Consumer Complaint: XX/XX/XXXX Good morning, We're reaching out to you, in the hopes that you will assist us, with our negotiations, with Ocwen loan servicing. We are WELL aware of the fact that Ocwen has a very long history of deception and fraud, when it comes to dealing with distressed homeowners and we need your help in our situation. We began our negotiations with them on XX/XX/XXXX. At that time we got a snapshot of our account status and we told XXXX, employee # XXXX that we would be submitting all paperwork required for review of our loan. On XX/XX/XXXX, we spoke with XXXX XXXX employee # XXXX. She informed us that all 52 pages that we faxed, were documented, imaged in and that the review process would begin within 3 to 5 business days. During the month of XXXX, we were required to resubmit the XXXX form, along with proof that my husband, XXXX XXXX, was the Executor of the Estate on this account.. TWICE. We did so happily. During the month of XXXX we've had contacts with them on a weekly basis and each of those conversations, we were told that our request for modification was being reviewed. We spoke with Ocwen on the XXXX, to XXXX, employee # XXXX and then to XXXX XXXX, employee # XXXX. At that point we were told that NO modification was being reviewed. We requested to be transferred to a supervisor and we spoke with XXXX, employee # XXXX. He told us that the original request for modification was, in fact, closed on XX/XX/XXXX. Meaning - Ocwen has been lying to us for the past 3 weeks. In order to review this loan for modification, a request ticket for an Assumption Modification must be made first. Documentation must be submitted for that and once approved, the formal modification can be completed. This was discussed during the very first conversation we had with Ocwen and they agreed that this would be done simultaneously, with our request. All of the notes from our conversations are attached to this complaint and we're asking that you reach out to Ocwen immediately, so they take this matter seriously and we get to where we need to be as quickly as possible. Consumer Complaint: Due to financial difficulties, my father and I has defaulted on our mortgage. We reached out to Ocwen Loan Servicing to discuss options and was placed on a repayment plan in XXXX of XXXX whereas I was required to pay a large initial down payment toward the repayment plan in the amount of {$10000.00} with payments to begin on XX/XX/XXXX. I called into Ocwen to authorize my payment by phone on XX/XX/XXXX which was to be dated XX/XX/XXXX. The representative that I spoke with dated the check for XX/XX/XXXX which caused the check to be returned insufficient funds. I immediately reached out to Ocwen to advise of this issue however ; there did not want to take responsibility nor resubmit the check to my banking institution. As a result, the repayment plan that was offered broke. Ocwen loan servicing required that I start the process over again and submitted all updated financial information to submit my request for workout assistance which I did. In the submission to Ocwen, I requested for the plan to be restored as a result of their error. Several months later, Ocwen offered me another repayment plan however ; increasing my payments to an amount we are unable to afford. They advised me they would be mailing me the repayment plan that will require our signature which I never received. The first payment was due on XX/XX/XXXX. To date, we still have not received the repayment agreement. Furthermore, given the age of my father and medical condition, I also requested if we were able to be considered for a Loan Modification however ; was advised that we received several modifications in the past which was not true. We only received 1 modification which was offered in XXXX. We attempted to explain this situation to Ocwen however ; they would not accept our response.

Consumer Complaint: Ocwen reported to credit bureaus I was delinquent in paying mortgage and sent me my pay history. They neglected to mention that I made several extra mortgage payments they charged to " principle payment '' because I learned you have to call them directly to tell them to " ONLY APPLY TO PAYMENTS '' As you can see below, here are those payments that should have covered my mortgage payments no matter what so I was never delinquent in paying : XX/XX/XXXX {$1600.00} XX/XX/XXXX {$170000.00} XX/XX/XXXX {$910.00} XX/XX/XXXX {$1800.00} * *Note : The Ocwen phone person is the one who explained they put extra payments into principle only even though I didn't know that she told me she can now click the button that says " ONLY APPLY TO PAYMENTS ''. I am asking you to please have Ocwen revise their credit company reports to show I have been on time with my mortgage since the beginning. Thank you. XXXX XXXX

OCWEN clearly shows they began servicing my mortgage on XX/XX/XXXX, IAW the RESPA, and their records clearly shows ALL payments made on time with the right amount of mortgage payments. OCWEN continues to report Mortgage servicing by a PREVIOUS mortgage company and bases their records on WRONG information. IAW the RESPA OCWEN began servicing my Mortgage Loan on XX/XX/XXXX, NOT XX/XX/XXXX, through today,. OCWEN 's records and mine CLEARLY shows there has never been a late payment since XX/XX/XXXX. ALL payments always made as specified by OCWEN and ALWAYS before the required due date.There has never been a late payment to OCWEN. IAW verifiable records. PLEASE CORRECT : IF OCWEN cares to report to the CREDIT Bureau 's it should be CORRECT and IAW with the RESPA. from XX/XX/XXXX NOT XXXX, through today. There should NOT be any late charges because the monthly mortgage payments are always the CORRECT amount and always paid to OCWEN on time. AGAIN, OCWEN should be reporting for the period they serviced my mortgage, XX/XX/XXXX, IAW the RESPA from XX/XX/XXXX through today. XXXX began servicing my Mortgage on XX/XX/XXXX through XX/XX/XXXX. I have records showing the mortgage payment amounts to XXXX were specifically stated by XXXX and the specified amounts were always paid to XXXX on time, NEVER Late and always the amount specifically specified by XXXX. As you can see, I have always had a stellar payment record with this company. I tried contacting both XXXX and OCWENLOANS with no successful resolution. XXXX only reporting me late. There was definitely an error on their part. I was never 30 days late XX/XX/XXXX-XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX.

Consumer Complaint: Ocwen Loan Servicing, first wrongfully reported me to be late in making payment by wrongfully allocating the monthly payment towards the principal and then began to charge late payment fees. They do this on a regular basis. PLUS they reported me to the Credit Reporting Agency for late payment, when we did not miss a single payment to them. What they do is simple. In the month of XX/XX/XXXX ( the short month ) any payment received on XX/XX/XXXX for XX/XX/XXXX is allocated as a " DOUBLE PAYMENT in the same Month '', as they receive one payment on XX/XX/XXXX and another on XX/XX/XXXX. This works each time as I make my payment reach them on the XXXX of the month. XX/XX/XXXX being 31 days and XX/XX/XXXX being shorter in length, they end up getting two payments in that month. So they allocate a payment without your consent or information to the PRINCIPAL balance, as if by mistake. BUT the intent is to charge you late fee of around {$100.00} per month. WITHOUT MISSING A SINGLE PAYMENT, they have reported me late. My case Number with them ( XXXX ) and NC Department of Justice ( XXXX ) is ignored and they reported me to XXXX as delinquent ( Case No. XXXX ). They have done this trick for the THIRD TIME. Their Ombudsman lady XXXX XXXX writes long jargon filled letters that do not address the complaint and try to side swipe their customers with fraudulent charges by wrongful manipulations without your knowledge or consent. OCWEN is a corrupt financial institution like XXXX, that is cheating people and has built-in cheating mechanisms.

Consumer Complaint: last week lender, Ocwen, sent emails that the only item needed was taxes ; taxes were signed and presented to Ocwen this week.Email from Ocwen said that the foreclosure would be placed on hold. Another email said that the foreclosure is NOT on hold. Ocwen hired their own company to foreclose. All kinds of calls from realtors and public calling and harassing over this foreclosure notice filed.
