Consumer Complaint: We applied for a line of credit on our home and was informed that there was an open lien on the property from XXXX. When we researched this on the XXXX XXXX County Recorder of Deeds web site we discovered there was a mortgage that was not showing as satisfied. Through weeks of research and back and forth with XXXX XXXX and Ocwen we are unable to resolve the issue. XXXX keeps saying that it is Ocwen and Ocwen say that they are only responsible for loans after XXXX. XXXX is the company that placed the letter of satisfaction on the incorrect loan back in XXXX. Please help us with this. We have done nothing wrong. Always paid our debts and now we can't get a line of credit because XXXX filed a letter of satisfaction on the wrong instrument number. Please see latest email chain below with more details.

Consumer Complaint: Hello! Re : Lender XXXX XXXX formerly XXXX XXXX Loan # XXXX I am writing you this letter of complaint in respond to the recent letter received from OCWEN under CFPB Case # : XXXX. After a careful review of the said letter, I realized that the bank that I should need to question should be XXXX XXXX. The moment I read the copy of the Fixed/Adjustable Rate Notice, I/we ( my husband ) were in total shocked! I recall XXXX calling us all the time and later convinced us to sign up for a great fixed second mortgage loan in which we later on decided to it with payments of at least {$600.00} or so each month. However, it was only agreed based on a fixed rate, not adjustable or it will not be entertained - for both 1st and 2nd mortgage. There was no way for any lenders to convince us on switching our fixed rate into adjustable, period! Otherwise, we believe the letter is not true! Also, Id like to know the previous name of the lender with the loan # before XXXX took over as I believe that our original interest rate was roughly 4.5-4.99 % fixed for 30 years ( home mortgage loan ). We acknowledge the signatures, but we have not seen this letter nor would have signed/approved for it! Again, we purchased our house at {$210000.00} in the year of XXXX. The letter from XXXX Bank was dated back in XX/XX/XXXX. Therefore, we would like to request them to send us all copies on how they came up with the {$340000.00} from the original/initial purchase at {$210000.00}, that is a difference of {$120000.00} plus the second mortgage loan of at least $ 60K or so? So my questions is, where did the money go? We didnt we see any money that was issued or deposited to our bank for over $ 100k? I need to see a deposit amounting the difference, copies of the checks and what bank it was deposited to? So we would like to know how they have acquired the amount of {$340000.00}, plus the second mortgage? That is a lot of money for us to borrow and why would we need that in the first place? Now, we need to see all the breakdown and calculations for both 1st and second mortgage, including : 1. 1st and 2nd mortgage payment LEDGERS, 2. Bank name we use to pay the 1st and 2nd mortgage so we can check them against our our bank for facts and proof. 3. Copies of all loaned money showing the check # and which back it was cleared under? 4. Full detail explaining on how the total from@XXXX went up to {$340000.00} in addition to the 2nd loan mortgage??? 5. And all other facts proof of all the entire calculations from day one since you took over! Sincerely, XXXX XXXX

Consumer Complaint: Once again Ocwen is claiming ownership to the property address XXXX XXXX XXXX. I tried for a modification with Ocwen from XXXX. I stopped when I found out the loan was a fraud Ocwen has attached the loan to a backdated old debt which is time barr to collect and file a law suit Ocwen put a modification on the home in XXXX and never sent me the papers to sign. I only found out when looking at the statement they sent. I requested the modification papers with signature they could only provide a blank signed paged. Ocwen added another modification to the home in XXXX XXXX after telling me I did not meet the dead line of 37 days per their attorney Ocwen approved a modification without my signature again in XXXX. I contacted Ocwen and asked how did they approve a modification without my signature. They apologized and stated it was a good faith modification to help the consumers out. I demanded they remove the modification as their attorney had already admitted in a letter they were not in the origination of the loan. Ocwen now has the home for foreclosure and I have not been notified nor did Ocwen. Ocwen is pass the status of limitation to foreclose on the home. I have not sent any payment to Ocwen since XXXX when they stop taking payment as they claim to have obtained the loan via transfer of assignment Ocwen has not been able to prove the transfer chain from the origination of the loan. They are just going to take the home and not follow the laws

Consumer Complaint: OCWEN is our mortgage loan servicer, but has refused to provide the opportunity for our mortgage loan to be reviewed for retention options. Instead, they have been pushing for a foreclosure sale that is schedule for XX/XX/2018. We reached out to OCWEN six month ago when we were only three months behind on our payments, but their representatives and process is not providing us the assistance that we should have received. They claim that they can not change the terms of the loan to make it affordable, but we are making plenty of money and can afford our mortgage payment. We do not feel that we have a real single point of since it is impossible to get a hold of her. We can not understand their representatives when we call in, are tired of fighting them and would rather work with them, but this has proven to be impossible. We have been given the runaround for six months as they have consistently denied us access to mortgage assistance options. Never have the offered us a foreberance, payment plan or a modification over the last six months. They only say for us to pay the entire past due amount, plus attorney fees, or get out of our home. From the start, this was a bad mortgage as we were put into an interest only loan when we purchase our home. Then, when we refinanced, our situation only got worse, as the refinanced loan put us on the cusp of affordability. When we had a detrimental financial event, we fell behind on our mortgage. Our hardship began last year when my wife and I both lost our jobs and then we had family members who fell ill. We quickly got back on our feet and tried to work with OCWEN , but they have denied us twice and never sent us denial letters. We had to find out over the phone and feel they are being deceptive. Their lack of cooperation is at the very least unethical, but maybe illegal, as they should be willing to help homeowners. I see that they fined over {$2.00} billion by our government, but we question if that made a dent in their behavior, as they seem uninterested in helping us. We have been treated unfairly by OCWEN and need help dealing with them.

Consumer Complaint: Ocwen declined us for a loan modification in XX/XX/2018. In XXXX we moved out of our house due to the fact the loan adjusted to a higher payment and we could not afford the mortgage. We also owe more than it is worth. In XXXX we put our home on the market for sale. We have had many showings, and submitted an offer for short sale. For the past 3 weeks we have tried to submit the offer with our Realtor for short sale. Ocwen has refused to give us a straight answer and will not place our offer in review for short sale, or order an appraisal to begin the process. We do not want to drag this short sale process out and have our credit destroyed. Ocwen is being dishonest and doing everything they can to create a foreclosure. When we were declined for a modification Ocwen told us we were qualified for a short sale to avoid foreclosure, now Ocwen is lying and being very dysfunctional.

Consumer Complaint: Ocwen has increased my payment monthly and will not give me an answer why. I keep getting notices from them monthly that I am behind in my payments. I have all the bank statements that prove I was NEVER delinquent in ANY of my payments. I refinanced my home ( apparently through them ). I am not sure. I have NEVER had a problem with my mortgage ( paid on time ). I am on XXXX and collect only {$1200.00} per month. My mortgage payment went from {$760.00} to over ( what I believe to be XXXX almost {$900.00}. I keep getting letters from them every month in regards to possible foreclosure and when I call them, they tell me my equity is in arrears. I've had this mortgage for 11 years and it never increased. I can not afford to lose my house that my late husband bought for us. As I said, I am on XXXX and can NOT afford this increase. PLEASE let me know what I can do, I am scared.
