Issue: Getting a loan or lease
Subissue: Confusing or misleading advertising or marketing
Consumer Complaint: On XXXX XXXX, 2017, Ally Bank executive customer relations XXXX XXXX stated her company adjusted my account {$630.00} in compliance with the settlement entered by Ally Financial , Inc., the Consumer Financial Protection Bureau ( CFPB ), and the U.S Department of Justice ( DOJ ) by subtracting it from my original agreement for the purchase in accordance with section 2 ( e ) of the contract signed. However, section 2 ( e ) describes Our right to purchase required insurance if you fail to keep the vehicle insured ( see attached ) nowhere in the section referenced is the statement ( in part ) you agreed that we may subtract any refund from what you owe. I believe Ally is confused with the difference between settlement and credit. The definition of legal settlement In law, a settlement is a resolution between disputing parties about a legal case, reach either before or after court action begins. The term settlement also has other meanings in the context of law. The definition of credit verb add ( an amount of money ) to an account Therefore I am requesting Ally show documented proof that they have the authorization to disperse settlement funds by subtracting it from the original loan agreement, and proof the funds were applied to the account by a copy of the loan activity record. If no credible justification can be provided a check in the amount of {$630.00} be sent in my name to my home address.

Consumer Complaint: I opened a car loan with ally financial about 4 years ago, the car was defective and i tried returning it to the dealership within 1 week of pu rchasin g it, ( it still was under the warranty period ) th e dealer refused to take it back.i was forced to repair the vehicle out of pocket. I told ally financial the dealer wouldbt take it back and it was still under warranty they also refused to help me with this and forced .e to remain with the vehicle, pay the repairs and keep the loan.after thousands of dollars in repairs i voluntarily returned the vehicle to ally financial. Years laters they still send me letters to force me to pay. I provided all the information to all the credit reporting agencies and they have removed this loan feom my credit reports, but ally financial still harasses me for the money. I no longer wish that ally financial contacts me or send me letters or try to collect this from me. It was wrong for them to do this after i asked them to please help me return the vehicle while i still could and they refused. Please mind that the vehicle was sold in auction by them and they still want me to pay the remaining balance.

Subissue: Problem when attempting to purchase vehicle at the end of the lease
Consumer Complaint: Was on the phone with the company for over 4 hours today as I was transferred from person to person, department to department, in order to get my repossessed vehicle back. The reason stated for my vehicle being repossessed was that " I did not do anything to obtain financing ''. This is clearly a lie as you will see in my documents. This company purposely refused to offer any help or assistance in the post-lease options and took the vehicle because of their failure to provide this customer with proper financing options.

Consumer Complaint: I called on the XXXX XXXX XXXX 2017 to request a payment deferment. It was granted. I specifically stated multiple times that I did not want the deferment to negatively effect my credit with them reporting a 30 day late. The representative assured me 3 times that it was an approved deferement and by paying a {$250.00} fee. My payment would be caught up and I would have no payment due until XXXX 2017. Which would represent my normal monthly payment. I have paid my loan on time every month an was my first payment deferment request. At any rate 3 days later and Ally bank reported erroneously a 30 day late to my credit report dropping my credit score XXXX points.

I have submitted the paperwork to get my title through the BMV of Indiana and now they tell me that National Auto Finance has a lien on the car. I have been calling National Auto Finance back all week and they said there is no lien on the car, but they have to verify that the State of Indiana tax lien has been paid. I have been calling them and all i get is " We will call you back. '' THEY NEVER CALL ME BACK. I want my title to my car as it 's been two years that I have been dealing with this.
