Issue: Loan servicing, payments, escrow account

Consumer Complaint: We are homeowner with a mortgage serviced by Ocwen. I am a Veteran and retired from XXXX with nearly 14 years in. My story is two-fold, 1.Making payments-Loan servicing, payments, escrow accounts 2.Problems when you are unable to pay-Loan modification, foreclosure Ocwen purchased our loan from another mortgagor. At that time they constantly said our full monthly payment was short bc of fees the previous company took and so Ocwen kept taking our monthly payment and applying it to fees instead of the principal payment and told us we only made a partial payment when we would MAKE NUMEROUS calls to someone in XXXX. This cycle continued on a monthly bases without any warning that we were being set up for a foreclosure scam with XXXX of other home owners. They also had a monthly fee for coming by the house and telling us we did not live there. The kicker here was that Ocwen would never give you their email address and then tell you that they never received the fax from you with the number Ocwen would provide. THE FOLLOWING PRACTICES WERE CONDUCTED BY OCWEN SERVICING OUR LOAN. 1.Failing to timely and accurately apply payments made by borrowers and failing to maintain accurate account statements ; 2. Charging unauthorized fees for default-related services ; 3. Proving false or misleading information to borrowers regarding loans that had been transferred from other servicers. I also went on the Ocwen website and there was a contradiction that showed payments were made in full and not late, so I printed those out. But after I tried to get a credit check to refinance the house, Ocwen then removed the payment history and changed all the information to delinquent on the website and on the credit history. This so discouraged us that when we saw what they did to my credit score and the mortgage rate we were offered we quit and were XXXX. It effected my wife XXXX and I could n't do anything to fix it. Ocwen tried to push us into foreclosure by XXXX XXXX. Took advantage of us with servicing shortcuts and unauthorized fees. Deceived us about foreclosure alternatives and improperly denied loan modifications. Engaged in illegal foreclosure practices. This lead to foreclosure talks and us fighting to keep our house by get up to date on our payment.

Consumer Complaint: I submitted a Complete short sale package/Offer for {$28000.00} on XX/XX/2016. Ocwen/servicer for the note for XXXX of XXXX sent a denial on XX/XX/2016 that stated the offer was too low. I sent an Increased offer the same day XX/XX/2016 for {$290000.00} which is closer to the BPO amount of {$330000.00}. On XX/XX/2016 Ocwen sent another denial letter stating the offer was too low and to submit a higher offer. on XX/XX/2016 i submitted an offer of {$310000.00} and then again a full price offer of {$330000.00} the same day in case they denied the higher offer and yet again on XX/XX/2016 they denied the offer due to a confirmed sale date set for XX/XX/2016. I feel that Ocwen has been purposely been delaying this short sale approval as they have been servicing this loan for well over 5 years for the purpose of continuous servicing fees to the note holder. This is unfair and should be looked into and the home owner is in complete shock as to why they would continue with a sale while we are in final stages of negotiations. This truly makes no sense?

Consumer Complaint: I was unemployed and had a hard time to pay my home loan XX/XX/XXXX and XX/XX/XXXX. Based on this fact, I requested to refinance my home with OCWEN Home Loans ( loan # XXXX ), which was refused. Then they give me the option of a quick sale ( deed in lieu ), which I agreed ; however, after several months ( XXXX ), I had no answer from OCWEN, arguing that their legal department was analyzing the case. On XX/XX/XXXX I paid OCWEN a due amount of {$7200.00}. Immediately after, they charged me {$650.00} for fees/other charges, disclosed as follows : {$390.00} trustee fee, {$220.00} title report fee, {$19.00} statutory mailings, and {$13.00} of property inspection fee. I completely disagree with all these fees, caused by their lack of resolution to a deed in lieu procedure. I suspect they intentionally lack to agreed in the deed in lieu procedure, hoping that I fail to pay and they continue to a foreclosure. Please help. Respectfully, XXXX & XXXX XXXX. Ph. # : XXXX

Consumer Complaint: For 2 months the Ocwen said they did not receive our payments. I told them we had sent them by mail, as usual. They made me beg for 1.5 hours and XXXX different people in order to get the late fee waived. Then they found our checks and cashed them without telling us. Now we have paid payments ahead for 2 months, because they found the checks. Now we need that money to pay taxes, but they have already credited it to our account. Also, the rate changed in XX/XX/XXXX but the payment coupon did not. They charged us the additional amount, but they show it on the statement as a fee, not principle and interest.

Consumer Complaint: I sent in a principal payment of XXXX in online bill pay to be at Ocwen mortgage by XXXX/XXXX/16. I checked my bank balance and mortgage balance daily to see if it posted. By XXXX/XXXX/2016 I finally called the mortgage company and was told they had not received it, they recently had changed their mailing address according to the representative and thats probably why it was missing. They told me to put a stop payment on the check from my bank and gave me the new address to send it to. I put a stop payment on the check and changed the address in my bill pay to the new address. I had the bank resend {$27000.00} on XXXX/XXXX/2016 to be received by XXXX/XXXX/2016 to Ocwen Mortgage. In the meantime I received a letter from Ocwen Mortgage with my previous check attached to it stating they were returning it because if I was paying off my Mortgage loan they needed certified funds. I immediately called Ocwen Mortgage and explained to them that it was simply a principal payment and not a payoff payment. My payoff was {$29000.00} my check was for {$27000.00}. Fast forward my new online check was to be received by XXXX/XXXX/16 and I again checked my balances daily. Finally on XXXX/XXXX/16 and still no record of my payment I contacted Ocwen Mortgage they did say that they received my payment from my bank however payoff payments were to be made by cashiers check and I again explained that it was simply a principal payment. It was then explained to me that my bank who sent the money would have to call them and fax them verification that funds were there and they had subtracted from my account. This is online bill pay I explained and I have been using this for the last 7 years with no problems!! Why now? Finally I was given to an escalation manager and I reexplained my story and I was told that they would take care of it and would call me Tuesday XXXX to let me know status. I received a phone call on XXXX and they left a message stating nothing had been done and they would call me in a day or XXXX. I called them on XXXX XXXX 2016 and again spoke to an escalation manager who was really no help. I explained to her that I would be contacting cfpb if this was not resolved. In the meantime I have been paying interest on a mortgage balance of {$29000.00} instead of {$2500.00} since XXXX/XXXX/16. I simply am trying to have my payment applied to my mortgage.

Consumer Complaint: I applied for a loan modification with Ocwen Mortgage in XXXX 2016. I am asked almost on the weekly basis to provide information I have already provided. When I submit the missing documentation, I am told my modification is in review and with the next couple of days when I call I am told that either the same or different forms are missing to the point that my application expired and I have had to resubmit application again. I have only spoken with the relationship manager assigned to me once. Although they say notes are taken, the next person is never aware of previous contacts issues. I do not understand this. We are now in XXXX and this issue is ongoing. Please help me. Thank you in advance.

Consumer Complaint: I have two problems with Ocwen, my mortgage company. First I asked them to remove my FHA mortgage insurance and they denied it because " The LTV is greater than 78 % of the original value. When I purchased my home the value was XXXX and i currently owe XXXX. Which is less than 78 %. When I called, they stated what they meant was 78 % of the original loan amount. There wording says one thing and they mean another.. very misleading and wrong. Second issue my XXXX escrow analysis. Ocwen is doing very shady mathematical practices on my escrow analysis which is causing my monthly payment to go up dramatically. I received a letter stating my expected escrow balance is {$55.00}, making my expected balance deficiency {$0.00}. Total escrow shortage {$0.00}, cushion of {$480.00}, and and additional {$1700.00} is needed for the escrow balance. XXXX divided into XXXX payments of {$48.00}. My mortgage has gone up {$82.00}. They ca n't give me a clear answer of what is going on with my loan. My taxes stayed the same and my insurance went up less than {$20.00}. I was told my a representative that is an issue from XXXX when my loan was purchased from GMAC. My XXXX escrow analysis had a shortage of {$480.00} which was only the cushion.

Consumer Complaint: The mortgage in question was foreclosed on in 2013. This just happens to be the time where my identity was stolen and I could not use my credit to secure refinance. Anyhow, Ocwen mortgage is reporting to XXXX that the payment status is " LATE '' while reporting a XXXX balance, today. I have been denied credit based on this late status and would like to pursue damages in court. I have contacted Ocwen several times verbally and in writing and all attempts have failed. Here is the stupidity of the matter, on XXXX they are reporting me paid in the exact same column that they are reporting and defending on the XXXX report as late?!?!?! One way or the other they are wrong at least on one report! The credit bureaus are useless and claim to report what they are given regardless of any fault or error, they simply report no matter what. This has adversely affected my life and my future. I want the status of the report to be paid as it is on the other bureaus and I would like a list of attorneys skilled in this matter. The account number is XXXX, this is all I have. XXXX XXXX XXXX
