Consumer Complaint: I have been disputing several accounts with XXXX here are two accounts I have been disputing from Midland Credit Management who has failed to provide debt validation or any information at all but continues to harass me with phone calls and threatening letters. The disputes from XXXX seem to be very quick only taking about 7 days when XXXX states in their website that dispute take around 30 to 45 days which leads me to believe XXXX is not actually investigating disputes this is an ongoing pattern with XXXX. Consumer Complaint: MIDLAND CREDIT you are furnishing inaccurate information to the consumer reporting agencies. The reporting of such inaccurate information has caused severe damage to my character, my reputation, my general mode of living, and my ability to obtain credit for personal and house purposes. You and your inaccurate reporting have damaged my livelihood. ( a ) Duty of furnishers of information to provide accurate information ( XXXX ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate. Duty : A moral or legal obligation ; a responsibility Accurate : correct in all details ; exact Prohibition : A law or regulation forbidding something As defined by the IRS : Even if you didn't receive a Form 1099-C, you must report canceled debt as gross income on your tax return. The IRS clearly defines a charge-off as Gross or ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes your reporting of this account inaccurate! By definition, the IRS clearly says a canceled debt or charge-off is income. The reporting of this account as a debt is inaccurate. 15 USC 1681 S-2 says YOU ; MIDLAND CREDIT , are a furnisher of information to a consumer reporting agency. You ARE PROHIBITED BY LAW to furnish inaccurate information. Consumer Complaint: Ok, I will cover my complaint one last time. Reg E requires pre authorization for ACH payments yes. However, your representatives told me I could not set up a payment arrangement WITHOUT setting up a RECURRING Pre Authorized ACH. Herein lies the problem as your representatives and your business practices are as such that consumers are required to void their rights in order to make payments under a payment arrangement on any debt your company has purchased. This behavior is a clear violation of Reg E and a business practice issue for your company to require representatives to FORCE by threatening litigation/REQUIRE consumers to set up a Recurring Pre Authorized ACH. As far as the other stuff in your complaint validation of debt and/or your right to pursue litigation was never a question. You are only attempting to deflect from the problem. The problem is your business practices that violate a consumers rights. Further your violation of Reg E, as you do not have the right to force via the use of litigation a consumer to grant you recurring pre authorization of payments. I recommend you correct this before someone else does.
