Issue: False statements or representation

Subissue: Indicated you were committing crime by not paying debt

Consumer Complaint: I sent a dispute letter to Convergent Outsourcing ( creditor ) on XX/XX/2018. This letter stated that the information they provided was incorrect and the negative mark on my credit report was being falsely reported by them. I also asked in this letter for them to provide me with evidence bearing my signature, showing that I have or ever had some contractual obligation to pay them. A little over a week later, they responded with their " evidence '' and it was insufficient. The address that they had listed on the account was an address that I have never occupied. So, after receiving their letter I sent them a second letter on XX/XX/2018. This letter let them know that the information they are reporting is inaccurate and they have failed to show any alleged contract or instrument bearing my signature. I asked them once again to please show me any viable evidence that this account is being reported accurately, it has been over 31 days and I have not received a response.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: This is a follow up to my initial complaint about Convergent Outsourcing. I actually spoke with a representative today regarding the account that is in accurately reporting on my current report. Upon speaking with the representative she gave me information on two separate accounts they have in their office - One is from a XXXX XXXX XXXX address and is from an alleged debt, dating from XXXX and the other is XXXX XXXX XXXX ( XXXX ) The representative stated that they sent a final bill to my home as validation, which in fact is not proof a debt. I explained to her that I was actually a victim of fraud in the past as well and neither of the debts belong to me. On top of it, the statute of limitations for debt collection has run out on the one debt that they are trying to collect ( XXXX ). I would appreciate it if these debts are removed from my credit report as a copy of a final bill is not validation and not proof that the debt is mine and that they can collect the debt, along with the fact that the debt is over 9 years old.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: To Whom It May Concern : On XX/XX/2018, I was assisting my significant other try and obtain a bank account with XXXX XXXX XXXX. When applying for the account he found out that he was not able to open the account because of a XXXX record he had with a company by the name of XXXX XXXX, who is now XXXX XXXX. The representative at the Credit Union gave us the number she had listed as a contact, in which we called to inquire. The representative at now XXXX XXXX didnt have answers to the questions and at one point put the call on hold. After that a male voice answered the phone, How Can I Help You?, not identifying himself, not even by name. At this time, there was no introduction I was now speaking with Convergent Outsourcing, a third-party debt collection agency agent. I proceeded to tell the man on the phone I wasnt sure as I was put on hold and he came to the phone and would continue to inquire about the account on behalf of XXXX XXXX. Because I was inquiring about XXXX, he told me I would have to speak directly to the bank at that point I asked if I was speaking to a collection agency. He did respond by saying yes. I believe it wasnt until then he said that it was an attempt to collect debt. He asked me who he was speaking to, and I replied by saying XXXX XXXX. He continued the call without identifying who I was, just asked my name. At that point he didnt have the information regarding when the account would fall off XXXX so I then asked to speak to a supervisor. That supervisor too, asked me my name, and I responded, XXXX XXXX and proceeded to speak with me. Later on, in the call, I did inquire about her speaking with me and her response was, I can speak with anyone who calls about the account because they didnt have a contact on file. This is clearly a violation of the FDCPA. To follow-up regarding the FDCPA violation and complaint written by XXXX XXXX, he received a response regarding the this violation and several others they refused to address in the letter by misrepresenting me and falsifying documents to the different agencies, i.e., Consumer Protection Financial Bureau, Attorney General, and the XXXX XXXX XXXX stating they were not in violation because I was representing myself as a person of the business account in question from XXXX XXXX who listed herself on the document as a Compliance Supervisor. After receiving the letter, I too read the response, that falsified who I said I was and tried to follow-up with XXXX XXXX for clarification and to date, havent received a response to the above claim. When trying to call the business, Convergent Outsourcing, I was hung-up on by the receptionist and treated very rudely by all parties in the company. After asking for a supervisor, I was transferred to 3 different people, one who identified themselves as just a collection representative, another who said she was a team lead who worked with management and said all supervisors were in a meeting. I was finally able to get through to a person by the name of XXXX XXXX, who identified himself as a Managers Assistant he would not speak with me regarding the account after telling him how the letter read. He said he didnt feel comfortable. I asked him to have XXXX XXXX get back with me and to date, again, have not heard from her. After not hearing from her, XXXX and I went to the company where we were treated like criminals by the receptionists, one who said it was illegal to transfer calls without an account number and the other who refused to give her name because she was in fear that we would find her on XXXX? It took at least 20 minutes for them to send down the Operations Manager who was also rude and unhelpful. I had to wait for attention to tell her our concerns with the account as she stood up in the middle of the conversation and started looking for her cell phone, then proceeded to ask XXXX if he had seen it as if he stole it from her. It was very disturbing that she not only thought he stole it from her but that was her concern more than the customers she had in her office regarding FDCPA violations and abusive employees of Convergent Outsourcing. The receptionists both were working with paperwork face-up on their desks which too is a violation. I have now made several attempts to contact the company regarding this situation and the falsifying of records and they will not respond, the Operations Manager even said, she wasnt going to deal with the situation. I respectfully asked her why and she said she doesnt have to give me reason, very rudely. She also refused to give a time frame in which we can check back with her for answers. XXXX and I continue to get ignored and have no choice but to file complaints to resolve the issues we are having with Convergent Outsourcing. They are a business operating untactfully, falsely and not following federal guidelines written in the FDCPA.

Consumer Complaint: In XXXX of 2016, I moved out of an area that XXXX services. In XXXX, I received my final bill and I called in and made my last payment, I even asked the lady on the phone if that was it and she informed me that it was. Here we are, over 2 years later, and this company adds itself to my credit report without sending me ANY information. Very slimy actions, to be honest. Please send me verification of debt and remove yourself from my credit report before you're sued.

Issue: Incorrect information on your report

Subissue: Old information reappears or never goes away

Consumer Complaint: I had settled an account with XXXX XXXX on XX/XX/2018 in the amount of {$100.00} for an outstanding balance with XXXX totaling {$260.00}. Had I known that this third party collection agency had no authority, other than to report weekly the information that my account is cleared with them, to remove this pestering collection away from my credit file. I had been transferred 5 times total, to be told to call XXXX and then to call XXXX XXXX again to finally become informed of that there is nothing else they are able to do. XXXX has its own collection policy that I was unaware of and to my understanding I should no longer owe another {$160.00} if the collection agency only settled for the {$100.00}. To add, I do not plan to EVER reinstate services with XXXX in neither the near nor far future.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: For the past 4 months, I have reached out to XXXX XXXX, XXXX via certified mail regarding the {$1200.00} they say I owe. I have informed them over and over this is not my account. I have requested documentation verifying this account and they have yet to furnish me information verifying this debt. Additionally, they have not reported to the credit bureaus that I have been disputing this debt. Their lack of accuracy is causing me to have major credit issues, including disqualifying me for credit as well as causing me to accept higher interest rates.
