Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: GM is reporting inaccurate information to credit bureaus. Based on documents from GM they are in violation of the FCRA for reporting inaccurate information on my file. After numerous disputes with the bureaus. Contacting GM about the situation both refuse to follow the law set forth in FCRA. GM has verified false information but more unethically updated its mistakes based on the documents of proof I provided to the credit bureaus during my dispute process. They continue to report the charge-off amount falsely. The amount that was charged off is XXXX as provided in documents provided to me from GM Financial. No matter how times I have provided this information to the bureaus they allow GM to verify a totally different amount which is the definition of inaccurate.

Consumer Complaint: I leased a car through GM financial. I set up auto pay like I have done in the past previously to " set it and forget it '' and not have to worry about payments during the lease. It worked perfectly until the very last payment on the lease. I must have missed the fine print that said that the last payment could not be made automatically. So despite having the money in my account the auto payment system did not perform the last payment. GM financial says they reached out to me to inform me of the late payment, however the emails they sent were classified as spam so got sent to a spam folder and the phone calls were sent from non caller ID numbers. I would answer the phone calls say hello and recieve no response on the other end so I assumed it was a robo spam call and hung up. So I was never informed of this missing payment until I went to go turn the car in or buy it out at the dealership weeks later. I paid the last payment in full as soon as I was made aware. I have tried calling into gm financial support about the issue already 3 times and got different explanations each time. I am hoping this 30 day late payment on my report can be overturned as I feel it is not accurate.

Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: This letter is in regard to the XXXX XXXX XXXX. This vehicle was purchased on XX/XX/XXXX of XXXX. The finance company GM Financial violated the Service members relief act ( SCRA ) by repossessing our vehicle on XX/XX/XXXX of XXXX without a court order. Which is illegal under the SCRA. The SCRA prohibits creditors from repossessing personal property, including your vehicle, without a court order, based on breach of a contract you entered into prior to XXXX XXXX military service. That means that even if you violate your contract by, for example, failing to make your monthly payments, the creditor must first file a lawsuit and get an order from a judge before your vehicle can be repossessed. We never received any court orders, nor did the lender ( GM Financial ) send any notification of the repossession. Neither did the repossession company identify themselves. the protection applies only if you : * purchased or leased the vehicle, or other personal property, before entering military service ; and * made a deposit or installment payment on the vehicle, or other personal property, before entering military service.Which BOTH applies to this situation. The SCRA rights are being exercised. SCRA rights may be exercised by anyone holding a valid power of attorney for the servicemember. Some SCRA protections also apply to dependents. To resolve this violation rather than taking legal action we would like the property ( vehicle ) along with the illegal down payment ( XXXX ) returned and restitution for pain and suffering this has caused. If the down payment, payment of restitution, and property is not returned legal action will be rightfully taken! * A person who knowingly resumes possession of property in violation of subsection ( a ), or in violation of section 3918 of this title, or who knowingly attempts to do so, shall be fined as provided in title 18, or imprisoned for not more than one year, or both. * ( 1 ) may order repayment to the servicemember of all or part of the prior installments or deposits as a condition of terminating the contract and resuming possession of the property ;

Consumer Complaint: approximately 3 months ago I placed a {$100.00} deposit on a new car with XXXX XXXX located at XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX Wisconsin XXXX. 3 Months later on Saturday the XXXX I went to see the car and finalize all the paperwork and wrap up all the necessary documents. I ended up not being able to leave with the car because I needed a co-signer or {$10000.00}. Later that evening I obtained a co signer, my brother. Next morning I heard that the car I had placed a downpayment was sold from under me to a different customer. My credit was ran approximately to twenty different banks and they are populating on my credit report. XXXX, the finance guy was extremely rude when I was asking him to figure out if a lease was a better option. He was not interested in assisting me into trying to help me or see what he could do. I will not be back at XXXX XXXX moving forward and will also be filling a complaint with the XXXX against them. This has been by far the worst experience I ever had. Was not welcomed and was not friendly at all. 10/10 would NOT recommend. ** this is NOT the way to deal with customers and this is NOT the way to deal with people trying to purchase a car. I felt like everyone just fed me lies from the start. General Motors should seriously look into this dealership from top to bottom.
