Issue: Problem with a lender or other company charging your account
Subissue: Can't stop withdrawals from your account
Consumer Complaint: On XX/XX/XXXX, I decided to refinance my car. I paid {$680.00} to Credit Acceptance Corporation. This was the difference in the actual value of my XXXX XXXX XXXX and the l balance with the lender at the time, Credit Acceptance Corporation. My credit union paid off the remaining balance. The transaction was seamless. I refinanced my car and the first payment has been deducted from my checking account with my credit union. On XX/XX/XXXX, I decided to make sure my mortgage payment had processed. While checking my account, I noticed that {$390.00} had been deducted by Credit Acceptance Corporation. I called and spoke to a nice young lady named XXXX. I told her about my dilemma, explaining that I did not want my mortgage payment and several other charges to bounce due to their mistake. Although she was very sympathetic, she said that she would need documentation from me, that it could be a lengthy process, and that it would be quicker for me to contact my credit union to have them dispute it. She confirmed that my account was paid off and that the payment was deducted anyway. She was just doing her job, and I understand that. But it left me, as a consumer in the cold. By the grace of God, I did have a few extra dollars to keep my mortgage from returning unpaid. It is automatically deducted from my checking account each month. But what If I had no other resources? This should not happen to anyone. It shows negligence on behalf of Credit Acceptance Corporation. Now I have to wait 5-10 business days for the funds to be disputed and restored to my account through my credit union. I am grateful that I had the extra funds to make up for the shortfall, but now I do not have access to that money during a pandemic. That is not fair. Not only do I want my funds refunded, but I also would like a letter on CAC letterhead apologizing for their mistake and promising that they have taken steps to keep this from ever happening again. Best Regards, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX processed my car refinance flawlessly. Their name should not be mentioned in anything published on line. This is strictly between me and CAC.

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: You are in direct violation of FCRA 623 ( a ) ( 5 ). Negative re-aging debt on a credit report is changing the delinquency status of an account to fool the credit bureaus into thinking its more recent than it really is, which is what you are doing by reporting the account as such and updating it monthly. I am very well versed in credit law and the practice of re-aging accounts. As you are no doubt aware, a collection is tied to the original account before it is charged off.You report that this account was opened - and therefore you are re-aging this account, which is illegal - so you are in violation of the FCRA, with fines of { {$1000.00} } per incident. I am requesting that you investigate this matter under the FCRA : * FCRA 623 ( a ) ( 8 ) Ability of Consumer to Dispute Information Directly with Furnisher * ( E ) Duty of person after receiving notice of dispute. After receiving a notice of dispute from a consumer pursuant to subparagraph ( D ), the person that provided the information in dispute to a consumer reporting agency shall -- * ( i ) conduct an investigation with respect to the disputed information ; * ( ii ) review all relevant information provided by the consumer with the notice ; * ( iii ) complete such person 's investigation of the dispute and report the results of the investigation to the consumer before the expiration of the period under section 611 ( a ) ( 1 ) within which a consumer reporting agency would be required to complete its action if the consumer had elected to dispute the information under that section ; and * ( iv ) if the investigation finds that the information reported was inaccurate, promptly notify each consumer reporting agency to which the person furnished the inaccurate information of that determination and provide to the agency any correction to that information that is necessary to make the information provided by the person accurate. In addition to the investigation, I am going to have to insist that you remove this illegal account from my 3 credit reports ( XXXX XXXX XXXX ) or you should expect an intent to sue in the mail, because I will have no choice but to take legal action.

Consumer Complaint: Creditor- CREDIT ACCEPTANCE CORP After vehicle was sold to me and later found out that it was a bad deal because vehicle could not drive shortly after getting it, Creditor told me that they were write off the loan. A few month later the loan showed on credit report as charged off that hurt my credit score. Years later on XX/XX/XXXX my score dropped 114 points, when i checked report it said that Credit Acceptance Corp, change the remarks on my credit and started reporting the account from charged to 30 days late. the loan was opened XX/XX/XXXX. Credit report shows 32 charge off status reported. Creditor is reporting inaccurately on my report that is hurting my credit. Account went from reporting 32 charge off payment status to reporting 30 days late on XX/XX/XXXX. I would like this to be reviewed and or reported correctly/deleted.
