Issue: Incorrect information on your report

Subissue: Public record information inaccurate

Consumer Complaint: In XX/XX/XXXX AES was discharged in bankruptcy. They refuse to stop harassing me or remove the debt. I continue to get bills, statements and everything from this company. I have sent them bk discharge papers numerous times over the years including copies of my credit reports showing it was discharged in BK in XX/XX/XXXX. They will not remove it, respect the judges decision and continue to break the law. Once the BK fell off of my credit report, they put it back on with 10 yrs worth of interest. I am looking for a attorney but I am being denied credit and my credit limit is being limited because this debt is being reported. They are currently in contempt of court. I sent a certified cease and desist letter.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I am on income driven repayment and received inadequate notice from my servicing company regarding the critical deadline that was approaching for my annual recertification. I received absolutely no US Postal mail from the company, no phone calls, or text messages. The only notification I received was an email on XX/XX/XXXX with the unspecific subject " Action Required : View the message in your Paperless Inbox and take action! '' Unfortunately this email was received after my loan servicer had already capitalized all my outstanding interest ( interest capitalization occurred on XX/XX/XXXX ), and had also increased my monthly payment from {$320.00} to {$2300.00}. I received no notification from the company that either of these two major changes to my account had taken place. I had to discover these changes for myself by logging into my account. Upon calling my servicer on XX/XX/XXXX, I was told my only option was to go into forbearance while they reviewed my now submitted ( submitted XX/XX/XXXX ) annual recertification I was also told to call my bank and do a stop payment for the payment that was due the next day. I did inform my servicer that I could still make a payment, just not the full {$2300.00}. My servicer told me that there were absolutely no negative ramifications from going into forbearance. After my initial call is when I discovered that the interest had already been capitalized. I called my servicer back ( still XX/XX/XXXX ) and they said there was nothing they could do to undo the capitalization of interest.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: To Whom It May Concern : I had two loans described below : 1 ) Stafford for {$4200.00} 2 ) DL Stafford for {$4900.00}. The school was either XXXX XXXX or XXXX XXXX XXXX XXXX XXXX. I paid of the full balances of these two loans about three years ago. Since then, XXXX XXXX XXXX kept sending me generic notices confirming that my loans were paid off and that I had no payment due. I kept meaning to call them and ask them to stop sending me these notices in order to save the paper, but it took me awhile. I finally did that today on XX/XX/XXXX. When I asked them to stop mailing these notices, they said I had a balance. I was shocked! I do not think there is any possible way that could be accurate. I told them that I have been receiving these notices ever since I paid off the loans, and they all say the same thing : that I have a XXXX balance with no payment due. One of the latest notices I got, which is right beside me now, shows the two loans and states at the top : PAID IN FULL NOTIFICATION. However, the customer service agent at XXXX XXXX told me that I owed interest of {$71.00} and an additional {$13.00}. Where on Earth did these amounts come from after three years? And why didn't they ever send me a notice clearly stating this? They never did, and now they expect me to pay this so-called interest that's been accumulating all of this time. Interest that's been accumulating on what, I am not certain. As I said, I paid these off in full in XXXX. I believe this practice of XXXX XXXX to be completely deceptive and disreputable. I told them that it must be their error, and they did not offer to adjust it or to listen to my explanation, for that matter. Of the two most recent notices I received, one was the paid-in-full notice mentioned above. The other one says monthly bill at the top. These are the same notices I've been receiving for the past three years. These bills always had a bunch of zeros on them, which is why I stopped paying attention to them and why I asked XXXX XXXX to stop sending them to me, in order to save the resources. When I looked more closely at this current " bill, '' it shows {$71.00} in the Current Balance box. I still do not know where this amount came from. I am certain it is an error. If it is not, XXXX XXXX must do a much better job of alerting their customers, in my case former customer, of any remaining or outstanding balances. It is not an ethical practice to state zero balances for years and then to suddenly show a balance that didn't exist before. It is also a very unsound and incompetent reporting process to state loans are paid in full and no payment is due but then contradict and state that I now owe interest. Please help me resolve this issue with XXXX XXXX, not just for my benefit but for every customer they now have or will have in the future. Sincerely, XXXX XXXX

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Back in XX/XX/XXXX, my wife and I were struggling to pay our two student loans and I contacted AES to find out what can be done. I was contacted by an agent that told me our best bet was to consolidate our loans. Based on his advice, we did, only to find out that it effectively made our situation much worse. XXXX is the servicer of our consolidation loan, which currently sits at 7 % and despite several attempts to reduce this percentage, we were told we were given one chance but a late payment took that opportunity away. Additionally, by consolidating, I took away my qualification for Public Service Loan forgiveness program ( I have worked in XXXX XXXX in XXXX since XX/XX/XXXX ). This was NEVER disclosed to me during the sales pitch to consolidate our loans. It has now been over TWENTY FIVE YEARS since I first started paying on my student loans and over 12 since we were talked into consolidating - and our principal has actually gone UP significantly since the consolidation. I want answers and I want retribution for all the money we have paid into our loans without seeing any reduction of our principal balance. XXXX and its representatives ( and I blame AES services too ) misled us and we have been paying for it - literally - ever since.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: After struggling for months to begin making payments on an income based repayment plan I was approved for in XX/XX/2017 and trying to make payments on, a 2 month forbearance was applied to my account without my consent. When I asked a representative why the forbearance was applied I was told that they could find no reason for the forbearance to be applied. The representative confirmed that the forbearance should not have been applied and was not agreed to by me. I'm concerned that XXXX XXXX is applying forbearances to accounts of borrowers who are struggling to make payments to continue to keep borrowers like me from beginning making payments on IBRs and to continue capitalizing interest.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: In your response to my previous complaint, you stated that based on your " thorough review '' forbearance was requested after the loans were reported which restored my account to a current status from the time it was applied. Which does not allow a retraction of adverse credit information that was accurate at the time of the reporting. I have a notice from XXXX, dated XX/XX/XXXX, that states you have received and processed my recent forbearance request. In addition to that, I also received the " Forbearance Loan Declaration '' which outlines the details below. XXXX XX/XX/XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XX/XX/XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XX/XX/XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XX/XX/XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XX/XX/XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XXXX Approved : Delinquency Forbearance XXXX Approved : General Forbearance XX/XX/XXXX-XX/XX/XXXX XXXX XXXX Approved : Delinquency Forbearance XXXXXXXXXX/XX/XXXX Approved : General ForbearanceXX/XX/XXXX-XX/XX/XXXX As you can see, the loans that are being reported as past due were in fact approved for retracted forbearance. By failing to update previously reported information, XXXX is in violation of Section 623 ( a ) ( 2 ) of the FCRA. The advisory opinion states that the Section 623 ( a ) ( 2 ) of the FCRA addresses the duty to correct and update information by furnishers, or persons who furnish information to consumer reporting agencies ( CRA ) such as credit bureaus. In particular, this section requires a person that has furnished to a consumer reporting agency information that the person determines is not complete or accurate to promptly notify the consumer reporting agency of that determination and provide any information needed to make it complete and accurate. Thus, on its face, this provision requires a furnisher to provide corrected or updated information to the consumer reporting agency that it had reported to originally. This duty extends to all student loan accounts reported to CRAs, regardless of whether they were accurate at one point, because the section requires the furnisher both to update accounts as well as to correct. I am requesting that in compliance with Section 623 ( a ) ( 2 ) of the FCRA that the 2 accounts showing late payments from XX/XX/XXXX- XX/XX/XXXX be updated and/or corrected and removed to accurately reflect my payment status.
