Consumer Complaint: On XX/XX/XXXX, Plaintiff, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX filed a civil action with the XXXX XXXXXXXX XXXX for XXXX XXXX XXXX XXXX XXXX , a unit in the apartment complex located in XXXX, XXXX. A summons date stamped XX/XX/XXXX, by XXXX County Sheriff 's Office was supposedly served on someone who resided in the apartment on XX/XX/XXXX. I have no idea who might have been served with the summons & complaint in question. I did not reside in this apartment complex or otherwise occupy a unit at the residential address that was being re-possessed. My physical address was about XXXX miles north of this complex. I never received a copy of the summons or complaint via postal mail or otherwise. On XX/XX/XXXX or a date within a day or XXXX of XX/XX/XXXX, I received a piece of via U.S. Postal mail from the law offices of XXXX, XXXX, XXXX, attorneys for XXXX XXXX XXXX, in which a Motion for Default Judgment for repossession of the apartment and all costs. This is the first I learned of the eviction claim against me. Obviouslt confused and eager to explain the mistake that had been made, I phoned the law office and asked to speak with the attorney who signed the Motion for Default, but the attorney would not speak to me, rather the secretary rudely hung up on me. Thereafter, I tried calling the office managers at XXXX XXXX to resolve the problem. No one answered the phone, I left messages, not return call. On XX/XX/XXXX, I filed a with the XXXX County Court, a Motion to Dismiss or Alternatively Quash the eviction claim on grounds that I was never provided service of process or notice of the pending action. On XX/XX/XXXX, the attorney representing XXXX XXXX XXXX then filed a notice of voluntary dismissal of its pending eviction and related claims. On XX/XX/XXXX, the XXXX closed the case and no other claims or eviction actions have been filed. I accepted a position and am having to relocate over XXXX miles for my new job ; thus, I am searching for rental homes in the area and am completing the required rental applications, submitting to background and credit checks to be approved for a long-term lease. I completed a rental application on XX/XX/XXXX through XXXX and noticed that an LexisNexis is reporting a residential eviction in its public records search. I have had XXXX rental applications denied, two prior to me having learned of this information. This is inaccurate reporting - the negative impact this false and inaccurate eviction record is having on my ability to establish a residence is resulting in severe hardship on my career and on my son 's education and our overall livelihood. We are on the brink of XXXX as of the date of this complaint. It is imminent that reporting agency remove this inaccurate information from my reports immediately. The exorbitant expense of renting XXXX and having to relocate every week is causing severe financial, emotional, mental hardship any my XXXX son and myself. The high cost of short term rentals is impossible for me to sustain ; Because of this inaccuracy on my rental history, I am having to spend the money I saved for the deposit and first month 's rent all rental agencies and landlords require to secure a longterm lease. I have attached the initial complaint, summons, motion for default, motion to dismiss and voluntary dismissal documents filed in this case. The case is closed- no eviction or order to pay any damages - I did not live in this apartment, was not physically present or residing at the apartment in question and was never apprised of the fact that a lawsuit had been filed against me. Having realized the error only after I filed the motion to dismiss, the attorney for the complex dismissed all claims against. Please remove this from my record ASAP.

Consumer Complaint: I contacted Lexis Nexis to let them know that I did not give them permission to share any information. I filed an initial complaint about them sharing information without permission. They claimed they could not verify my identity however they sent me a letter acknowledging they know who I am along with a PIN number and case number ( XXXX ) in case I would like to share my information in the future. This company is being deceptive in saying they can't verify who I am but continuing to share information and so called " verifying '' information for other companies. I have attached the letter they sent me because they continue to use my identity without permission. I'm sure they are aware of the damage they do to a persons reputation with their continued deceptive practice. According to : 15 U.S.C 1681 A. States I have the right to privacy. According to : 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions According to : 15 U.S.C 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

According to the law 15 U.S. Code $ 1681a - Definitions ; rules of construction. The term " investigative consumer report '' means a consumer report or portion thereof in which information on a consumer 's character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information. Consumer Complaint: The Company negotiated a plan with me after being fully informed that I am totally and permanently XXXX in which I and the sales person discussed the possibility that I would not be able to generate sufficient revenue at times to service any debt that arose. Since then I have had great difficulty in generating sufficient revenue and have asked to discuss this issue a number of times. At no time have my requests been actually acknowledged nor have I been contacted by any individual to discuss the matter. Today I learned that the company has been pyramiding late fees by assessing late fees on prior late fees by charging, per their email, 2.17 % on the balance after adding in prior month instalments and subsequent late fees. I have an email message from them flatly stating as much.
