Im filing a complaint against Ocwen for Misreporting and negatively impacting my 3 major credit bureau records. On XX/XX/XXXX, we were told by Ocwen agent XXXX ID # XXXX, that the account had started to report current as of XX/XX/XXXX. However after printing a portion of my credit report which best reflects Ocwens reports, clearly show that the account is and has been reporting as over 190 days + late since XX/XX/XXXX. Consumer Complaint: RE : Loan # XXXX XXXX XXXX On XX/XX/XXXX I received a answer back from your Ocwen s account anaylist XXXX XXXX when i pointed out all the fraud that the company that he works with and represent. He defence was such : " we can not comment on actions taken by " that '' servicing company. '' So my question to the gentleman is : Before you foreclosure me. If you want to do things right don't you think you should check every paper that, that prior company placed in court so you don't commit the same fraud? Since your company said the investor is the one who does not want to modify my loan so after just 2 weeks ago I requested from your company the XXXX from my loan. Because I thought : _Oh ... well, you must have it already in hand if you are denying my loan on bases of the investor been the one who does not want it. As of today they send me a letter saying that they had send me what I requested but. guess what? I never got it. this is the letter that I have sent to you. " Last week a received a call from your company. The represent told me that you guys where working on a in house loan modification and by last week you would give the the final figure and that every thing was ok and you just needed to give me final numbers.which i though it was very wise from you. Since my loan has so many fraud. You can not deny it.because again attorney general, etc, has send checks after checks apologizing for frauds you committed against me. Me and my family were happy with you decision that finally we would get our peace of mind back. we even went out to celebrate with our kids that blessing. But it is known the cruelty your company does with home owner! Sad to say today I got again some of your cruelty again because again today your representative came up with another story. They told me today that you can not modify my loan because there is too much interesse to pay. And also " the investor '' does not want that. Right now I'm challenging you to prove to me in court the investor has a say on it. First you dont even know who is the owner of my note after so many selling of it on XXXX XXXX. Even the representative of investors in the XXXX XXXX says only the servicer can decide when to modify loans. you are The SERVICER. Also XXXX XXXX XXXX XXXX XXXX spokesman XXXX XXXX says its misinformation to say that investors make these decisions.it is very rare for the language iven to exist on the XXXX So you are the ones who does not think you are going to gain as much as if you sell my loan.Again the house is in rehab. Every thing is on hold right now referent to that. I was fixing Walls has damaged through the years. ( 11 year ) Kitchen i'm putting new cabinet, fixing floor etc. Im experrient on that. I will be suppressed for it condition if you can make XXXX on that. Therefore you will loose more money if you sell it.apart of putting more name of fraud under your companies name, because I'm reporting every thing you are doing in my loan .also more money to loose because I'm about to go back in court to fight again. I m not taking vantage of the situation and asking for a free house. I just want a fair modification. I know you are doing the math and thinking you better off to selling it then work with me. But please don't test my intelligence. I know there is not investor in this. It is you who don't want to modify. You can say you were not taking care of my loan when all this happened but you can not close your eyes to some thing that is under y our authority at this present time. And if you sell my house you will be co participating with the fraud committed against me If you look at my loan. I'm part of the who had the XXXX sign fraud. Assignment of mortgage, the note, if you look at court paper shows lawyer XXXX saying. The note is lost " look at court papers please ''. Now the note is there. Is that the real one? Can i ask for a forensic of the note? Would you allow me? Lets set a place, perhaps court.Just to make sure you are been fair with me. Sense you say there is nothing wrong with my loan. Dont close your eyes. DO RIGHT, GIVE ME A IN HOUSE MODIFICATION Please i would like you to answer back my letter.

Consumer Complaint: Paid reinstatement amount stated by Ocwen in XX/XX/XXXX for {$25000.00}. Loan was reinstated Next payment was due XX/XX/XXXX. Ocwen applied funds to account and state I owed another {$6500.00} in XXXX. I contested this and was stonewalled when I tried to call on numerous times with the person on the phone who promised that this would be resolved. My account was frozen in XXXX stating I owed {$1000.00}, but they refused to use money in a suspense account totally {$1000.00}. No resolution was ever offered to apply funds properly. Account went into foreclosure Property sold to Ocwen ( XXXX XXXX, XXXX ) on XX/XX/XXXX. Have been trying to speak to someone about purchasing the home, but have not been allowed to speak to anyone who can make this decision. I have retained a lawyer who has tried, unsuccessfully, to speak to someone at Ocwen, they have continually referred us to a company called XXXX. This would have never gone to foreclosure if Ocwen honored the reinstatement in XX/XX/XXXX. Through their accounting, application of the {$25000.00} payment, and refusal to allow me to speak to anyone higher than customer service when I call in, have taken my home and given me nothing in the way of any recognition or resolution to the XX/XX/XXXX payment or suspense account money that was never applied.

Consumer Complaint: I have been paying ahead on my loan sending in additional money writing on the money order and sending a letter with each additional payment that these were principle only additional payments. I called on XX/XX/18 for a pay off and to inform them that they other money I sent in was for principle only. They informed me it would take 3-4 days to fix the payments and then another 3-4 days to give me a pay off. I informed them that this was unacceptable. I would be paying interest for almost 2 more weeks because they can not figure a pay off. I want a pay off so the interest is stopped. Please help! Consumer Complaint: I refinanced my loan back on XXXX ending with a conventional ARM loan, currently with an interest rate of 7.75 %. I was able to maintain my payment on time until I was forced to retire back on XX/XX/XXXX due to serious medical condition. I am now depending on my social security benefits and a small pension from XXXX. Due to the income reduction I was also forced to file for bankruptcy in the beginning of XXXX, finally discharged on XX/XX/XXXX. I contacted a Housing Counseling Agency since XX/XX/XXXX after getting a steep increase in my payment. My housing counselor has submitted the workout package along with my financial documentation for a couple of times and I have been following up closely since then. I am know 60 days behind and the lender keeps arguing the bankruptcy case must be " dominated '' to process my application. I have gone back and forth to the bankruptcy court and their staff had clearly stated the bankruptcy is done, shouldn't be an impediment any more. My counselor recommended to report my case to you agency, hoping to get an answer from my lender.

Consumer Complaint: Ocwen Loan Servicing acquired my current home loan. Previously, Ocwen reduced the mortgage payment to about {$1100.00} per month without me having to refinance. Recently, Ocwen increased my mortgage payment by a ridiculous {$800.00} extra per month. Now my current payments are {$1900.00}. Ocwen said this was due to an escrow shortgage.???. Anyway, I have been sacrificing to pay this outrageous amount for the past several months and I know the escrow shortage should be cleared up by now. I requested that my payments be lowered back to around {$1100.00} and was told that couldn't be guaranteed since the shortage amount had already been calculated and included in the remainder of the loan balance. Ocwen said that I could re-finance. I DO NOT want to refinance with Ocwen. I didn't refinance for them to lower my payment prior to this huge mortgage increase so I shouldn't have to refinance now. This will only add additional fees and increase the loan amount. I also received a notice from Ocwen stating they have PMI insurance on the loan. I want this removed to help lower the mortgage.payment.

Consumer Complaint: We have lived in our home for 15 years and have never missed a payment on our mortgage to Ocwen Loan Servicing, LLC, XXXX. XXXX XXXX, XXXX XXXX XXXX, FL XXXX. However, interestingly enough, we have been sending our payments to an address in XXXX XXXX, IL. This month 's invoice dated XX/XX/XXXX, includes a charge for {$240.00} for " Past Due Fees/Other Charges. '' Since we have never missed a payment or been delinquent in any manner, we were puzzled. We called Ocwen ( not certain of the date ) and asked about this charge. They told us it was some kind of processing charge from 2013. Still puzzled, we called them to ask for some authentication of this fee. They sent what they called a Payment History. It is essentially a spreadsheet with 52 items on it, none of which we can understand. However, it does end with a - {$240.00}. It is of no help in understanding their claim. So now our questions are : 1. Is this a legal charge? 2. Is it legal to go back 5 years and tell a client she has a charge she has no way of understanding? 3. What are our rights in this situation. I have decided to do this : I am sending this months payment with a check, not electronically as I usually do. I will send a letter with it explaining I have filed a complaint with the Consumer Financial Protection Bureau and I will not pay this extra amount until the cast is resolved.

Just recently, Ocwen has denied the loan modification and informed me that they did not review any of my income. My income is very important part of the process and unfortunately Ocwen is not considering it. I am in position to pay my mortgage based on the income I am currently receiving. I am not asking for any adjustments. If they brought my account current, i would be ok with that.

Consumer Complaint: The complaint I have with the Mortgage company is Ocwen. You see I applied for a Loan Modification. I was approved, it couldn't come at a worst time. I told them I needed a month to start paying back the loan. A month earlier I was in the hospital for a month you see I had a XXXX and couldn't go back to work for a month. I told them this several times, they told no problem. You can re-apply everything will work out.So I re-apply and I got DENIED. They turned me down flat and didn't even look at my current check stubs.I don't know what else to do I did what they said.I have paperwork to prove it.
