Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: This is a XXXX addendum to my complaint against Ally. So to date, Ally has reported to the credit bureaus a voluntary repossession and has noted incorrect lateness on all my credit reports. In addition to that and the most concerning is that I received a letter from Ally that states that I told them I have a lawyer so they will not be submitting any information to me and for me to provide the name of my lawyer so the information can be released to my lawyer and I had a timeline to do so before they would contact me. I just received this letter on Thursday, XX/XX/XXXX. Please see letter attached. So I called Ally and I spoke with someone and advised that I do not have a lawyer and I need the information of the sale sent to me so that I can rectify the remaining balance. He said he would take my information and record it. I am concerned that with all the incorrect information on this sub-prime loan that I will not get a fair shot at paying the balance. Currently on my credit report they have two balances listed which is concerning. 1 for {$880.00} late amount and a 2 a total balance of {$25000.00} for the loan. These are clear, however I am not clear on what these are and Ally representatives are not providing any information.

Issue: Closing on a mortgage
Subissue:
Consumer Complaint: Two complaints : 1 - Was told we would be going beyond our lock rate date and would need to " to either extend the lock or pull the application. '' No costs or other information was provided to us. As rates have decreased since we started this process, this seems like a deceptive practice to obtain more money from us without giving us complete information. 2 - Had issues scheduling an appraisal. Company would not let me choose appraiser or schedule an exterior only appraisal to confirm property value. The appraisal company the bank choose refused multiple times to schedule the appraisal on more than 1 day 's notice. The bank refused to return numerous messages about this, which ultimately caused many delays. I do not understand why the bank does not allow for flexibility in the appraisal process or why the appraisal company refused numerous times to schedule beyond one day. Ally Bank for home loans is the definition of a complete scam.

Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: My name is XXXX XXXX and I am an XXXX licensed in XXXX XXXX # XXXX and XXXX XXXX XXXX # XXXX. My Stepfather XXXX XXXX passed away on XX/XX/2020 and had a lease on a XXXX from XXXX from Ally Financial. My mom is XXXX and can not take care of herself and had to be transferred to an assisted living facility and I intend to return to the car to XXXX as soon as COVID is over, but my wife is pregnant so I do not want to risk going to XXXX, especially since as I understand it an auto payment of {$250.00} is being made to Ally Financial anyway. I informed Ally Financial of my stepfather 's death and there seemed to be no issue, but approximately a month ago my mother began receiving harassing and threatening phone calls from a woman named XXXX XXXX who called from XXXX XXXX XXXX XXXX in XXXX, Florida would not even identify where she was from, but repeatedly called my mom in her assisted living home and threatened to lien her home. I attempted to call her back, but nobody could connect me to Ms. XXXX whoever she may be. I am unsure if this is a scam from Ally Financial or if this Ms. XXXX is a scam XXXX. Ms. XXXX should not be harassing elderly widows in retirement homes and at the very least some form of written notice should have been sent, but none has come.
