwarded to legal and that I had paid my loan off 21 months prior. I was not given any contact information for the legal department. As of XXXX XXXX, XXXX, I have received no update from legal or anyone else at Ocwen.

Consumer Complaint: Ocwen is our servicer for our loan. I fell behind a couple of months XX/XX/XXXX. I stayed in constant communication with them to try to modify or get caught up with my payments. They gave me a different amount to pay every time I spoke with someone and they even game my cousin who is an attorney a different amount than me within 10 minutes of calling them. Then XX/XX/XXXX, they called me and told me that I was approved for the modification. I agreed to send them 3 months of payments to show good faith. I even sent the payments via fed es on XX/XX/XXXX. That very same day, they claim that they served me with a summons to foreclose. I do not recall at all receiving that bc I would have been really taken a back considering I just sent them 3 months of payments per our agreement. Now, they are trying to push a sheriffs sake on the property all the while their customer service e dude is lying to me staying my property is absulutely not in foreclosure. I 've still been trying to work with them in the modification. I e never been denied but they keep stringing me along stating that they need different Infornation. I feel completely taken advantage of, they lied abs completely misled me all the while trying to sell my property while they tell me it 's not in foreclosure. Please help. XXXX

Consumer Complaint: Great day to whomever is reading this ... .. I am sorry I have to ask to be protected by law but it seems I have no choice, can you help? I would like to request the Laws to be enforced on my " Borrowers Right to Cancel '' and the Law Regulation X. this final rule implements Dodd-Frank Act sections addressing servicers ' obligations to correct errors asserted by mortgage loan borrowers ; to provide certain information requested by such borrowers ; and to provide 1 Public Law 111-203, 124 Stat. 1376 ( XX/XX/XXXX ). protections to such borrowers in connection with force-placed insurance. The lender manages my taxes, and insurance in escrow and it shows in the lenders escrow that they paid for the regular billed insurance and then forced placed others at the same time I had insurance, so I had insurance paid by lender when the forced placed insurance fraud and the refunds were never refunded in my escrow. I have all org. copies of evidence to show that the mortgage added XXXX from XX/XX/XXXX to XX/XX/XXXX and I paid for XX/XX/XXXX insurance that the mortgage is charging me on their paper work the lender is suing me and will not show clear and understandable cost and refunds of the forced placed insurance from total breakdown of cost. Plus the evidence the lender is using was the cancellation of that contract and the lender is with holding evidence from the fax cover sheet that had the cancellation on it. The evidence is easy to get from a third party called XXXX and the info on the issue was faxed on XX/XX/XXXX and the fax cover shows the cancellation and the mod. agreement attached just as the law states. So my request is to have these laws enforced before trail. I am sorry I have to ask for this request but I you can see I had no choice. Just asking for XXXX things from the lender, show in writing that anyone can understand on dates, policy numbers, and cost, and the total paper work on how the lender got possession of the XX/XX/XXXX mod agreement meaning the fax cover sheet with withheld evidence. Consumer Complaint: XX/XX/XXXX my then husband and I ended up foreclosing on our home. Our last payments made to the mortgage lenders was XX/XX/XXXX. Once we left the property we received nothing further from any of the Mortgage lenders. Credit reports pulled XX/XX/XXXX showed ALL mortgage accounts as 'closed '. I have these reports. XX/XX/XXXX, well past the Colorado statue of limitations ( 6 years ) I was being sued by XXXX, XXXX, Assignee of XXXX XXXX XXXX XXXX , XXXX. I disputed the claims and now have a Judgement on my credit! The original loan debt was for $ XXXX. The judgement is for $ XXXX!! I have been back and forth with XXXX XXXX whom have just informed me that this is NOT their case and that it is in fact GMAC. Whom purchased the loan from XXXX XXXX back in XXXX XXXX.
