Consumer Complaint: On or about XX/XX/2023, I initiated a transaction to pay my XXXX XXXX credit card payment through the online bill payment system at my bank, Capital One. The amount of the payment was {$3600.00}. On the morning of XX/XX/XXXX, I checked my bank account and saw that the payment was actually sent to XXXX XXXX, rather than XXXX XXXX. The payment said pending, but when I called Capital One, I was told that since it was an electronic payment, they could not stop the payment. I filed a dispute on the payment with Capital One, which they declined because they said that I directed them to send the payment to XXXX XXXX, and that XXXX XXXX had " accepted '' the payment. They provided me with a credit trace # to track the payment with XXXX XXXX. I do not know if it was my error or the bank 's error that caused the money to be sent to XXXX XXXX instead of XXXX XXXX. I have called XXXX XXXX XXXX XXXX and I have gone into the local XXXX XXXX store. XXXX 's tactic has been to transfer me in a loop to various people in their foreign call center and to deny that they have received my money. I have spent hours on the phone with them and each time, I am transferred to at least XXXX different people, none of whom are willing and/or able to give me a definitive answer about whether or not XXXX received my money. I have had to take money from my savings account to pay the actual credit card payment to avoid having to pay late fees and interest. So, I have spent XXXX XXXXXXXX in less than a month. I am not sure if the credit trace number I received from the bank is a " confirmation '' that XXXX actually received the funds or if it only means that an electronic transfer was attempted. In any case, XXXX is telling me to talk to the bank and the bank is telling me to talk to XXXX. But each one has closed the case and refused to admit that they have my money. The bank at least provided written notice that they closed the case. I have asked them to reopen it. XXXX XXXX is refusing to help me at all. I only know that the case was closed because that's what the customer service person told me when I called to inquire about whether XXXX XXXX has the money. At this point, it seems that I will need to go through the time and expense of taking legal action to recover my funds. This is very unfair to a consumer. When I asked the bank to reopen the case, they said I would have to wait 15 days to get an answer. Meanwhile, I have bills to pay and I have no assurance that the money will be returned to me at that time. I have suffered both mentally and physically as a result of Capital One and XXXX XXXX ' handling of this erroneous payment.

Consumer Complaint: I am a XXXX XXXX XXXX XXXX citizen and a XXXX XXXX. I am a law abiding citizen. I have no criminal record whatsoever. I always pay my bills on time. My payments have never been returned except in 1 case where an honest mistake was made. I enjoyed an excellent credit score of around 750 before I became a victim of a scam. It is really very unfortunate and terrible thing that happened to me in my old age. It is tragic that Scammers and Fraudsters prey on innocent people especially sick and old people like myself and they show no mercy on their targets especially when less protected platforms like the one Capitalone has makes it very easy for them to prey on them. I state the following : 1 ) There seems to be total misunderstanding of this case by Capitalone that needs to be corrected. XXXX ) The XXXX cause of this fraud was that Capitalone accepted 3rd party payments from fraudsters without any validation who used Fake bank accounts to make payments which consequently resulted in return of payments. To prove my point, I had a similar situation with my XXXX XXXX XXXX XXXX XXXX. XXXX were not able to commit fraud against my XXXX XXXX XXXX credit card XXXX XXXX Bank XXXX XXXX didnt accept any 3rd party without validation and hence they were filtered out. XXXX ) I hold Capitalone liable for my loss for allowing XXXX party payments without validation and then also for readily posting the return payments as chargeback against my account without any investigation. XXXX ) XX/XX/XXXX was not the first time that I reported this case. In fact this case had been reported soon after it happened in XXXX XXXX but unfortunately it was denied by Capitalone then as it is being denied now. XXXX ) I am surprised that Capitalone has no records of my reporting this case to them in Apri/May soon after it happened. XXXX ) I considered fraudsters a legitimate business and that is why I gave them my credit card number just like I would do that to any other business when I do online shopping. I couldnt be held liable for that. I am the innocent victim. XXXX ) I was not able to actively pursue this case after I reported this case to Capitalone in XXXX XXXX because I suffered a Massive XXXX XXXX in XX/XX/XXXX which incapacitated me. My health continued to deteriorate up until XX/XX/XXXX that is when I had an XXXX XXXX XXXX. I am still recovering from that XXXX. XXXX ) The 4 returned transactions that I reported as fraudulent happened on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. Those transactions may be seen in my XX/XX/XXXX account statement. Two of those payments were made by online ACH payment and the other two were made by Electronic Phone Payments. XXXX ) Capitalone never investigated those 4 returned transactions that I reported as fraudulent but instead ended up investigating transactions that I never reported as fraudulent/unauthorized as stated by them in their online fraud acknowledgement letter of XX/XX/XXXX. How could Capitalaones investigation be valid when they investigated wrong transactions? XXXX ) The total value of returned payments posted on my account amounted to {$17000.00}. XXXX ) I made good those 4 returned payments out of my own pocket but it was falsely interpreted by Capitalone as if the Merchant credited my account. I made good those returned payments because I didnt want to lose my Capitalone credit card while I was sick recovering from the XXXX XXXX. I was also afraid that my credit score would plummet if I didnt make good those returned payments. I was definitely planning to take up the case with Capitalone as soon as my health would permit. XXXX ) The Notifications that I received from Capitalone for return payments all state that those payments were returned by my bank which is NOT accurate. The fact of the matter is that those payments were Never returned by my bank because those payments were not made by me or by my bank on the first place but instead were made by 3rd parties using Fake bank accounts. XXXX ) I Demand that Capitalone credit {$17000.00} to my account soon to keep their promise of zero fraud tolerance to their clients.

While account is charge off and closed, capital one is still reporting a balance of {$790.00} of an intital {$400.00} debt, and second account reporting {$510.00} of {$300.00} credit limit. I demand the account to be closed at a zero balance since that account is charge off. Due to possible inaccuracies in the these credit reports, I demand that the validation I hereby request be in the form of a verified statement by a person with knowledge of the debt, who can testify that the debt incurred legally, was not subsequently disputed as a result of returned, faulty, or recalled consumer products, was not utilized as a profit-loss tax deduction during the period it may have been payable, and was not claimed as a loss with any insuring entity during the period it may have been payable. Please be advised that I am requesting competent evidence that I had some contractual obligation in relation to the tradeline.

Consumer Complaint: in XXXX of XXXX four accounts were placed under the XXXX as an umbrella for other business accounts. In XXXX We closed all businesses and accounts. We used a debt consultation company but Capital one would not work with them because these accounts were under the XXXX. I officially closed these accounts and made and was told the online access would remain open and we would work on a settlement option to settle the accounts under a payment option. The day I closed the accounts I was locked out of all information. I lost the ability to get access to past and current documents because I was lied to. We were charged inflated and undue charges. They said on the phone it was late fees ( we were current ) and over the limit fees and higher interest fees. I to this day have never seen billing or accounting of this. The the fees were about doubled when reported on the credit report. The credit report shows all XXXX accounts are over the revolving limit and currently late and in collections. In 4 years I have had no written communication. These should be reported under the EIN number for XXXX and not under our personal report. Capital One has said they would report one thing but does another. They said they were sending account files that I never received. Keep changing dates of closing and late fees on credit reports.

Consumer Complaint: I called on XX/XX/XXXXXXXX and spoke to a XXXX XXXX Capitol One concerning my XXXX Rewards card. I explained to her that yes, my payment which was due on XX/XX/XXXX was one day late due to the fact that my SSI was not loaded on my card till the XXXX of XXXX. I had previously called before the XXXX and told them it would be one day late. They have now slapped me with an over {$19.00} interest charge, a {$28.00} late fee and a {$54.00} minimum payment. I made a {$50.00} payment on XX/XX/XXXX as soon as my money was posted. This {$50.00} more than covered my minimum payment of {$28.00}. In addition, it says my balance is STILL over the limit of {$750.00}. It did nothing to bring my balance down. Instead I get slapped with fees and what available credit I had disappeared. They are ripping people off, or in .y opinion they are me. I want this resolved, it is ridiculous.
