Consumer Complaint: As per the Fair Credit Reporting Act, specifically 15 USC 1681 section 602 ( a ), it emphasizes the importance of consumer reporting agencies conducting their responsibilities fairly, impartially, and while respecting the consumer 's right to privacy. Equifax and XXXX are recognized as consumer reporting agencies, and as a consumer, you hold the right to ensure the protection of your private information, as supported by 15 USC 6801. Under 15 USC 1681 section 604 ( a ) ( 2 ), it is stated that a consumer reporting agency may only furnish a consumer report based on the written instructions of the relevant consumer. The financial institution, classified as the " Furnisher of information to credit agencies '' in this case, falls under the definition of a financial institution according to the relevant title. Therefore, both the financial institution and consumer reporting agencies such as Equifax and XXXX do not possess your consent to furnish your information, specifically without your written consent, as mentioned in the statute. Furthermore, 15 USC 6802 ( b ) ( c ) explains that a financial institution is prohibited from disclosing nonpublic personal information to nonaffiliated third parties unless the consumer is informed of their option to exercise nondisclosure. In this case, the " Furnisher of information to credit agencies '' failed to inform you of your right to exercise the nondisclosure option, which is a violation. Additionally, 15 USC 1681C ( a ) ( 5 ) states that a consumer reporting agency is not authorized to include certain items of information, including adverse items, in a consumer report without your permission, unless permitted under subsection ( b ). Therefore, their reporting of this adverse item without your permission is a violation of the law. Moreover, 15 U.S. Code 1681s2 ( A ) ( 1 ) stipulates that a person must not provide any information to a consumer reporting agency if they know or have reasonable cause to believe that the information is inaccurate. Equifax and XXXX are required to maintain reasonable procedures to avoid violations of section 1681c and to restrict the provision of consumer reports to the purposes listed under section 1681b, as outlined by 15 U.S. Code 1681e. Lastly, according to 12 CFR 1016.7, a consumer has the right to opt out of reporting services at any time. Therefore, I am exercising my right to opt out of their reporting services.

Consumer Complaint: I am reaching out again regarding the ongoing nightmare I face due to XXXX XXXX and credit reporting agencies mishandling verified identity theft on my account. Despite providing substantial evidence like an official police report, FTC Identity Theft Report, notarized affidavit, and identification documents, XXXX and the bureaus continue to falsely attribute fraudulent charges to me. XXXX refuses to conduct a full investigation, instead making empty claims of " verification '' without providing any concrete evidence like IP addresses, geolocation records, or transaction metadata to validate over {$300.00} in unauthorized charges. The credit bureaus have violates my rights under FCRA Section 605A by repeatedly allowing this disputed, inaccurate information back onto my credit reports even after initially blocking the account per federal law. I have spent countless stressful hours trying to resolve this legitimate fraud only to be dismissed, given the run around, and left to deal with the consequences like a plummeting credit score. The financial and emotional distress caused by XXXX and the credit bureaus ' lack of urgency and accountability has severely impacted my life. Despite multiple attempts to directly address the issue in good faith, XXXX continues to ignore evidence and suppress my fraud claims. The credit bureaus continue reinstating unverified, disputed information. These systemic failures warrant intervention and oversight from the CFPB. I urge the Bureau to exercise its enforcement authority to facilitate proper investigation and resolution of my identity theft case, ensure XXXX substantiates any claims with concrete evidence, compel the credit bureaus follow FCRA procedure, and secure reasonable compensation for provable damages. The mishandling of this matter extends beyond my personal frustrationit represents the urgent need to hold financial institutions and reporting agencies accountable for their roles in perpetuating harm against consumers.
