Issue: Struggling to pay mortgage

Consumer Complaint: On several occasions I tried to get my mortgage company to modify my mortgage. They said I did not make enough money and this last time they said that they did not have all the documentation ( which was not true ) This last time they said I was too far behind. I have been trying to modify this mortgage for a number of years. I called the mortgage company to get a copy of the application and Truth and Lending Statement. The mortgage company sent me a copy of the Truth & lending Statement two copies of the Truth & Lending Statement one was written in with one set of number and the other had another set of numbers. So it appears that the Truth and Lending Statement was " fixed '' after I signed at the closing. Later I find out that the original mortgage company XXXX XXXX went out of business because of fraud. I think Ocwen wanted me to loose my house so I would never find out that there was fraudulent documents.

Consumer Complaint: I modified my loan with XXXX in 2009. The company changed name and is now called Ocwen. I was told if I had 3 years of timely payments on a trial basis bases and I kept the house, the loan would be as is with no prepayment penalty and I would not owe additional funds. I have been renovating my house out of my own pocket since then. I want to refinance my loan. When I asked for a pay off with Ocwen informed me I owe them an additional 25 % of the new appraised value. There was one stipulation, if I renovated and submitted receipts they would deduct that dollar per dollar. I asked what is criteria for remitting receipts and what would be accepted. I was told there was no one to talk to and it's up to their discretion. I want some solid guidelines. When I researched this loan, numerous people were told the same as myself that we were out of any pay back after 3 years. How can this be so subjective? And they lied about a three year termination of any stipulations. My email is XXXX XXXX

Consumer Complaint: I contact Ocwen Mortgage in XX/XX/2018 because I was having some financial difficulty. They set me up on a repayment plan in which I have made all payments on time. Ocwen has been reporting me on all three credit agencies as 60 days late. Ocwen never disclosed that if I opted for the repayment plan I would be considered late and that would be report to the credit bureaus as late. I feel that was unfair and they did not provide informed consent. I contacted Ocwen several times to no avail

Consumer Complaint: I have been living here in this house since 23 years. My husband borrowed against this house in XX/XX/XXXX all in his name. The note is on his name and he passed away in XX/XX/XXXX. I have been in touch with the bank ever since he passed away to transfer the note on my name so I can continue making the payments. The bank refused to talk to me since I am not on the loan. I explained them that my late husband and I both jointly own the house. However, they have not acknowledged me on the loan ever since then. I called Ocwen about 20 times in the past one month to save my house and they refused to transfer and therefore the loan modification is not available to me. They are still sending the loan modification offer only to my dead husband. Now they want to foreclose me on XX/XX/XXXX. I NEED TO SAVE MY HOME. I have an XXXX year old mother and a XXXX old daughter who depend on me.

Consumer Complaint: Ocwen Loan Servicing, LLC, has assessed our account the amount of {$8700.00} unlawfully. We contacted the servicing company regarding the matter, in response Ocwen Loan Servicing, LLC, indicated that the fees were not past dues even though it reflected in that fashion according to the mortgage statement, but assessed due to the XX/XX/XXXX foreclosure action. I have attached a notice of voluntary dismissal from the foreclosure action. What does this mean? In Florida in order for servicer 's to collect for legal fees they must either win summary judgment or acquire a final judgment at trial. We never went to trial because both me and Ocwen entered into an agreement and therefore trial was cancelled. In XX/XX/XXXX, the Florida Supreme Court adopted Fla. R CIV . P. 1.525, which states- " Any moving party seeking a judgment taxing cost, attorney 's fees, or both shall serve a motion within 30 days after filling of the judgment. See case no. XXXX, In the XXXX Circuit court of the XXXX Judicial Circuit. You will find that NO JUDGMENT WAS ENTERED, case was voluntarily dismissed and therefore as per Florida Civil Rules, Ocwen is not entitled to have assessed the {$8700.00}. This is Illegal on its face and we ask action immediately by the Consumer Protection Bureau.

Consumer Complaint: Re : Ocwen Loan Servicing, LLC account number XXXX Hello, Im writing this letter in complaint about monies being improperly taken from my escrow account by Ocwen under the guise of Lender placed flood insurance. I have been going back and forth with Ocwen for a few years now about monies being removed from escrow account as described above. They always increase the amount of flood insurance that is required for my mortgage after I have renewed the insurance at a coverage amount previously set by Ocwen, at the time the policy renews, and then remove money from my escrow account to cover the difference. Last year in my attempt to pin them down and avoid the hassle of being on the phone with them for hours trying to get my money back, I asked them to put in writing the amount of Insurance coverage needed to cover from XX/XX/XXXX to XX/XX/XXXX ( the term of my flood policy ) so that this situation could be avoided. They refused to provide this number in writing but gave me a verbal number and I renewed it for that number in XX/XX/XXXX. But in XXXX and XX/XX/XXXX they removed money from my escrow account again as described above. Even though the policy was renewed for the amount Ocwen had requested it to be renewed for. I spent hours on the phone with them about it in XXXX and they agreed to give the money back and as of this date I have not seen where the full amount has been returned. And they actually removed additional money in XXXX. So I called them back again and I still have no explanation on why they did not return all the money after they agreed to do so nor did they explain why additional money was taken. At this point it appears to me that Ocwen is just engaged in outright fraud, theft and deceit. Ive spent countless hours arguing with them about this issue, and they talk in circles, seem to not understand the issue, promise to return the money and then dont ( they actually returned it one year only to take it back again a few months later with no explanation ), they say things verbally and then refuse to put them in writing, blame other Ocwen departments, they also refuse to disclose who the proper regulating authority that their customers should complain to if they have a problem. As to avoid confusion please be aware that Ill submit this in writing and online to the cfpb and Im sending copies to the United States Attorney General, New Jersey State Attorney General, and to Ocwen as they need to be stopped.
