Consumer Complaint: This is the last email I send about you not applying my payments for XX/XX/XXXX-XX/XX/2016 and removing the delinquents from my credit report. I am contacting CFPB on Friday XX/XX/2016 regarding you posting practices and how you have destroyed my chances of getting a loan for a property. I do not know the loan number since it was sold and paid off in XX/XX/XXXX. Then you returned the checks that were not applied. I need a response by Friday morning or I will be contacting CFPB, I have been writing you since XX/XX/2016, It should not take 8 months to get this corrected. OCWEN never applied my payments for XX/XX/XXXX- XX/XX/XXXX because I did not write the account number on the check. It was left in limbo and they sent the mail that I was delinquent to the wrong address and had all the mail returned to them. After years of paying on time, they will not take the delinquents off my credit reports, thus I am not able to obtain another mortgage. I sold the property and paid them off. I thought I would be able to purchase a new home in XX/XX/2016, it is now XX/XX/XXXX and I still ca n't get a mortgage because of them. I am virtually homeless, since I sold my home. I have been living with my mother, and my son and my daughter. I have called and written them several times to have it removed and to no avail. I need this removed immediately so I can get a place to live. It is unfair that such a careless outfit can determine my destiny.

Ocwen claims that my mortgage documents allow them do to this. They claim that unless I specifically disclose insurance on the interior of my units, they can insure the interior, and add their expense to my principal. They have refused to provide any signed documents that prove my responsibility to make a disclosure. They have already lost a {>= $1,000,000} class action settlement on this issue - they were charging people inflated amounts for insurance and pocketing kickbacks. XXXX

Consumer Complaint: In XXXX my mortgage under XXXX and suddenly change to XXXX till XXXX, due to resessions and difficulty of business income, i got hard time to pay my mortgage, I applied modification and approved with the amount of {$2800.00}. I was in 3 months trial payments, on the 3rd months XXXX refused my payments coz my mortgage is no longer with them and was endoresed to Ocwen, I called Ocwen for my 3rd payments and was n't able to accept payment due to non documents in their system. I kept calling and waited for several months and I finally received statement back to my original payment. I could n't make the payment till I got Foreclosure via XXXX Bank. XXXX XXXX XXXX promised to save my house which I paid {$2500.00} as their service fee by XXXX XXXX XXXX which is later find out Scam. I continuedly saving my house to apply Modification directly to Ocwen. While modification is on going XXXX Bank keep fighting to foreclose my house.XXXX Bank filled a motion to sell my house without open house and the court granted while my modification is on going. I called Ocwen what is going on then ask me to submit some documents and scheduled me to a phone call which they failed to call me. I received a motion for selling my property without open house. XXXX scheduled to sell my property without open house in XXXX XXXX, XXXX. I received a denied letter from Ocwen after the selling date. I filed bankruptcy chapter XXXX to save my house and paid {$1800.00} XXXX = {$3600.00}. A week after my relation officer called me if I want to save house and I said of course. Again ask me re-do some documents which I did. Ocwen approved my modification too high as much as my original loan payments after I filed Bunkruptcy chapter XXXX. I did not accept their offer because too high and ca n't afford due to difficulties and changes of income. I want to know also why XXXX Bank is foreclosing or selling my property while modification was on going? Please I need help what is going on and need help to lower my mortgage.

Consumer Complaint: I would like the CFPB to take a journey with me. I am once again applying for a loan modification with Ocwen Loan Servicing. I uploaded my HAMP application to the Ocwen website on XXXX/XXXX/2016. I did not get a confirmation email from them. On XXXX/XXXX/2016 I submitted an email to the Ocwen Omsbudman and have not heard back from them to date. I logged onto my account today XXXX/XXXX/2016 and there was an email in my mailbox that indicated that they mailed me something because I did not provide all of the proper information. This is how the interaction began two years ago when I tried to apply for a loan modification with Ocwen. Ocwen tells you that you did not send in the right information so the processing timeframe gets restarted. I fear I am in for the same experience. I am going to track this process and ask that you take this journey with me. There is something going on at Ocwen that has to be out of compliance with the law.

It really amazes me how a financial situation can openly mock the system. Ocwen has sent me a release that was issued against a different apartment I owned up until XX/XX/2015. Which by the way, the crook investors Ocwen represents, grossly took away from me. Now investor and/or Ocwen wants to claim that that is the document they filed for apartment XXXX??????

Consumer Complaint: I have a mortgage with Ocwen. I have made my payments consistently on time. On XX/XX/XXXX I made a payment to Ocwen in the amount of {$2500.00} for the month of XX/XX/XXXX. The XXXX, Ocwen reported me to credit bureaus for being 30 days late for XXXX, even though they received {$2500.00} on the XXXX. Rather than applying my payment to my principle and interest, they HELD the funds and did not apply the funds because escrow amount was increased and I was short a few dollars. So they HELD {$2500.00} of my funds and reported me as 30 days late in making my payment when in fact that was False. I have a healthy balance in escrow and I was not short there either. My credit rating has sunk because of their practice to hold my funds and not apply them to my mortgage. They have been unwilling to help me clearing up my credit report because of them HOLDING my funds, even though I have been and remain current in my payments.

Consumer Complaint: this is in response to Ocwens attorney filing XXXX XXXX, 2016 the Law firm of XXXX with attorney XXXX XXXX XXXX who gloated to this Bureau in re to the XXXX Courts decision, what she wholly failed to mention was my Motion to Stay Proceedings ( see attachment below filed XXXX XXXX, 2016 ) in which the Court failed to rule, also my acknowledgment that my complaint was filed in a court that did not have jurisdiction XXXX XXXX XXXX XXXX, XXXX, XXXX " XXXX XXXX XXXX XXXX shall be the monitor and shall have the authorities and perform duties described in the enforcement terms. '' XXXX XXXX further gloated in re to the wrong cease and desist letter filed by me, in which she has the correct copy within her file when I filed my complaint as an exhibit which I mistakenly filed ( which I have attached the correct copy to this responsive complaint ). knowing she had the correct cease and desist letter and claiming to this bureau she did not have is genuinely dishonest as a practicing attorney should raise serious ethical issues with this Bureau. also on a number of occasions she stated in fact, " I am unable to find evidence that Ocwen failed to comply this was a very self-serving statement, of course she would n't find evidence, she is the attorney representing Ocwen and hired to side-step the consent judgment, which stated " within 15 days of the effective date of this consent Judgment the plaintiff, shall designate an administration and monitor all aspects of the consent judgment and the monitoring of compliance with it by defendants ( Ocwen ). ''!!!, in which they did in fact appoint XXXX XXXX XXXX XXXX XXXX and so XXXX XXXX was never appointed monitor of the consent judgment what she sees or did n't see is irrelevant as a matter of law because she has unclean-hands which is self-serving. further stated, " the XXXX XXXX XXXX retains jurisdiction for the duration of the consent judgment to enforce its terms, the consent judgment can only be modified by order of the XXXX XXXX XXXX. '' also, " the court shall retain jurisdiction for purposes of enforcing or remedying any outstanding violations that are identified in the final monitor report and that have occurred but not cured during the term. '' Exhibits page XXXX of the consent judgment XXXX states " The SPOC ( Specific Person of Contact ) shall, at a minimum, provide the following services to borrowers ; a. Contact borrower and introduce him/herself as the borrower 's SPOC ; b. Explain the programs for which the borrower is eligible ; c. Explain the requirements of the programs for which the borrower is eligible ; d. Explain program documentation requirements ; e. Provide basic information about the status of borrower 's account, including pending loan modification applications, other loss mitigation alternatives, and foreclosure activity ; f. Notify borrower of missing documents and provide an address or electronic means for submission of documents by borrower in order to complete the loan modification application ; g. Communicate Servicer 's decision regarding loan modification application and other loss mitigation alternatives to borrower ( in writing ) ; h. Assist the borrower in pursuing alternative non-foreclosure options upon denial of a loan modification ; i. If a loan modification is approved, call borrower to explain the program ; j. Provide information regarding credit counseling where necessary ; k. Help to clear for borrower any internal processing requirements. 5. Consumer Complaint: OCWEN Loan Servicing , LLC conducted a loan modification without my knowledge nor authorization. My signature was forged on a loan modification document which was not notarized. I am the co-borrower on loan # XXXX. I have attempted to be removed from the mortgage which has negatively impacted my credit. I am held financially responsible for such loan although decisions on the loan as well as a modification have been made without my knowledge or consent. I should not be held financially responsible for a loan which I was not informed of the new terms and conditions that I did not agree to. The co-borrower ; as well as her family members have gone back and forth on deed / ownership of the property and also have been involved in fraudulent mortgages in the past ; including co-borrowers ex-husband and father both of whom have filed bankruptcy over foreclosures. I am deeply concerned with my credit since I have not lived in the property for over 8+ years, do not have any financial investment in property nor do I make any payments towards said mortgage yet I am negatively effected as a co-borrower. OCWEN does not correspond nor consult me in decisions made on the loan my name is attached to. **NOTE : I do not know which mortgage process my issue is related to below

Consumer Complaint: I am a widow and this is stressing me out both emotionally and physically. XXXX of all, when I call them, I get this recording, 'your last payment of {$1500.00} was made on XX/XX/2016 and your next payment of {$1500.00} is due XX/XX/2016 ' RED FLAG! What I was calling about was on XX/XX/2016 my statement said payment due XX/XX/2016. I made a XXXX payment. Then the XX/XX/XXXX statement generated said my payment was due XX/XX/2016, and I did not make a payment for XXXX. The XXXX payment took over XXXX weeks to get there. The statement generated on XX/XX/2016 says that {$8200.00} was XXXX ''. They have CASHED these checks. And I have when I sent them and they allegedly got them. I am on XXXX and I do n't get my check until the third Wednesday of the month. My payment takes most of my check. I got my XX/XX/XXXX check back because I did n't put the XXXX cents in where you write the amount. They charge me {$6.00} for certified mail, when I mail my payments certified, it costs me {$3.00}. I have got XXXX with a certified tracking number on it. They also charge me for property inspection, {$13.00} and they are NOT in California. They also sent back my XX/XX/XXXX payment because it was n't the {$12000.00} plus due. I they pay my property taxes and I feel that they are OVERCHARGING me. When I called them I got that recording I mentioned in the beginning and the person I talked to was in the XXXX, a XXXX. They charge up to {$19.00} to talk to a customer service person. He said that " I '' would have to call back to get the results. I have sent letters to them and no response. If I have to get a lawyer I am wanting Ocwen to pay the lawyer fees. It was in foreclosure I resolved that and have been making payments since.
