Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: On XXXX XX/XX/XXXX, one letter was sent to Midland Credit Management ( MCM ) in XXXX, MI to verify the debt they are reporting to the credit bureaus. The letter was received on XXXX XX/XX/XXXX and signed for by a XXXX XXXX. I have received a response from MCM dated XXXX XX/XX/XXXX as required by Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( a ) and ( b ). Even though I received this information, there wasn't any information that would verify debt. The information received are working documents. There is no wet signature document to verify that I have applied or owned that debt. They are reporting the debt as continuously late up through XX/XX/XXXX ; however, their own documents show that the debt was charged-off in XXXX. How can a debt be late if the account was charged off, which means it was closed? They are reporting as if I opened the account with them. Even the information reported between the three bureaus changes.

Consumer Complaint: According to 15 USC 1681 Congressional findings and statement of purpose ( a ) ( 1 ), it is evident that the banking system relies on fair and accurate credit reporting. Inaccurate credit reports can directly impair the efficiency of the banking system, while unfair credit reporting methods erode public confidence, which is fundamental to the continued functioning of the banking system. In light of this, I believe it is crucial to bring to your attention the creditor 's actions that have compromised the integrity of the credit reporting system. Additionally, under 15 USC 1666b Timing of payments, ( a ), creditors are obligated to adhere to specific timelines when it comes to credit card account payments. They may not treat a payment as late for any purpose unless they have established reasonable procedures to ensure that consumers receive periodic statements, including the information required by section 1637 ( b ) of the FCRA, no later than 21 days before the payment due date. If the creditor in question has failed to uphold these obligations, it represents a violation of my rights and the FCRA. I kindly request that the Consumer Financial Protection Bureau investigate these matters thoroughly and take appropriate action to address the creditor 's unfair practices. I believe that this investigation is necessary to protect my rights and the rights of other consumers who may have been similarly affected by these practices.
