Consumer Complaint: I have suffered identity theft and power of attorney fraud by the following companies. Pursuant to XXXX XXXX XXXX XXXX XXXX, a United States Court of Appeals for the XXXX XXXX in XXXX ruled and emphasized that for a creditor to rely on a consumer 's consent, it must be informed and voluntary. Mere inclusion of a consent provision in a contract does not automatically establish informed and voluntary consent. The nancial institution must demonstrate that the consumer explicitly provided consent, indicating their understanding and agreement to have information reported to credit bureaus. Pursuanbt to FCRA 605b and 15 USC 1681 c-2 i demand the acount be removed and blocked from my reporting or you may be held liable for noncompliance pursuant to 15 USC 1681o and 15 USC 1681n . It is imperative to understand that failure to disclose information that should be made available constitutes fraud. Additionally, the unauthorized use of another person 's identifying information, without proper consent, amounts to Identity Theft. Under California Penal Code 530.5 you may be held liable for Identity Theft. U.S. Court of Appeals for the Eleventh Circuit recently ruled that a consumer does not have to prove actual damages to recover statutory damages for willful violations of the Fair Credit Reporting Act, In XXXX XXXX, et al. v. Experian Information Solutions , Inc. ( XXXX ; XXXX ; Experian ) has violated many consumer rights. Under Title 15 USC 1681 604 ( a ) ( 2 ) a consumer reporting agency CAN NOT furnish any account without my consent. ( XXXX ; XXXX ; Experian ) continues to defy my demands and report inaccurate accounts. ( XXXX ; XXXX ; Experian ) has failed to provide me with their investigation process. Has failed to provide me with any documents and proof of validation. ( XXXX ; XXXX ; Experian ) has also abused my privacy rights. Under Title 15 USC 1681 602 ( a ) it states I have a right to privacy and ( XXXX ; XXXX ; Experian ) continues to engage in abusing my rights. They have also engaged in defamation of my character. ( XXXX ; XXXX ; Experian ) is in violation of FCRA section 611 part ( A ) ( 1 ) I never gave ( XXXX ; XXXX ; Experian ) any written instructions to furnish any of these accounts which is a violation of Title 15 USC 1681b and ( XXXX ; XXXX ; Experian ) has caused me XXXX XXXX, and stress due to their abusive and unfair practices. The standard for unfairness in the XXXX XXXX act is that an act or practice is unfair when : ( 1 ) it causes, or is likely to cause substantial injury to consumers And ( XXXX ; XXXX ; Experian ) has caused me emotional and financial injury. According to 15 USC 1681 ( a ) ( 2 ), an elaborate mechanism must be developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( XXXX ; XXXX ; Experian ) falsely reported information that resulted in defamation of my character. Further, ( XXXX ; XXXX ; Experian ) created a deceptive form that made the creditors and employers believe that I was in debt, though you could not prove its validity. If the debts were valid, ( XXXX ; XXXX ; Experian ) created a false impression that I was not able to pay the alleged debts. As a result, I was discriminated against and denied my right to extend credit. I also suffered emotional as well as financial hardship. Therefore, the ( XXXX ; XXXX ; Experian ) Company is liable according to 15 USC 1681o. Consumer Complaint: Complaint Regarding Credit Report Inaccuracies Dear CFPB, I am writing to file a complaint regarding inaccurate information on my credit report. I have been actively disputing these inaccuracies with the credit bureaus, but they have failed to adequately investigate my claims or remove the incorrect information. In accordance with the Fair Credit Reporting Act. I attached the PDF file below containing the list of items that have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Credit Bureau stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify or delete accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I also believe that the credit bureaus have violated the Fair Credit Reporting Act ( FCRA ) by failing to : 1. Investigate my disputes in a timely and reasonable manner : The credit bureaus have not provided a clear explanation for their decision not to remove the inaccurate information, and I believe their investigation was inadequate. 2. Furnish accurate information to creditors : The inaccurate information on my credit report is harming my ability to obtain credit and other financial services. 3. Follow the FCRA 's dispute resolution procedures : The credit bureaus have failed to comply with the timeframes and procedures outlined in the FCRA. I am requesting that the CFPB investigate my complaint and take the following actions : 1. Order the credit bureaus to remove the inaccurate information from my credit report. 2. Consumer Complaint: I am writing to address a matter of non-compliance with the Fair Credit Reporting Act ( FCRA ) Section 609 by Experian. I submitted a complaint to Experian regarding inaccuracies in my credit report, as per FCRA guidelines. According to the FCRA, Experian is legally obligated to respond within 30 days of submission. However, it has now been more than 30 days since my complaint was filed, and I have not received any response from Experian. As per FCRA rules, this failure to respond within the stipulated timeframe warrants the removal of the disputed negative items from my credit report.
